Statement of Work
Disposal of Hazardous, Non-Hazardous Waste and Regulated Garbage Generated at Dover AFB (DAFB)
Background: This statement of work combines the disposal of hazardous, non-hazardous waste and regulated garbage generated from international flights. The statement of work outlines the requirements individually to identify the requirements of each.
1. As a large quantity generator of hazardous waste, DAFB manages a hazardous waste central accumulation facility located in Building 1306.
Accidental spills and routine maintenance activities have the potential to produce large quantities of hazardous and/or non-hazardous waste. An off-site response organization is essential in ensuring proper clean up and disposal of bulk wastes generated on DAFB.
2. DAFB complies with the Department of Agriculture requirements, outlined in 7 CFR 330.400, through the utilization of a steam sterilizer operated by Dover AFB personnel. However, there is still a need for a back up to be available to accommodate proper disposal for garbage generated on international flights. In those occasions, DAFB proposes to store the generated garbage in applicable containers within a refrigerated system inside Facility 508. For purposes of this statement of work, the term garbage is defined by 7 CFR 330.400.
3. This statement of work is not affiliated with the DAFB refuse contract, and shall operate independently.
Objective:
1. The contractor, on an as needed basis, shall provide DAFB with pickup of hazardous waste, non-hazardous waste, and regulated garbage generated on international flights. The contractor shall provide DAFB an expedited service option for excess garbage generated between routine pickups. The contractor shall provide labor for the cleanup of spills
Description of Services provided in association with Hazardous & Non-Hazardous Waste Disposal at Dover AFB.
1. Contractor shall provide emergency response and bulk disposal services on an as needed basis. A representative of the contractor must be present for every pickup (exception is limited to the delivery of empty roll-offs). If any specific disposal methods are required; issues, will be discussed, on each individual delivery order as appropriate.
2. Contractor shall abide by all applicable federal, state and local environmental regulations pertaining to hazardous waste as well as the Department of Transportation regulations pertaining to the transportation of such items.
3. Contractor shall ensure all subcontractors utilized to perform services related to this statement of work comply with applicable federal, state and local environmental and transportation laws. These regulations include, but are not limited to the 40 &49 CFR series of regulations and the Delaware Regulations Governing Hazardous Waste.
4. Contractor shall demonstrate compliance with the requirements outlined in 40 CFR 264, Subpart H - Financial Requirements.
5. Contractor is responsible to perform all loading and unloading requirements associated with the pickup. This includes providing adequate work force and equipment (such as forklifts, drum dollies, lift gates on transportation trucks, etc). DAFB will not assist in the loading or unloading of hazardous waste during pickups.
6. Delivery orders involving equipment drop-offs prior to actual disposal pickups (e.g. roll-offs for construction debris) are unique and the following requirements shall apply.
a. Roll-offs/tanks will be requested on a delivery order separate from the waste. Roll-off/tank cost shall be based on having them at Dover AFB for 30 days.
b. Roll-offs/tanks shall be delivered within five business days of request. Roll- off/tank shall be delivered either with an empty weight ticket or a statement indicating empty weight. DAFB will only pay for disposal of actual waste weight.
c. Because the weight of waste within the roll-off is undeterminable, the contractor submitted cost per pound (or ton) will be utilized until the exact amount can be determined on day of removal. Weighing of the debris shall occur at Building 650 on DAFB.
d. Disposal of waste from tank shall occur prior to moving the tank from Dover AFB.
7. Delivery orders involving cleaning of tanks or oil/water separators are unique and the following requirements apply.
a. Cleaning services will be requested on a separate delivery order.
Cleaning services will be scheduled at a coordinated time between the contractor and DAFB.
b. Because the weight of sludge is undeterminable, the contractor submitted cost per pound (or ton) will be utilized until the exact amount can be determined on day of cleaning. The delivery order will be modified once final weights are provided.
8. The contractor shall also be responsible for any enforcement action that may be taken by the State of Delaware, or other State or Federal Government related to handling, transportation and the proper disposal of hazardous waste and hazardous materials. If notification, certifications, documentation, manifests, permits or any other written materials are required by law to be obtained, prepared and/or submitted, the contractor shall prepare same and provide a written copy to the CO, and a copy to the Environmental Flight (436 CES/CEIE) within the timeframes set forth in the law and regulations governing the action. Wing commander designated representatives from the Environmental Flight having the required training must sign the hazardous waste manifests. DAFB is not responsible for any hazardous materials brought on base by the contractor that may become hazardous waste during the course of performance. The contractor shall remove those materials from the base at their own expense and risk.
9. Contractor must provide a primary treatment facility and transporters being utilized on this contract.. The contractor, in the required work plan shall discuss alternate plans to ensure appropriate disposal in the event of unanticipated events.
Description of Services to be provided in association with Garbage Disposal at Dover AFB.
1. Contractor shall provide emergency response and bulk disposal services on an as needed basis. A representative of the contractor must be present for every pickup (exception is limited to the delivery of empty roll-offs). If any specific disposal methods are required; issues, will be discussed, on each individual delivery order as appropriate.
2. Contractor will generate all associated paperwork. The contractor shall provide Dover AFB the ability to review all paperwork prior to the pickup. Provide all paperwork at least three working days prior to the pickup.
3. Review and submittal of paperwork for expedited services shall be discussed between DAFB and contractor representatives.
4. Contractor must provide a primary treatment facility and transporters being utilized on this contract. DAFB representatives will consult with Department of Agriculture personnel to modify the existing Memorandum of Agreement on how Dover AFB disposes of regulated garbage. The Memorandum of Agreement will list the approved disposal facility along with the transporter route to reach that facility. All modifications must be approved by DAFB and Department of Agriculture officials as outline in the modified Memorandum of Agreement. The contractor, in the required work plan shall discuss alternate plans to ensure appropriate disposal in the event of unanticipated events.
5. Regulatory Compliance: The contractor is required to comply with all applicable State and Federal Laws, including, but not limited to State and Federal regulations, and Air Force Instructions in effect at the time of performance of this contract. The contractor shall be responsible for compliance with all operating permits, responsible for penalties, fines, or natural resource damage claims that may be required or assessed by the State of Delaware, Federal or Local Governments resulting from contractor performance, or failure to perform, during the course of this contract. The Government will inspect for compliance, at their discretion, and will notify the Contracting Officer (CO) of any discrepancies found. In addition, the contractor may be subject to contractual sanctions including, but not limited to withholding, offset, termination, suspension, debarment, and adverse past performance assessment. The contractor shall also be responsible for any enforcement action taken by the State of Delaware, or other State or Federal Government related to handling, transportation and the proper disposal of regulated garbage.
Description of Services to be provided in association with Immediate Spill Response
1. Because of spill potential from the storage of fuel, DAFB is required to maintain contract services in the event of an incident beyond the capacity of Dover AFB response capabilities. Specifically, DAFB is required to maintain an inventory of 1,000 linear feet of booms due to our location in and around surrounding waterways.
2. Contractor is required to provide up to 1,000 linear feet of boom at one time and install as necessary on surrounding waterways within 1 hour of notification.
Submitted cost estimates shall include the specific price per linear foot of boom.
Labor costs for delivery and implementation of boom are identical to those associated with the hazardous waste pickup section of statement of work.
Environmental technicians will be implementing the boom.
3. Contractor can perform limited immediate spill response other than installation of booms in the presence of labor to support DAFB efforts. Spill response measures are limited based on funding restrictions per delivery order (shall not exceed $25,000). Extended spill cleanup and remediation will be implemented via another contracting avenue.
4. Contractor must be certified through the United States Coast Guard as capable to perform such duties and provide annual training records.
