DRAFT PERFORMANCE WORK STATEMENT

AGENT REGISTRATION LIST DATA ENTRY AND ANALYSIS

INTRODUCTION

The Department of the Treasury designated the Financial Crimes Enforcement Network (FinCEN) as the agency to establish, oversee, and implement policies to prevent and detect money laundering. FinCEN’s mission is to safeguard the financial system from the abuse of financial crime, including terrorist financing, money laundering, and other illicit activity by serving the interests of financial, law enforcement, and regulatory communities.

FinCEN is responsible for developing and managing systems that support the identification, tracking, and investigation of financial crimes and money laundering activities. FinCEN collects Bank Secrecy Act (BSA) data from various sources, including Money Services Businesses (MSB). Upon request, MSBs are required to furnish FinCEN with a list of their agents. An “agent” is a separate business entity from the issuer that is authorized through a written agreement or otherwise, to sell its instruments or, in the case of funds transmission, to sell its send and receive transfer services. A person who is solely an employee of the MSB is not an agent of that MSB.

In order to compile a current listing of all MSB agents, FinCEN is gathering data from the MSB community. Once complete, the database will be used to further FinCEN’s mission needs, in aiding individual law enforcement case investigations, and in conducting strategic analysis of financial transactions and service providers. Further, the data will help inform decisions to be made in the future about the feasibility and desirability of a regulatory change to turn the agent list recordkeeping obligation into a reporting obligation.

STATEMENT OF NEED

FinCEN is soliciting 25,000 MSBs for identifying information on their agent population. Contractor support is required to enter MSB responses into a database, tabulate the data, and generate graphical presentations of the data for inclusion in FinCEN reports. Data and contents of the database are Sensitive But Unclassified (SBU) and all work efforts will be conducted at FinCEN utilizing government provided data, databases, and SAS® software tools. Specific task details follow:

Data Entry Task

MSB responses are due to FinCEN on or about June 15, 2011. Of the 25,000 requests, FinCEN anticipates a response rate of one‐half or approximately 12,500. Format of the responses is expected to be comprised of 70% electronic‐based (Excel compatible) or paper‐based (non‐Excel compatible) to be downloaded or physically keyed into the database as appropriate.

The responses are expected to contain identifying information including the following data fields:
