1. This request for quotation (RFQ) is to support USACE's Southern and Northern Operations Branch (SOB/NOB) installations requirement to provide and install new gas (propane) HVAC units at multiple project locations in the Southern and Northern Branches of the Sacramento District. These HVAC units shall meet ENERGY STAR specifications for energy efficiency.

The goal is to provide HVAC systems for climate controlled, air purified heating and cooling for personnel office buildings and work areas.

2. Contractors are requested to submit a price quotation in response to this RFQ and Attachment 3 - CLIN Pricing Worksheet, and other applicable terms and conditions as listed in this RFQ and associated Attachments. All pricing must be inserted into Attachment 3 and provided as part of your quotation. Further information on submission of technical and price quotations is provided throughout this document. Contractors must provide technical specifications demonstrating the ability to meet the salient characteristics identified by the Government in Attachment 1 below for any "or equal" items quoted.

This contract is subject to the Federal SCRM policies and regulations including the Defense Federal Acquisition Regulation Supplement (DFARS) 252.239-7017 Notice of Supply Chain Risk, 252.239-7018 Supply Chain Risk, DoD Instruction 5200.44 Protection of Mission Critical Functions to Achieve Trusted Systems and Networks, Section 806 of the FY2011 NDAA Requirements for Information Relating to Supply Chain Risk, and internal SCRM Processes and Procedures.

If a SCRM concern arises after contract award, the Government will determine whether a continuation of the contract poses an undue risk to both the common defense and security to this nation. If the Government determines that such a risk exists, the Government reserves the right to accept or reject a proposed mitigation plan by the Contractor (if one or more is presented within a reasonable time) or terminate the contract.

5. Evaluation Factors and Basis for Award Determination:

Award will be made to the contractor whose quotation is determined to represent the overall best value to the Government using an LPTA evaluation process. Quotations will be evaluated with regard to technical compliance and on price submissions. All aspects of Attachment 1 must be addressed for a quotation to be considered for award. The quotation should include all information the contractor wants the Government to consider and evaluate regarding its company’s ability to conform to all required terms and conditions. The below evaluation factors and subfactors will be used in the determination of technical acceptability.

a. The agency intends to award an FFP order using the LPTA methodology. After receipt of quotations, the Government will first evaluate the lowest price quotation. If the lowest price quotation is determined to be technically acceptable and otherwise properly awardable, award will be made to that offeror. The Government reserves the right to evaluate only the lowest price quotation or to conduct further evaluations of additional quotations.

b. The standards for determining technical acceptability are listed below. Quotations must be submitted on the attached CLIN Pricing Worksheet in MS Excel format utilizing Attachment 3. Failure to provide pricing on the provided template (Attachment 3) may result in removal of your quote from further consideration. All formulas shall remain present in the spreadsheet for verification. The Government reserves the right not to consider for award any quotation that does not adhere to the administrative requirements of this RFQ.

c. Evaluation Criteria: The evaluation method that will be utilized is Lowest Priced

Technically Acceptable (LPTA) in accordance with FAR 15.101-2. Award will be made on the basis of the lowest evaluated price of quotes meeting or exceeding the acceptability standards for non-cost factors. Tradeoffs are not permitted. Quotes are evaluated for acceptability but not ranked using the non-cost/price factors. The evaluation criteria are as follows: Price and Technical Capability.

(1) Technical Approach Factor: The Technical Subfactors will be evaluated and rated either Acceptable or Unacceptable IAW the evaluation table below. In order for a quotation to be rated overall Technically Acceptable, the contractor must be able to provide all of the equipment (or equal to) and services set forth in the Attachment 1. If a requested item(s) is/are end of life and no longer available from the Original Equipment Manufacturer (OEM) the contractor at the direction of the OEM can propose a substitution, this substitution must be clearly identified in the quotation and documented with information from the OEM. All items must be new products.

Evaluation Table - Technical Ratings Rating Description

Acceptable Proposal/quotation meets the minimum requirements of the solicitation.

Unacceptable Proposal/quotation does not meet the minimum requirements of the solicitation.

(2) Price Factor:

(a) Price quotations will be evaluated and the Government reserves the right, but is not obligated, to perform a price realism analysis. The total evaluated price will consist of the contractor’s quoted price for all items listed on Attachment 3.

(b) Optional CLINs - Applicable Optional CLINs Not Applicable

The total price evaluated will be the sum of all CLINs for the basic and all options.

The inclusion of an option, however, does not obligate the Government to exercise the option.

6. DD254 - Applicable DD254 Not Applicable - Contractors must complete and submit with quotation Blocks 6, 7, and 8 of the DD Form 254 with the appropriate information for their companies. A separate DD Form 254 must be submitted for each proposed subcontractor (when applicable).

7. GSA Federal Supply Schedule (FSS) - Applicable GSA FSS Not Applicable - All proposed products MUST be available on an existing GSA FSS pricelist. Provide a copy of the GSA schedule introduction page and a copy of the page listing the items or identify a web site link for the Government to verify the items are on GSA schedule.

8. Please provide your business size, taxpayer identification (TIN), CAGE code, DUNS, discount terms, and estimated delivery date with your quotation. At a minimum, the contractor must provide the same warranty terms offered to the general public for products purchased.

Information regarding the standard OEM equipment warranty (terms, effective date and duration) for all items must be included with the quotation.

9. Partial quotations of the listed items will be accepted. not be accepted.

In the event that all requested items are not available from a single contractor, the Government reserves the right to award multiple orders in the combination that is in the best interest of the Government based upon this RFQ.

10. Completeness of Pricing Quotations. The Federal Government is exempt from sales tax. If requested, the Contracting Officer can provide a tax exempt certificate after award. However, if there are any valid applicable taxes such as the Arizona Half Tax or Hawaii GET for supplies or services, contractors must include the costs in their quote as a separate line item. Such taxes will not be considered or paid unless they are included in the quote at the time of submission. Price quotations must be complete at the time of submission.

11. Delivery Address. Quoted prices shall include all costs associated with delivering the required items to the delivery address listed in Attachment 1. Contractors shall include the contract number on any shipping labels.

12. Requested Delivery Date: All items are to be delivered no later than the date identified in paragraph 1 above. Contractors are required to obtain delivery quotes from the OEM for all equipment listed on Attachment 1 in order to provide anticipated delivery information in their quotation. Failure to provide on time delivery may result in actions taken against the contractor by the Government. Late deliveries may result in negative ratings on the Contractors Performance Assessment Report.

13. The Government intends to evaluate quotations and award a contract without exchanges with contractors. However, the Government reserves the right to conduct exchanges or seek clarifications if the Contracting Officer determines they are necessary. The Government further reserves the right to reduce the number of quotations being competitively considered to the greatest number that will permit efficient competition among the most highly rated quotations. If a contractor’s quotation is removed from further consideration for award, written notice of the removal will be provided to the contractor. In the event issues pertaining to a proposed task cannot be resolved to the Contracting Officer's satisfaction, the Government reserves the right to withdraw and cancel the proposed order. In such event, contractors will be notified in writing.

14. Attachment 4 contains provisions that apply to this solicitation and clauses that will be applicable to the resulting award. Some of the provisions and additional instructions require a response from the contractor and must be submitted along with your quotation.

15. In response to this RFQ, no terms, conditions, or assumptions will be entertained. If terms, conditions, or assumptions are included in a quotation, the quotation may be excluded because it failed to comply with the RFQ instructions.

16. All quotations received in response to this RFQ shall remain valid for 90 calendar days from the quotation due date below. By submitting a quotation in response to this solicitation, you are submitting an offer that the Government may accept, and you agree that if the Government awards you the contract, the award document sent by the Government to the contractor is a binding and enforceable contract. The contractor has a legal obligation to perform if awarded the contract.

17. Portions of the offeror’s quotation may be incorporated into the contract.

18. This solicitation for commercial items prepared in accordance with FAR Part 13.5

If offerors object to any of the companies listed as participating on the source selection team, the offeror must send their objection to the contracting office point of contact immediately.
