About this file
This document is a set of questions and answers related to a Request for Response (RFR) issued by the Massachusetts Trial Court for Office Supplies, Toner, and Custom Printing. The RFR seeks discounted pricing off manufacturer's list price for office supplies and toner cartridges, as well as custom printing of checks and envelopes in various quantities. Vendors are requested to provide pricing in the specified formats, including options for custom printing with black or reflex blue ink. The RFR contains details on the custom check and envelope specifications, as well as clarification on the quantity requirements for the envelope orders. A sample voided check can be provided to vendors upon request.
The RFR indicates that vendors must comply with "mark up" or "cost plus" requirements, where they may be required to submit invoices to prove the accuracy of their pricing. Failure to provide this documentation could result in contract termination. The RFR also states that any proposed pricing with a "cost plus" component or "gross profit floor" will be considered non-responsive.

| 1 | 4/5/18 | Andrew Adinolfi WB Mason | Discounting inclusive of "Cost Plus" or "Gross Profit Floor" conditions | 1. Regarding the discounting sought by the Trial Courts (Attachment A2) Category 1B- Whole Catalog Non-Market Basket_1 and (Attachment A3) Category OEM and Non Remanufactured Toner Cost Sheet), we just want to confirm that the discount being sought and desired by the Trial Courts is discounting off of manufacturer?s list price by product category and that any proposal for off contract items containing a ?Cost Plus? component or inclusive of a Gross Profit Floor will be considered to be non-responsive. We are asking this question specifically because of the language we find in RFR Section 4.4 on Page 19 which states that: Mark up % or Cost plus %: If this contract requires bidders/contractors to quote for materials, supplies and any other items on a ?Mark up %? or ?Cost Plus %?, the contractor (when requested by the department) is required to submit, to the requesting department, a copy of their original manufacturer?s invoice (or other documentation) to prove accuracy of their mark up or cost plus total. When requested by the department, the contractor shall submit this documentation within 5 working days upon the department?s request. The referencing invoice will not be processed for payment until satisfactory documentation is received; and will not be considered late payment. Any written credits shall be immediately issued to the department along with justification or error. This requirement may also be part of the contract performance evaluation. Failure to provide this documentation may result in immediate termination of contract. In addition, if the contractor is found non-compliance (not charging the department the contract rate), it may also result in immediate termination of contract. In the event that there was a possibility that this language was intended to allow bidders to bid non contract items on a ?Cost Plus? basis or with a GP Floor attached to their proposed discounting, we just wanted clarification on this point. | Yes, vendors should provide the discount off the Manufacturer's List Price for OEM & Non Remanufactured Toner. |
| 2 | 4/5/18 | Andrew Adinolfi WB Mason | Custom Checks/Envelopes- Excel File Cross Reference w/ pdf images | 2) We are having a bid of difficulty matching the specs for the checks and envelopes on the Excel file with the pdf images you supplied for us. For instance, we only have the one image of the check to work with but the Excel file contains seven different specs. Likewise, we are a bit uncertain of which specs on the Excel match up with which pdf image. If it isn?t too much trouble, would you be able to label each envelope pdf image with a number that would correspond to the Excel spec? For example, we?re not sure which Excel item the first pdf image matches up to, whether its?s the straight #10 or the 24# white wove or the ?prints either black or reflex blue?, etc. Labeling both the Excel specs with the corresponding pdf image with the same number would really help us quote your accurately on these items. Would that be possible? | The specs refer to only one type of check that the Trial Court uses exclusively throughout the Commonwealth. Please see answer to question # 4 if you need additional information to quote appropriately. We are requesting that vendors bid on custom printed #10, 24 pound white wove regular envelopes and custom printed #10, 24 pound white wove window envelopes in each quantity as specified on the spreadsheet. We are requesting pricing be the same for black and reflux blue. The current lables for attachments should be sufficient. |
| 3 | 4/5/18 | Andrew Adinolfi WB Mason | Custom Envelopes- Excel File Varying Quantities | 3) Regarding the quantities of ?10,000?, ?12,500?, ?15,000?, ?20,000?, ?25,000?, ?30,000?, and ?50,000? listed on the ?Custom Envelope? tab, are you asking bidders to quote each item in those quantities in addition to the quantity listed next to the item proper? For example, on the ?Flat & final size 4.125 x 9.5? envelopes, are you looking for pricing for quantities of 1,500, then the varying quantities of 10,000 through 50,000? Or, are the quantities of 10,000 through 50,000 applicable only to the ?1 side no bleed? spec? Could you please clarify? | Yes, we are requesting that vendors bid on custom printed #10 regular envelopes and custom printed #10 window envelopes in each quantity as specified on the spreadsheet. |
| 4 | 4/9/18 | Andrew Adinolfi WB Mason | Attachment A4 Custom Check | The image provided for bidders on which to based their bid for custom checks is a bit obscure; could we possibly get a sample voided check that either you could send to our attention at: W.B. Mason Co., Inc. 59 Centre St. Brockton, MA 02303 Attn: Andy Adinolfi Or, conversely, we would pick up a sample if that were more convenient for you. Thank you. | Yes, a sample can be provided upon vendor request. |
