Procurement Request Number: ____________________________________

Justification for OTFAOC Number:__JA10-094_______________________________

LIMITED SOURCE JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION

Upon the basis of the following justification, I, as Head of Contracting Activity, hereby approve the use of other than full and open competition of the proposed contractual action pursuant to the authority of 10 U.S.C. 2304c(b)(2), Task and Delivery Order Contracts Multiple Award Contracts, and FAR 16.505(b)(2) ii, Exception to the Fair Opportunity Process.

JUSTIFICATION

1. Agency and Contracting Activity.

a. Agency

USCENTCOM /CCJ6CN

7115 South Boundary Blvd.

MacDill AFB FL 33621-5101

b. Contracting Activity

Defense Information Technology Contracting Office (DITCO)/PL8222 2300 East Drive

Scott AFB, IL 62225

2. Nature/Description of Action(s).

The action being processed is a directed technical solution to be competed among the three DISN Satellite Transmission Services – Global (DSTS-G) prime contractors (ARTEL, DRS-TSI and CapRock Government Solutions). The contracting action will be DSTS-G Task Order (TO) 633 to provide inter/intra theater satellite bandwidth on Eutelsat W6. The TO will be firm fixed priced, funded via DISA-managed DCWF PDC Y6E0GM. Services are considered severable. Consideration of any other technical solution is not in the Government’s best interest.

3. Description of Supplies/Services.

USCENTCOM requires 72 MHz of contiguous, non-preemptible, full duplex, bi-directional KU-band satellite capacity/service on Eutelsat W6. The satellite is located at 21.5 degrees east longitude and provides coverage over the Southwest Asia (SWA) region and Europe. The frequency range is within 14.0 to 14.5 GHz for the uplink, and 10.95 to 12.75 GHz for the downlink. The uplinks and downlinks must be on opposite linear orthogonal polarities to ensure good cross polarization isolation. The minimum required effective isotropic radiated power (EIRP) at all locations within the satellite footprint must be 40 dBW, and the elevation angle from all earth terminals within the 40dBW footprint must be at least 10 degrees.

The new requirement is for 33 months, including a base period of 12 months and three option periods (one for 9 months, and two for 6 six months each).

CENTCOM’s requirement for 72 MHz is needed in two increments--the first increment of 30 MHz on 15 May 10 and the second increment of 42 MHz on 1 Aug 10. Listed below are the periods of performance with the estimated dollar amounts.

4. Identification of Statutory Authority.

10 U.S.C. 2304c(b)(2), Task and Delivery Order Contracts, Multiple Award Contracts implemented by FAR 16.505(b)(2)(ii)

5. Demonstration of Contractor’s Unique Qualifications.

This satellite bandwidth requirement is for a specific technical solution to be procured via the DSTS-G contract, Task Order 633.

The Eutelsat W6 satellite is a key element in CENTCOM’s satellite capacity supporting Operation Enduring Freedom (OEF) in Afghanistan. Eutelsat W6 supports CENTCOM’s ability to provide inter-theater and intra-theater links within Afghanistan and between Europe and SWA. Eutelsat W6 is specifically being used to support the troop increase and infrastructure expansion within Afghanistan. (Deleted Text) The lease of 72 MHz of satellite bandwidth on Eutelsat W6 will ensure the requirements can be satisfied in the best manner possible.

Eutelsat W6 must be used to satisfy this requirement for bandwidth because of the designed nature of the satellite network. (Deleted Text) Research indicates that there are many applications and services available but that they either function poorly (inclined unstable orbits) or not at all when used over multiple satellite hops. (Digital communications is time dependent and is adversely affected on links that use multiple satellite hops because they introduce additional time delays that cause packet loss and link degradation to the point of not being useable).

Procurement of additional bandwidth on Eutelsat W6 enables USCENTCOM to support the additional links and services required for the growth of the satellite network supporting the troop increase in Afghanistan. (Deleted Text) The ability to carry out long-haul satellite communication is vital to successfully meeting the operational requirements of the warfighter. (Deleted Text)

6. FedBizOpps Announcement/Potential Sources.

In accordance with FAR 16.505(a)(1), the Contracting Officer does not synopsize orders under indefinite delivery contracts.

7. Best Value Determination.

Award will not be made until the price can be determined to be fair and reasonable. The Contracting Officer will perform price analysis on contractor proposals received. Proposed prices will be compared with rates reflected in Section B of the DSTS-G contracts. If necessary, the offerors may be requested to provide additional documentation supporting the proposed prices.

8. Description of Market Research.

Market research conducted by USCENTCOM program engineering staff, using industry contacts, internet vendor research, and past program experience indicates that the additional costs associated with acquiring additional earth terminals and acquiring satellite bandwidth on any other satellite other than W6 would be unacceptable in both terms of dollars and time. It would take months to plan, coordinate and execute the reconfiguration of the existing network infrastructure. (Deleted Text)

9. Any Other Supporting Facts. N/A

10. Listing of Interested Sources.

The list of DSTS-G contractors is provided as follows:

DCA200-01-D-5002 with ARTEL, Inc., 1893 Preston White Drive, Reston, VA 20191

DCA200-01-D-5004 with CapRock Government Solutions, Inc., 2751 Prosperity Avenue, Suite 300, Fairfax, VA 22031.

DCA200-01-D-5003 with DRS Technical Services, Inc, 12930 Worldgate Drive, Suite 700, Herndon VA, 20170

11. Actions Taken to Remove Barriers to Competition.

Maintaining the current satellite bandwidth, network and terminal configurations is of utmost importance while the war-fighting continues. If the need for these services is projected beyond contract end, USCENTCOM will submit a competitive requirement package to DITCO in sufficient time to compete or offer fair opportunity to other contractors.

12. Reference to the Approved Acquisition Plan (AP).

In accordance with DISA Acquisition Regulation Supplement (DARS) Part 7, Paragraph 7.9002, a written Acquisition Plan is not required.
