JUSTIFICATION AND APPROVAL
FOR USE OF OTHER THAN FULL AND OPEN COMPETITION
1. Contracting Activity.
Naval Air Warfare Center Aircraft Division (NAWC-AD) Patuxent River, MD
2. Description of the Action Being Approved.
This request is a Firm Fixed Price (FFP) contract to provide government furnished radar installation and tower services to augment existing capabilities at the Atlantic Test Range (ATR)
3. Description of Supplies/Services.
When complete, all legacy cabling will be removed and new cable and radar installed atop towers located at four (4) outlying sites: Bishops Head, West Basin, Webster Field, and Point No Point. The radars will be provided by the government (GFE) on existing towers.

4. Statutory Authority Permitting Other Than Full and Open Competition.
10 U.S.C. 2304(c)(1), Only one responsible source and no other supplies or services will satisfy agency requirements.
5. Rationale Justifying Use of Cited Statutory Authority.
Teltronic Towers has accrued valuable data and information on our towers at Bishops Head, West Basin, Webster Field, and Point No Point through years of support. They have intricate knowledge of our radar towers that includes proprietary tower survey data and records. Having the survey data and records gives competitive advantage because other vendors would require tower survey/structural analysis which costs approximately $9.5k per tower site for a total of approximately $38k for the four tower sites. If another vendor was chosen the additional time required for tower survey/structural analysis would cause
FY20 - RDT&E $25k unacceptable delays in fulfilling the agency requirement and the additional cost would exceed Surface
Surveillance Project funding limit. Additionally, this effort is commensurate with the services being provided at the Point Lookout tower under the Surface Surveillance Project and is a follow-on contract for continued development and staggered replacement of the ATR Furuno Radar systems.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.
Installing equipment on towers requires special training, certifications, insurance, tools, and equipment that limits the availability of competitors. Given additional travel restrictions during the COVID-19 pandemic, distance to vendor headquarters was a selection consideration. Teltronic Towers is within 75 miles of Patuxent River NAS and Webster Field, which are two of the included installation locations where additional restrictions become a factor. The remaining installation locations are remote sites requiring fewer travel considerations.
We are unable to consider outside vendors because there would be substantial cost and resulting schedule delays that are not expected to be recovered through competition due to the high unlikelihood that outside vendors will assume the risk of performing installation on towers without conducting their own independent tower study prior to installation. Teltronic Towers is unique in that they have performed the previous installations at each of the installation sites and have proprietary tower survey data necessary to perform all required tasks without the need to perform additional studies.
7. Determination of Fair and Reasonable Cost.
The rate quoted is consistent for similar work performed in previous installations and there is adequate price history and information to determine fair and reasonable cost.
8. Actions to Remove Barriers to Future Competition.
The ATR will continue to monitor the market for vendors that can provide the expertise and capability to provide a complete system needed to satisfy and support requirements. If another potential source emerges, ATR will assess whether competition for future requirements is feasible.
Per Navair Instruction 4200.31F dated 22 July 2014, Contracts awarded under FAR Part 13, simplified acquisition procedures, do not require a J&A thus do not need concurrence from our legal counsel.
