About this file

This document is a Justification and Approval (J&A) for Other Than Full and Open Competition for the Department of Veterans Affairs Medical Center in Wilkes-Barre, PA. The urgent requirement is to replace approximately 4,800 feet of 750Kcmil copper electrical cables in the main hospital's electrical system due to insulation failure and observed electrical arcing. The estimated project cost is between $100,000-$200,000, with work expected to begin immediately and take approximately fourteen days to complete.

Market research identified three potentially qualified electrical contractors within 26.1 miles of the campus, with Cavanaugh Electrical Contractng LLC (8 miles away) and Action Contractng & Electrical Co LLC (15.7 miles away) being the most viable options. The J&A justifies using the "Unusual and Compelling Urgency" statutory authority under FAR 6.302-2, emphasizing that the cable replacement is critical to maintaining electrical power for medical equipment and the hospital's operational mission. The document is signed by Robert Calarco and Stephanie Luniewski, with an effective date of 04/15/24.

DEPARTMENT OF VETERANS AFFAIRS

Justification and Approval (J&A) For

Other Than Full and Open Competition (>SAT)

Acquisition Plan Action ID:

1. Contracting Activity: Department of Veteran Affairs Medical Center (VAMC), Network

Contracting Office 4 (NCO4).

Nature and/or Description of the Action Being Processed: The Department of Veterans Affairs Medical Center (VAMC), located in Wilkes Barre, PA, has failed electrical cables (insulation failure) in the main hospital that need to be replaced immediately. WB VAMC experienced electrical outages across the campus. Electricity has been temporarily restored through an electrical rerouting but corrective action is urgently required.

2. Description of Supplies/Services Required to Meet the Agency’s Needs: The contractor will supply the labor to remove approximately 4,800 feet of 750Kcmil of copper cable (in conduit/duct bank) from a stepdown transformer to a switch panel and reinstall, terminate, test and land 4,800 feet of 750Kcmil of copper cable in existing conduit/duct bank. The cost is estimated to be between $100,000-200,000. This work will need to begin immediately upon award and will take approximately fourteen days to complete.

3. Statutory Authority Permitting Other than Full and Open Competition:

( ) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per 41 USC §3304(a)(1) as implemented by FAR 6.302-1;

(X) (2) Unusual and Compelling Urgency per 41 USC §3304(a)(2) as implemented by

FAR 6.302-2;

( ) (3) Industrial Mobilization, Engineering, Developmental or Research Capability or Expert Services per 41 USC §3304(a)(3) as implemented by FAR 6.302-3;

( ) (4) International Agreement per 41 USC §3304(a)(4) as implemented by FAR 6.302-4

( ) (5) Authorized or Required by Statute per 41 USC §3304(a)(5) as implemented by FAR 6.302-5;

( ) (6) National Security per 41 USC §3304(a)(6) as implemented by FAR 6.302-6;

( ) (7) Public Interest per 41 USC §3304(a)(7) as implemented by FAR 6.302-7;

4. Demonstration that the Contractor’s Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority):

Unusual and Compelling Urgency (FAR 6.302-2, 6.303-2(a)(9)(ii)) – On July 30, 2025, electricians were in the main electrical room when they observed what was described as electrical arcing. Upon investigation, they saw acing coming out of a ductbank. Then put on the appropriate PPE and shut down the switch panel (one of the facility’s main panels) that this duct bank feeds. This action caused the arcing to stop. Electrical personnel gathered the proper equipment and started to remove the covers on the ductbank where the arcing was observed. It was at this point that significant scorch marks were observed in several locations https://www.acquisition.gov/far/part-6#FAR_6_302_2 https://www.acquisition.gov/far/part-6#FAR_6_303_2

Acquisition ID#: __________________ within the ductbank. This arcing is only possible if the cable insulation has failed, which it did in several locations. With the number of insulation failures, the overall quality of all the cables insulation is questionable. All the cables in this duct bank must be replaced. These cables are one half of the total number that feeds this main switchboard. Only the cables in the ductbank that experienced the arcing require replacement. These cables are essential to the normal operation of the main switch panel. The main switch panel is essential to providing electrical power to the medical equipment in the hospital. Operational medical equipment is essential for the hospital to fulfill its mission.

5. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: Wilkes-Barre Pennsylvania is not a large population area and therefore there are not a large number of qualified electrical contractors. Market Research will be performed to identify potential sources.

6.

7. Determination by the CO that the Anticipated Cost to the Government will be Fair and

Reasonable: The Contracting Officer will make a fair and reasonable determination prior to award.

8. Description of the Market Research Conducted and the Results, or a Statement of the

Reasons Market Research Was Not Conducted: Fourteen small business contractors were identified on a Small Business Dynamic Search. Further research narrowed this list down to three possibly qualified companies. A search on VetCert for the three companies resulted in zero (0) SDVOSB or VOSB possibilities from these results.
