About this file
This document is a Justification for Urgent Acquisition related to a federal contract opportunity for towing and docking services for Landing Craft Utility (LCU) vessels during the 2024 Hurricane Season. The requirement was initially identified in February 2024, but no funding was identified until May 2024, leaving little time before the hurricane season begins on June 1st. The crafts cannot remain where they are stored once Hurricane Condition III is set, and the existing piers at ACU 2 cannot support the craft in wind conditions above 50 knots. The Contracting Officer determined that only one source, Fairlead Boatworks, Inc., could meet the required 3-5 day delivery timeframe. A contract was awarded to Fairlead Boatworks, Inc. on June 20, 2024 for $195,583.00 under Urgent and Compelling conditions.

Subj: JUSTIFICATION FOR URGENT ACQUISITION
Ref: (a) Procurement Request No: V5321041234301
(b) Federal Acquisition Regulation 13.106-1(b)
1. URGENCY: This justification is provided to support the processing of reference (a) on an urgent basis (i.e., more quickly than the routine cycle timeframes of 20 days for requirements less than $25,000 and 30 days for requirements greater than $25,000 but less than $150,000.
Processing of a requirement on an urgent basis may allow the soliciting from a single source if Contracting Officer determines that the circumstances deem only one source reasonably available. This justification is based on the following facts:
1 FEBRUARY 24, date on which the requirement was first identified.
22 MAY 24, is the date on which the requirement was submitted to the contracting department.
30 JUNE 24, is the required delivery date as indicated on the requisition. The hurricane season officially starts 1 JUN 24, but it is historically unlikely an event will occur before 1 JUL 24.
_X _ Explanation of the special circumstances and conditions that exist validating the requirement as "urgent".
Original requisition for towing and docking services for the 2024 Hurricane Season for Landing Craft Utility (LCU)- was developed in February.
However, no funding was identified for the requirement until 1 MAY 24. The hurricane season officially starts 1 JUN 24, but it is historically unlikely an event will occur before 1 JUL 24. NOAA has predicted a significant number of storms this season.
_X_ How this requirement will impact your mission (i.e., the specific harm that would result) if you do not receive the material or service by the required delivery date. (Note: Delays in production schedules alone or failure to expend monies are not acceptable reasons for justifying urgency.)
ACU 2 does not have sufficient piers to support the craft in wind conditions above 50 knots. NAVFAC is working on a repair and replacement plan, but it will not support the FY24 or FY 25 Hurricane seasons. The craft cannot stay where they are stored once Hurricane Condition III is set by CNSL.
_X_ Estimated production lead time for the item (how long will it take the contractor to produce the item or complete the service once the contract is awarded)
Contract award to craft pick up is 3-5 days.
The following firms were contacted and have indicated that they cannot provide an item that will meet the needs of the Government.
Only one source can meet required delivery date.
1.___N/A Sole Source____ (Company Name & Phone number) (Person Contacted) (Date of call)
(Reason*)
2.___N/A Sole Source____ (Company Name & Phone number) (Person Contacted) (Date of call)
(Reason*)
3.___N/A Sole Source_____ (Company Name & Phone number) (Person Contacted) (Date of call)
(Reason*)
*Possible reasons that a firm could not provide a supply or service include it is something the company does not manufacture, their product line does not meet the minimum performance requirements of the Government, they could not meet the Governments delivery requirement and/or other similar reasons.
