Responses to Additional Trade and Quote Questions

Question 1: Does the Office of Financial Research (OFR) require the “Offeror” to store and maintain all TAQ data on the “Offerors” site and make the data available to the OFR via FTP within 24 hours, or is the request to only deliver the data to the OFR data center via FTP within 24 hours? The total quantity of historical data in uncompressed form from 1993 through present is close to 120TB, and there is an additional 20TB of uncompressed data each year. So the data storage requirements could become quite large.

Answer 1: Pricing for both is requested, and should be separated by base year and each option year.

Question 2: Our understanding is you no longer require real-time data which shall be updated with no more than industry standard latency. "Latency" refers to the time it takes for a stock quote to get from an exchange's server to a trader's screen.

Answer 2: Correct – this requirement was removed.

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors, in descending order of importance, shall be used to evaluate offers:

Technical – Go/No Go Factor

Risk Factors

Trade and Quote Data – optional items and where the offeror exceeds the minimums

Past Performance

Price

Risk Factors are more important than optional items, exceeding the minimums and past performance and are significantly more important than price.

(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

ADDENDUM TO 52.212-2, EVALUATION -- COMMERCIAL ITEMS (JAN 1999)

Technical - Go/No Go Factor

Proposals will be first evaluated for technical acceptability on a go-no go basis. IF ANY MANDATORY REQUIREMENT IS NOT MET, THE OFFER WILL BE CONSIDERED TECHNICALLY UNACCEPTABLE AND

THE OFFEROR'S PROPOSAL WILL NOT BE EVALUATED FURTHER.

It is solely within the discretion of the Government to determine if the data offered that exceeds the minimums are of any benefit to the Government.

(a) The Government will award a fixed priced contract resulting from this solicitation to the responsible contractor who represents the best value to the Government. The Government will evaluate proposals based on risk, price, and non-price factors to determine the best value to the government. In performing its best value analysis, the Government will compare any relevant differences among the evaluated proposals to determine which proposal offers the overall best value.

(b) The Government may choose to make an award to one or more Offerors.

(c) The Government reserves the right to make award based upon initial offers received, without discussions or negotiations of such offers. Therefore, the initial proposal shall contain the Contractor’s best terms from a technical, past performance, and price standpoint. In addition, it is important that each offer fully address the requirements stated in this solicitation, including any exceptions thereto or deviations there from.

(d) The Government also reserves the right to make a competitive range determination and conduct discussions only with the Offerors included in the competitive range.

Risk Factors The Government will evaluate the risk to the Government for the items to be discussed in line 65, 66 and 67 of Attachment A1.

Past Performance

The Government will evaluate the information obtained from the Past Performance Questionnaire (PPQ) with regards to Quality, Timeliness, Billing, Problem Resolution, and Customer Service.

The Government may use information provided by the Offeror in their proposal submission, information in both Government and commercial databases, and other information available as the Contracting Officer determines is reasonable.

For recent and relevant PPQs, the Government will evaluate the Offeror’s Past Performance. If the Offeror has no recent and relevant past performance readily available (FAR 15.306 (a) (2) (IV)), it will be evaluated as Neutral.

Price Factor

A price analysis will be conducted to determine the quoted price is fair and reasonable.
