About this file
This document is a Sole Source Justification and Approval for the replacement of an Uninterruptible Power Supply (UPS) System under a firm-fixed-price contract. The U.S. Army Mission and Installation Contracting Command, Fort Belvoir is procuring a new 120kVA/120kW, 208/120-208/120V, 3 phase, 4 Wire Power System with Remote Emergency Power Off (REPO) System, Stand Alone and Combination Bypass System, Power/Load Sharing Capabilities, and Cellwatch Battery Monitoring System from EATON Corporation. The total estimated value of the contract is $839,000.00, with an anticipated award date of September 27, 2024, and delivery by June 9, 2026. The justification cites EATON's proprietary design and integration of the existing Facility Power Complex, which includes commercial power feeds, switchgear, and generators, as the sole source for the replacement UPS. A sources sought notice was posted, but no other vendors were found capable of meeting the requirement. The contract will be awarded under the Simplified Procedures for Certain Commercial Items, as implemented by FAR Subpart 13.5.

Sole Source Justification and Approval
1. Contracting Activity: U.S. Army Mission and Installation Contracting Command, Fort Belvoir (MICC-FB), 9410 Jackson Loop, Fort Belvoir, VA 22060.
2. Description of Action: The Regional Network Enterprise Center – National Capital Region (RNEC-NCR) requests a firm-fixed-price contract with EATON Corporation, 8609 Six Forks Rd., Raleigh, NC 27615. The Government projects award for 27 September 2024 and fiscal year 2024/2026 Other Procurement Army (OPA) funds will be used. An acquisition plan is not required because this procurement does not meet the threshold at Defense Federal Acquisition Regulation Supplement 207.103(d)(i)(B).
3. Description of Supplies/Services: This action is to replace an Uninterruptible Power Supply (UPS) System that was at End of Life over 10 years ago. Replacement is vital to continued operation of this facility which provides vital communication services to Ft. Belvoir, The National Capital Region and our Warfighters worldwide. The Contractor, EATON Corporation, shall provide all necessary products, components, materials, tools, and trained personnel to perform replacement of the existing UPS System in support of the RNEC-NCR. In addition, this will include the testing and validating the operation of the UPS System. The new system will consist of 120kVA/120kW, 208/120-208/120V, 3 phase, 4 Wire Power System with Remote Emergency Power Off (REPO) System. The system will have a Stand Alone and Combination Bypass System with Power / Load sharing capabilities and a Cellwatch Battery Monitoring System for a total of 160 batteries. The Monitoring System will consist of Touch Screen Monitoring on Units and Remote Monitoring capabilities that provide Error Detection and Fault Isolation and Network Based Monitoring. The Contractor shall remove the existing UPS System before installation of the new UPS System. The Contractor will be responsible for removing and disposal of all parts of existing UPS System.
Delivery Date: 09 June 2026 Total Estimated Value: $839,000.00
4. Authority Cited: Simplified Procedures for Certain Commercial Items, as implemented by FAR Subpart 13.5.
5. Reason for Authority Cited:
a. The RNEC-NCR has surveyed the marketplace and found that EATON Corporation has a unique capability their systems provide that no other vendors offer.
EATON designed and installed the present Facility Power Complex and software that runs the complex. The current UPS System is one part of the Facility Power Complex which consists of two redundant Commercial Power feeds, the UPS System, a Switchgear System, and a Generator System that is interfaced through the Human
Machine Interface (HMI) with software written and designed by EATON. Because EATON Corporation designed and installed the current UPS system that works within the Facility Power Complex, it is vital that EATON install the new UPS system. The current UPS in the Facility Power Complex works within EATON designed specifications. Using a different name brand will create a stand-alone UPS System that will not communicate or switch when functioning as part of the Facility Power Complex should a fault be detected. This becomes a life, health and safety issue.
Presently, EATON’s proprietary software controls the systems within the Facility Power Complex and interacts with the human machine interface (HMI). The software was specifically written to ensure fault detection and isolation as systems fail or come online. The UPS is a part of the system with specific code that will allow a technician to open or shut a UPS down if it fails, catches fire, etc. Without the EATON software on the UPS, the UPS would not operate with the commercial power, switchgear, UPS and generator systems. The software communicates to the systems about when and what is online to prevent power accidents or death.
The HMI provides a status display that gives a visual of all the systems that operate in the power complex. The HMI allows system components to be shutdown in an emergency. There is EATON software where there is a Power Shut Off (PTO) on the HMI. The HMI contains an UPS display and control keys to shut down the UPS in an emergency. This requirement was required to meet STIG and Risk Management Framework (RMF) compliance.
The EATON switchgear ties all the power source systems together that includes 2 commercial power circuits, 2 UPS Systems, and 2 Generator Systems. This is managed though the Human Machine Interface (HMI). Without the switchgear interface, there is nothing to tell the UPS there is something wrong and or facility power needs to be on the UPS only or UPS needs to go offline. It is vital that EATON install and integrate the new UPS systems to meet compliance. EATON Corporation only allows their certified technicians to install and work on EATON equipment. Only Eaton personnel are authorized to start-up the UPS equipment to enable full warranty.
b. Alternatives: There are no alternatives. EATON Corporation does not license their system for resellers to market and are the only source that can satisfy the RNEC’s requirements. EATON Corporation software and training are proprietary and distributed only through EATON.
c. If the justification is not approved, the RNEC-NCR will not have a fully functional and compatible UPS System that can sustain and function in the current power complex architecture that was designed by the EATON Corporation.
6. Efforts to Obtain Competition: The U.S. Army Mission and Installation Contracting Command, Fort Belvoir (MICC-FB) posted a Sources Sought notice on 9 August 2024 and received four (4) responses. It was determined that none of the companies that responded were capable of meeting the requirement. The deliverable required is a designed solution by the Eaton Mission Critical Power Solutions team via interview, engineering, site walks and vetting of several alternatives for the benefit of the site’s critical system. As the Eaton designed solution is a proprietary package, any other company would need to develop their own solution from scratch.
7. Actions to Increase Competition: Currently, there are no other sources that can provide a fully functional and compatible UPS System that can sustain and function in the current powerplant make up. The EATON Corporation system is designed to complement the existing powerplant that was originally designed by EATON Corporation. RNEC-NCR will continue to monitor and conduct market research to identify future capabilities and solutions that would meet or enhance the requirement to support the Facility Power Complex and software that runs the complex. If another potential source emerges, RNEC-NCR will assess whether competition for future requirements is feasible.
8. Market Research: Market research was performed which included reviewing the history of this requirement and prior contracts, contacting knowledgeable individuals in Government and industry regarding market capabilities to meet requirements, and internet searches including the System of Award Management, SBA Dynamic Small Business Database, Federal Supply Schedules, existing DOD contracts, and the required sources. The market research conducted found that there are no other companies that can provide a fully functional and compatible UPS System that can sustain and function in the current powerplant make up. As this is a proprietary system, only EATON can provide the proprietary designed solution. A Sources Sought Notice was posted on the Government wide Point of Entry on 9 August 2024 and It was determined that none of the companies that responded were capable of meeting the requirement.
