About this file
This is a Justification for Other Than Full and Open Competition (JOTFOC) document from GSA Federal Acquisition Service for the procurement of Thermal Material Roll from ThermBright Ltd. (P/N MJS7712) with an estimated cost of $76,000.
The document justifies a limited source procurement for specialized thermal material rolls used for target silhouettes at military training facilities. The required product must be 328 feet by 24 inches, made of PVC 200 backer material, have 15 mil thickness, be OG Green in color, and present a cold image to thermal sight. The material must withstand extreme desert conditions including temperatures from 0° to 120°+, 60+ mph winds, and multiple years of outdoor exposure. The Operations Group Phoenix Team requires this specific product for over 1,500 target lifters throughout their training area. While the procurement will be synopsized on SAM.gov for 7 days, ThermBright's MJS7712 (formerly MJS9000) is identified as the only known product meeting these specialized requirements. Vendors quoting this specific brand name item will be allowed to submit quotes.

328 feet by 24 inches (100 meters x .6 meters) Backer material PVC 200, not adhesive Mil thickness +/- 15 mill Extremely sun, wind, and tear resistant OG Green Emissivity less than .15, very bright thermal return for weapons systems Has 1 inch +/- border for stapling Roll weight: 80 +/- pounds for “one person” lift Shipped per roll, individually boxed on spindles for ease of handling, measuring, and cutting.
Material will present a COLD image to thermal sight – white in black hot mode, black in white hot mode. This is thick material specifically designed to with stand high winds, extreme heat and cold.
provides an excellent substrate for stapling to backers.
Acquisition of THERMAL MATERIAL ROLL will be sourced through the vendor quoting the lowest price technically acceptable. The estimated cost of this procurement is:
$76,000.00.
IDENTIFICATION OF STATUTORY AUTHORITY
This acquisition is conducted under the authority of Section 201 of the Federal Property and Administration Act of 1949 (40 U.S.C. 501). All acquisitions for THERMAL MATERIAL ROLL will be conducted under the authority of the Open Market Program. The primary statutory authorities for the MAS Program are Title II of the Federal Property and Administrative Services Act of 1949, and Title 40 U.S.C. 501, Services for Executive Agencies. In accordance with FAR Part 13, approval is sought for a sole source procurement based on the circumstances and rationale for restricting consideration of schedule contractors is FAR 13.106-1(2)(b)(1)“For purchases not exceeding the simplified acquisition threshold, contracting officers may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, or industrial mobilization)”.
THERMAL MATERIAL ROLL is a commercial product as defined in FAR 12.101.
DEMONSTRATION THAT THE ACQUISITION REQUIRES THE USE OF THE
AUTHORITY CITED
FAR 13.106-1 allows restricting consideration of schedule contractors to fewer than required in FAR
13.104 whenever only one source is capable of responding due to the unique or specialized nature of the item required by the agency is exclusive to one manufacturer or when there is an urgent requirement. The Operations Group Phoenix Team is responsible for over 1,500 target lifters with various silhouettes throughout the training area. To ensure Rotational Training Units (RTUs) can train their optics and effectively acquire targets, non-powered thermal paper is required to be mounted on both vehicle and infantry silhouettes. Due to the extreme heat, cold, and wind experienced in the Mojave Desert, thermal paper needs to be thick/robust enough to withstand major temperature changes (0*<>120*+), able to be mounted to silhouettes without being pulled off fasteners by excessive wind (60mph+), and last multiple years of excess outdoor exposure. ThermBright provides a MJS7712 (formerly MJS9000) paper that is the only known product to be effectively mounted to target silhouettes at NTC. As such, no other items are being considered.
EFFORTS TO SOLICIT TO AS MANY SOURCES AS PRACTICABLE
The Contracting Officer will synopsize the RFQ through SAM.gov for a total of 7 days. Vendors quoting the required name brand items will be allowed to submit quotes.
DETERMINATION THAT THE ANTICIPATED COST WILL BE FAIR AND REASONABLE
Current quoted pricing is fair and reasonable based on competition among vendors quoting the required THERMAL MATERIAL ROLL.
DESCRIPTION OF THE MARKET RESEARCH CONDUCTED
Due to the limited source nature of this requirement no other manufacturers’ products were sought.
However, the Contracting Officer will synopsize the RFQ for 7 days through SAM.gov.
OTHER FACTS SUPPORTING THE USE OF THE OTHER THAN FULL AND OPEN
COMPETITION
While GSA is committed to expanding competition, we must accomplish that goal with the least risk to the successful support of the GSA Mission and the ongoing efforts in the war on terror and homeland security. GSA jeopardizes being able to meet our customers’ need by not completing this limited-source, brand name specific procurement.
LIST OF SOURCES THAT EXPRESSED AN INTEREST IN THE ACQUISITION
Due to the limited source nature of this requirement no other manufacturers’ products were sought.
However, the Contracting Officer will synopsize the RFQ for 7 days through SAM.gov.
STATEMENTS OF ACTION TO OVERCOME BARRIERS TO COMPETITION
See section “EFFORTS TO SOLICIT TO AS MANY SOURCES AS PRACTICABLE” above.
