About this file

This document is a tribal ordinance from the Turtle Mountain Band of Chippewa Indians detailing TERO (Tribal Employment Rights Office) regulations for contractors and businesses operating on their reservation. The ordinance requires a 3% fee assessment for all contractors, subcontractors, and businesses with negotiated contracts of $10,000 or more, including construction, manufacturing, professional services, architectural/engineering firms, consultants, and legal services. The fee must be paid in full upon receiving the first progress payment or within 45 days of contract award.

Additionally, the ordinance mandates that any person, employer, or vendor conducting business on the reservation must obtain and maintain an annual tribal business license from the TERO Office before commencing work. Licenses are issued annually and must be renewed before the end of each calendar year. Fees are assessed to provide tribal revenue and support the operation of the TERO Commission, as authorized by Article 9, Sections 3 and 4 of the tribe's constitution, with exceptions for educational materials like computers, books, classroom desks, and supplies.
