FAR Subpart 13.5 Simplified Procedures for Certain Commercial Items Sole Source Justification and Approval

1. Contracting Activity: Regional Health Contracting Office – Central, U.S. Army Health Contracting Activity, 3551 Roger Brooke Drive, Joint Base San Antonio (JBSA) – Fort Sam Houston, Texas 78234.

2. Description of Action: The Regional Health Contracting Office – Central requests approval for the Specialty Beds at Brooke Army Medical Center (BAMC), Fort Sam Houston, Texas. This requirement is Firmed Fixed Price Blanket Purchase Agreement utilizing Defense Health Program, Army FY20 Funds.

3. Description of Supplies/Services: US Army Department of Surgery has a requirement for medical grade specialty/ therapy beds with various accessories (e.g., side rails, grab bars, foot support and bed alarms) for the US Army Regional Health Command. Some patients require special beds during a hospital stay, particularly burn patients and those requiring bariatric care or spinal/cranial patients.

Period of Performance: 1 May 2020 to 30 September 2020 Total Value:

4. Authority Cited: The statutory authority permitting other than full and open competition is 41 United States Code 1901 as implemented in (FAR) 13.501(a)(1)(ii), sole source (including brand name) under the authority of the simplified procedures for certain commercial items.

5. Reason for Authority Cited: Market research was conducted on 28 August 2019, based on potential sources that were provided by the small business specialist.

However, this research revealed that those businesses could not provide the type of beds required for this effort. One of the vendors offered a bed by Hill-Rom. Hill-Rom's proposal that was submitted for the original BPA (W81K00-16-A-0024) was deemed technically unacceptable. The other vendor only provided a capability statement indicating their ability to install exam tables. The basic contract was awarded on 1 October 2016. The Government exhausted all resources and made a diligent effort to locate small business that could offer these services, in this case, Arjohuntleigh is the only company that can provide these services.

6. Efforts to Obtain Competition: A request for quotation (RFQ) was posted to the Government point of Entry (GPE) under solicitation number W81K00-16-T-M047.

Quotes were submitted by Arjohuntleigh, Inc., Size Wise and Hill-Rom. However, only the quote submitted by Arjohuntleigh was determined to be technically acceptable. The other vendors did not offer all bed positions, rotation or battery back-up specifications.

Therefore, BPA W81K00-16-A-0024 was awarded to Arjohuntleigh on 1 October 2016.

a. Effective competition. Once the Blanket Purchase Agreement ends, the requirement will be solicited via GPE under full and open competitive procedures in accordance with FAR Parts 12 and 13.5. The Government will continue to assess the market for companies providing Specialty Beds.

b. Subcontracting competition. A subcontracting plan is not required, as it below the threshold of $700,000.00 in accordance with FAR 52.219-9 Small Business Subcontracting Plan.

7. Actions to Increase Competition: After award, the justification will be posted to FedBizOpps. Prior to expiration of the contemplated Blanket Purchase Agreement, market research will be performed to determine if other sources exist that meet or exceed the Government’s needs, should the Government decide to continue the need for Specialty Beds. An annual evaluation of the market will be conducted prior to the exercise of any of option related to this requirement. Pricing, availability and any alternative solutions will be the focus of that research.

8. Market Research: Market research revealed there was only one source capable of performing this requirement. The Government exhausted all resources and made a diligent effort to locate small businesses that could offer these services, in this case, Arjohuntleigh is the only company that can provide these services.

9. Interested Sources: To date, no other sources have written to express an interest. As stated above in paragraph 6, the notices required by FAR 5.201 shall be published, and any bids or proposals received shall be considered, at this time there are none that could provide the requirement.
