3.0. Description of Services

The Contractor shall provide a standard commercial warranty for three (3) years for all two hundred and fifty (250) Hand-Held Readers per section 2.7 TASK SEVEN. Standard Commercial Warranty of the Statement of Work (SOW).

See Attached SOW for additional information for services.

3.0.1 Description of Product

The TWIC reader must meet one hundred percent of the statement of works specifications and requirements of the TWIC reader. Requirements activities primary preference per the TSA self-certified and approved original equipment manufacturer (OEM) and products list is as follows:

Alternates: Alternates are acceptable for review. The alternates must already be on the most recent TSA self-certified approved original equipment manufacturer and products list. The offeror must provide evidence that the alternate items being proposed are indeed similar, the same or exceeds the specifications within the statement of work (SOW). The offeror must provide this information in detail of compatibility and comparability with the name of manufacturer, make, model or serial numbers for the products being proposed.

Alternate products on the TSA will be taken into consideration and will go through technical review by subject matter experts within the U.S. Coast Guard. Alternate products are not guaranteed to be acceptable by the U.S. Coast Guard based in accordance with the statement of work (SOW) specifications, standards and requirements.

3.0.2 Eligibility Information

Eligibility Information:

a. All qualified offerors who meet the requirements of this solicitation may submit a proposal.

b. Foreign participation: Foreign Disclosure Review will be accomplished on each full proposal selected for funding; foreign participation may not be allowed.

c. Notice to Foreign-Owned Firms: Such firms are asked to immediately notify the Contracting Officer before deciding to respond to this announcement. Foreign contractors should be aware that restrictions might apply which could preclude their participation in this acquisition.

d. Offerors cannot submit more than one (1) proposal.

e. You may be ineligible for the award if all requirements of this announcement are not met.

4.0. Delivery and Performance Information

See Attached SOW

4.0.1 Government Acceptance Period

The COR will review deliverables prior to acceptance. The Contracting Officer or the Contract Specialist will provide the contractor with an e-mail that provides documented reasons for non-acceptance. If the deliverable is acceptable, the Contracting Officer or Contract Specialist will send an e-mail to the Contractor notifying it that the deliverable has been accepted.

5.0. Labor Categories and Descriptions

All personnel providing support shall have the experience to support the services portion of the statement of work (SOW) requirements.

6.0. Invoicing Instructions

On a monthly basis, if all services are in compliance with the contract, the contractor may submit an invoice for the amount of support services provided. Invoices shall be consistent with established unit prices per CLIN and/or within the total not-to-exceed CLIN limit. If services are not in compliance with the contract, payment will be withheld on those associated CLINs until in compliance with the contract.

Electronic Submission of Payment Requests (FSMS Awards)

(a) Definitions. As used in these instructions -

(1) “Payment request” means a bill, voucher, invoice, or request for contract financing payment with associated supporting documentation. The payment request must: comply with the requirements identified in FAR 32.905(b), “Content of Invoices” and the applicable Payment clause included in this contract. In addition, discount offers and small business status if available must be stated. If travel was allowable and approved, components in accordance with FAR 31.205-46 must be provided.

(b) Except as provided in paragraph (c) of this clause, the contractor must submit payment requests electronically using the Invoice Processing Platform (IPP). Information regarding IPP, including IPP Customer Support contact information is available at www.ipp.gov or any successor site.

(c) The contractor may submit payment requests using a method other than IPP only when the contracting officer authorizes alternate procedures in writing in accordance with Coast Guard procedures.

(d) If alternate payment procedures are authorized, the contractor must include a copy of the contracting officer's written authorization with each payment request.

***Invoice Processing Platform (IPP) Enrollment Notification*** You will submit proper invoices associated with this award through the Invoice Processing Platform (IPP) at https://www.ipp.gov/. IPP is a secure web-based electronic invoicing system provided by the U.S. Department of the Treasury’s Bureau of the Fiscal Service in partnership with the Federal Reserve Bank of St. Louis (FRSTL). IPP is available at no cost to any commercial vendor or independent contractor doing business with a participating government agency.

7.0. Proposal Submission Requirements

a. EXTRANEOUS INFORMATION: Information not explicitly requested in this announcement is not desired by the government and shall not be submitted. The government will only read and evaluate each section up to the stated page limit. Pages exceeding the page limitation will not be evaluated.

b. FORMATTING:

1) Paper Size – 8.5-inch x 11 inch

2) Margins – one-inch on each side

3) Font – Times New Roman 12-point font, to include tables, diagrams, and charts. Any other information (e.g., footnotes, headers, restrictive markings) shall not be smaller than the Times New Roman 8-point font.

4) The quote shall be submitted in either Microsoft Word or Adobe PDF. Additionally, documents should be sent without password protection.

c. RESTRICTIVE MARKING: If the offeror wishes to restrict its proposals, they must be marked with the restrictive language stated in FAR 52.215-1(e).

d. Offers shall contain the following:

• Introduction section.

• Pricing section (Submit as separate proposal from technical proposal). Ensure that the pricing proposal is included on the attached pricing summary spreadsheet.

Response to Solicitation Provisions (Enclosure 3)

The contractor’s response shall be limited to a maximum of (15) fifteen pages. Page size shall be 8.5” x 11”.

The introduction section shall include information; the company name, company address, company website, Point of Contact’s email address and phone number, Unique Entity Identifier (UEI) number, company size, type of small business concern.

1) Part 1. COVER PAGE. Submit in the format of the template provided as Attachment 1. Page limit is one (1) page.

2) Part 2. TECHNICAL/MANAGEMENT. (Page limit is five (5) pages.

Technical/management shall present, briefly and concisely, the important goals, aspects and core issues of the proposal in technical context. The technical area shall include:

• The technical aspects from above are to be addressed, statement of services/products and proposed approach to meet the services and product objectives.

• Description of the effort to be accomplished. Identify specifications of the product and services to align with the statement of work (SOW).

• An assessment of risk and mitigation plan for product and services rendered.

• Description of how proposed products and services advances the current state of the product and services with new technology or methods approach.

• Management – describe how the services shall be organized or conducted and how the efforts are related to each other along with any other management approach that should be provided for evaluation of the effort.

3) Part 3. CAPABILITIES. Page limit is three (3) pages. This section shall describe the overall capabilities of the offeror to include current and past work in similar proposed efforts that is applicable to the product and services. A brief description of the facilities that will be used to execute the proposed effort.

4) Part 4. SCHEDULE. The page limit is two (2) pages. (The schedule shall identify and describe major milestones for the entire effort not to exceed one (1) year from date of award. Duration for specific tasks identified in the technical/management section should be shown. The schedule should include an additional three (3) months after the end of technical performance to provide for preparation, submission, review by The U.S. Coast Guard, and acceptance of the final report.

4) Part 5. STAFFING/KEY PERSONNEL. (Page limit is five (5) pages.

Technical/management shall present, briefly and concisely, the important goals, aspects of the proposal in staffing context for rendering the product and continued services provided throughout the duration of the contract and if there is any technical troubleshooting customer service support The technical area shall include:

i.) The staffing aspect from above to be addressed, statement of objectives and proposed approach to meet the objectives.

ii.) Description of the effort to be accomplished and identify specific tasks.

iii.) An assessment of risk and mitigation plan.

iv.) Management – describe how the efforts are related to each other along with any other management or administrative information that should be provided for evaluation of the effort.

Before replacing any individual designated as Key by the Government, the Contractor shall notify the Contracting Officer no less than 15 business days in advance, submit written justification for replacement, and provide the name and qualifications of any proposed substitute(s). All proposed substitutes shall possess qualifications equal to or superior to those of the Key person being replaced, unless otherwise approved by the Contracting Officer. The Contractor shall not replace Key Contractor personnel without approval from the Contracting Officer. The following Contractor personnel are designated as Key for this requirement. Note:

The Government may designate additional Contractor personnel as Key at the time of award.

• Project Manager (Senior Level)

Funding: USCG may encounter funding delays. Per FAR 52.232-18 “Availability of Funds”, if funding is delayed, USCG will notify the awardee prior to the award. All option periods that are reviewed to exercise the option are funded annually and maybe “subject to availability of funds.”

The contract specialist or contracting officer will notify the awardee of availability or non-availability of appropriated funds.

NOTE: USCG will not be funding through grants.

Definition: A "subject to availability of funds" statement clarifies that a party's obligations, often financial, are dependent on the actual receipt and allocation of funds. This means if the expected funding is reduced or doesn't materialize, the obligated party isn't held liable for fulfilling the commitment

a. Basis for Award and Order of Importance:

The USCG intends to award a single firm-fixed price contract for services, as specified in the applicable Statement of Work (SOW). The Offeror whose quote conforms to the Request for Proposal (RFP). A contract will be awarded based on the best value to the Government and meets all acceptability standards and specifications. Technical tradeoffs will be made and no additional credit will be given for exceeding acceptability.

The Government intends to provide a fair opportunity when evaluating the proposal and awarding a single contract based on a technically acceptable proposal with the best value. The Contracting Officer intends to award without communications. In the event the Contracting Officer determines it is in the best interest of the Government to hold communications, the Government will utilize the flexible authority of FAR 16.505 in conducting those communications and shall not be held to procedures conducted within the authority of FAR Part 15. Therefore, the proposal shall contain the best terms from both a technical and price standpoint. The Government reserves the right to conduct communications if determined necessary by the Contracting Officer. You are cautioned that taking exception to the terms and conditions of the RFP may cause an otherwise acceptable proposal to become unacceptable.

As a result of this RFP, the USCG intends to award a single, Firm Fixed-Price contract to the Offeror which submitted the proposal determined to represent the best value to the government using a tradeoff method.

The Government will select the proposal award using a Best Value Analysis. This analysis will be based on the following evaluation factors, however; technical and past performance is of greater importance than price. Price is still considered part of the evaluation.

Factor 1 – Technical Capability/Experience Technical Capability will be evaluated adjectivally based on its methods in providing the required staffing and execution of elements and objectives of the Statement of Work (SOW).

The government reserves the right to award the best value considering these three factors Factor 3 – Price Price will be fair and reasonable for all prices and options under the contract.

The Contracting Officer anticipates the award without communication to the Offeror. Therefore, each proposal shall contain the Offeror’s best terms from both a technical and price standpoint.

The Government reserves the right to conduct communications if determined necessary by the Contracting Officer. Offerors are cautioned that taking exception to the terms and conditions of the RFP may cause an otherwise acceptable proposal to become unacceptable.

END OF INSTRUCTIONS

Technical Approach and Past Performance are of equal importance. Technical Approach and Past Performance when combined are significantly more important than Price. Where competing proposals are determined to be substantially equivalent for non-price factors, price becomes the controlling factor. The Government may award any resulting Task Order to other than the lowest price offer, or other than the Offeror with the highest technical rating. The Government will not make an award at a significantly higher price to achieve small technical advantages.

(d)Comptroller General Examination of Record. FAR 52.212-3 OFFEROR REPRESENTATIONS AND CERTIFICATIONS–

COMMERCIAL ITEMS ALTERNATE (Feb 2024)

The offeror shall complete only paragraphs (b) of this provision if the Offeror has completed the annual representations and certification electronically via the System for Award Management (SAM) Web site located at http://www.sam.gov/portal. If the Offeror has not completed the annual representations and certifications electronically, the Offeror shall complete only paragraphs (c) through (u) of this provision.

Definitions. As used in this provision--

“Economically disadvantaged women-owned small business (EDWOSB) concern” means a small business concern that is at least 51 percent directly and unconditionally owned by, and the management and daily business operations of which are controlled by, one or more women who are citizens of the United States and who are economically disadvantaged in accordance with 13 CFR part 127. It automatically qualifies as a women-owned small business eligible under the WOSB Program.

“Forced or indentured child labor” means all work or service—

Exacted from any person under the age of 18 under the menace of any penalty for its nonperformance and for which the worker does not offer himself voluntarily; or

Performed by any person under the age of 18 pursuant to a contract the enforcement of which can be accomplished by process or penalties.

“Highest-level owner” means the entity that owns or controls an immediate owner of the offeror, or that owns or controls one or more entities that control an immediate owner of the offeror. No entity owns or exercises control of the highest-level owner.

“Immediate owner” means an entity, other than the offeror, that has direct control of the offeror. Indicators of control include, but are not limited to, one or more of the following:
