Water Quality Programs

The Contractor must ensure that no pesticides, pesticide residues, or pesticide wastes of any kind are allowed to enter the sanitary sewer system or storm sewer system, or be disposed of to the land. Vehicles or equipment contaminated with pesticide residues may not be washed or rinsed on Fort Benning. All disposal of pesticide wastes must be in accordance with Fort Benning policies, i.e., off the installation.

Ted Roever (706-545-2643), 8/28/2020

Pesticide

Application of herbicide or any other pesticide By the Contractor is to be conducted in accordance with the DoD Pest Management Program (DoDI 4150.07), the Fort Benning Integrated Pest Management (IPM) Plan, and State of Georgia/ Alabama regulations. DoDI 4150.07 requires that the technical language in DoD pesticide contracts be reviewed and approved by an Army Environmental Command (AEC) pest management consultant; a pre-approved Pesticide Requirements document is attached which is to be used as a technical SOW for the contract. Each time herbicide application is conducted under this contract, a pest management report is to be filled out IAW the attached Pesticide Requirements document; a separate entry is to be prepared for each date and/or location. IAW DoDI 4150.07 requirements, a copy of each report is to be provided to the Integrated Pest Management Coordinator (IPMC) as they are generated. The IPMC has reviewed the contractors GA Dept of AG Pesticide Contractor License and Commercial Applicator license in applicable category of certification. The contractor may select from the current list of approved pesticides (Pesticide Use List) or submit another product for approval. If pesticide operations are to be conducted on the AL portion of Fort Benning, the contractor must provide AL reciprocal company license and applicator certifications. Special Note: Pesticide/herbicide mixing and application must only be performed by a certified Commercial Applicator; technicians with no certification category may assist the Commercial Applicator but may NOT mix or apply pesticides on Fort Benning, regardless of supervisory oversight.

NPDES: Area-wide pesticide application on Fort Benning is covered under the Installations Alabama or Georgia Pesticide General Permit (PGP), on file with the IPMC, Rm 310, Bldg 6. The PGP does not require the applicator to determine whether or not U.S. Waters are affected by the project; rather, it establishes a threshold (GA – 8960 ac; AL – 6400 ac) below which the applicator may operate largely by following industry-accepted work practices. Historically, area-wide pesticide application on Fort Benning has not exceeded PGP thresholds; however, the IPMC must be able to track the Installations total treatment area acreage for PGP compliance purposes. Accordingly, upon completion of each episode of herbicide application under this REC, the contractor must immediately record treatment area acreage in the pest management report and forward the report to the IPMC. Any delay in recording treatment acreage may compromise PGP requirements to submit an NOI within 30 days of exceeding a threshold. Pesticide applicators must abide by the following site-specific control measures in order to minimize the discharge of pollutants to waters of the State resulting from pesticide application under this PGP: 1) use the lowest effective amount of pesticide product per application and optimum frequency of pesticide application to control the target pest, consistent with reducing the potential for development of pest resistance; 2) perform regular maintenance activities to reduce leaks, spills, or other unintended discharges of pesticides; 3) maintain pesticide application equipment in proper operating condition by adherence to manufacturer’s conditions and industry practices, and by calibrating, cleaning, and repairing such equipment on a regular basis to ensure effective pesticide application and pest control; and 4) Report adverse incidents/corrective actions to the IPMC by phone within 24 hrs. Non-venomous snakes are protected by State of Georgia regulations; project personnel shall avoid killing all snakes in order to prevent inadvertently killing non-venomous snakes.

Ted Williams (706-545-1489), 8/25/2020

HAZARDOUS WASTE

Any wastes generated must be evaluated for their hazardous characteristics, containerized and disposed of in accordance with all Federal (40 CFR 260-280), State (EPD 391-3-11) and Fort Benning Hazardous Waste Regulations

Sara Forrest (706 545 3604), 9/1/2020

GENERAL REQUIREMENTS FOR PESTICIDE APPLICATION

CONTRACTORS ON FORT BENNING

Pest management and pest control operations are to be conducted in accordance with the DoD Pest Management Program [Department of Defense Instruction (DoDI)] 4150.07 and the Fort Benning Integrated Pest Management Plan (IPMP). Either document is available upon request from the Integrated Pest Management Coordinator (IPMC), but the general requirements of both are summarized below.

Contractor Qualifications. In accordance with DoDI 4150.07 requirements, the grounds maintenance contractor, or their pest control sub-contractor, must possess a Pesticide Contractor License in the categories of pest control service to be performed, issued by the Georgia Department of Agriculture, Pesticide Section, in order to apply pesticides on Fort Benning. If the contractor’s duties require pesticide application on the Alabama portion of the Installation, the contractor must possess an Alabama Custom Pesticide Applicator’s License issued by the Alabama Department of Agriculture and Industries. The contractor must maintain current liability insurance for the operation of a pest control business, effective in the State where the pest control service is to be performed.

Personnel Qualifications. In accordance with DoDI 4150.07 requirements, pesticide (including herbicide) application may only be performed by a licensed Commercial Applicator who is certified by the Georgia Department of Agriculture, Pesticide Section, in the category of pest control being performed. If the contractor’s duties require pesticide application on the Alabama portion of the Installation, the contractor’s application personnel must be certified by the Alabama Department of Agriculture and Industries in the category of pest control being performed. If the contractor’s duties require pesticide application in or near aquatic habitats on the Installation, the contractor’s application personnel must be certified in the appropriate categories (Georgia - 26;

Alabama - AQ). Pest control personnel must maintain a copy of their certification in their possession at all times while conducting operations on Fort Benning property. Uncertified pest control technicians of the pest control contractor or those certified as ‘Private Applicators’ are not authorized to mix or apply pesticides on property administered by Fort Benning, regardless of supervisory oversight.

Communication. The contractor’s pesticide applicators must be able to speak, read, and write the English language in order to ensure that pesticide applications are performed in accordance with the pesticide product label directions.

Vehicles. The contractor must comply with all applicable requirements of the Fort Benning Motor Vehicle Regulation, MCoE Reg.190-5 (2011).

o Pest Control Vehicles. Vehicles used to transport pesticides must be identified in accordance with State law and equipped with a fire extinguisher and spill/decontamination kit. Spill/ decontamination kit will be equipped with materials sufficient to respond to any spill of pesticides being used or transported by the contractor.

Pest Management Report. In accordance with DoDI 4150.07, Installations are required to produce, maintain, and permanently archive daily records of all contracted pest management activities conducted anywhere on the Installation. Accordingly, the contractor must submit a pest management report to the IPMC in Environmental Programs Management Branch, Bldg 6, Rm 310, at the completion of daily activities. The report will be completed on a company ticket or DD Form 1532-1, be legible or typewritten, and contain the following information:

1. Date of treatment or service

2. Treatment site or building number

3. Target pest

4. Pesticide trade name; EPA Reg. No.; and active ingredient

5. Amount of pesticide concentrate used (qt., gal., oz., etc.)

6. Final concentration (or total volume of mixture applied)

7. Applicator’s name and certification number

8. The total area treated (square feet, acre, etc.)

9. Remarks or any conditions that may prevent control of pests

Integrated Pest Management (IPM). Army policies require the use of IPM techniques to accomplish pest control operations. IPM is a process for achieving long-term, environmentally sound pest suppression through the combined use of physical, mechanical, biological, cultural, and chemical practices, including the use of the least toxic, least persistent, target-specific pesticides, applied at the lowest concentration that will effectively control a target pest.

o Army policies prohibit the use of ‘preventive’ pesticide treatments to control pests.

Pesticide application will only be conducted in those locations where pest presence has been confirmed by surveillance.

Pesticide Approval. The contractor must only use EPA- and State-registered pesticide products that have been pre-approved for use on Fort Benning by an Army Environmental Command (AEC) Pest Management Consultant (PMC). The list of pre-approved pesticides is available from the IPMC. To obtain approval for use of a product not previously approved, the contractor must submit the EPA-approved pesticide product label, target pest, and application site to the IPMC through the contract representative. The IPMC will notify the contract representative when AEC PMC approval has been obtained for use of the product.

Disposal of Pesticide Wastes. The contractor must not dispose of any pesticide product, container, or waste on Fort Benning property.

Pesticide Safety. The contractor must use caution when applying pesticides in the vicinity of sensitive areas such as open bodies of water, people, and non-target organisms. No space treatments (fogging or ultra-low volume) or application of aerosol, dust, or liquid pesticides will be conducted in occupied areas. No exterior application of pesticides will be performed during adverse weather conditions. Prior to pesticide application, the contractor must ensure that the area to be treated is in suitable condition for the pesticide to be effective. If conditions exist that could adversely impact the effectiveness of a pesticide treatment, the contractor must delay any pesticide application until the conditions have been corrected and notify the contract representative of the situation.

Pesticide Mixing. Pesticide formulations must be mixed at the site of application; pesticide formulations in spray containers of 2 gallons or less may then be transported to other application sites on the Installation. Formulations in excess of 2 gallons must be mixed in such a manner that the entire tank can be applied at the site and the treatment remains within pesticide label specifications. No tank-mix of formulated pesticides in excess of 2 gallons is to be transported over Fort Benning roadways.

o Tank Filling. Filling of formulation tanks with potable water on Fort Benning may only be conducted from locations with DPW-approved back-flow prevention devices connected to water outlets. An air-gap must be maintained between the formulation tank and the fill hose at all times.

Pesticide Handling. During the preparation and application of pesticides, the contractor must abide by Federal and State regulations and industry-accepted procedures and guidelines including, but not limited to:

o Use safety equipment and keep spill kits readily available.

o Attend equipment while filling to prevent overflow or the uncontrolled release of hazardous material.

o Conduct on-Post filling operations only from locations with DPW-approved back-flow prevention devices connected to the water outlets.

o Inspect equipment (per manufacturer's specifications) and the work area during application to ensure proper and safe treatment.

o Remove empty pesticide containers and other pesticide waste off of Fort Benning property for disposal.

Clean Water Act Compliance (National Pollutant Discharge Elimination System - NPDES).

Area-wide pesticide application on Fort Benning will be conducted under the authority of, and in accordance with, Georgia Pesticide General Permit (PGP) No. GAG820000 (01 August 2016) and Alabama PGP No. ALG870000 (06 September 2016), as applicable; accordingly, the contractor’s pesticide applicators must abide by the following site-specific control measures in order to minimize the discharge of pollutants to waters of the State resulting from pesticide application under this PGP:

o Use the lowest effective amount of pesticide product per application and optimum frequency of pesticide application to control the target pest, consistent with reducing the potential for development of pest resistance.

o Perform regular maintenance activities to reduce leaks, spills, or other unintended discharges of pesticides.

o Immediately report any adverse incidents and corrective actions to the IPMC through the contract representative.

o Maintain pesticide application equipment in proper operating condition by adherence to manufacturer’s conditions and industry practices, and by calibrating, cleaning, and repairing such equipment on a regular basis to ensure effective pesticide application and pest control.

Environmental Concerns. The contractor must only apply pesticides in a manner that prevents toxic exposure of personnel and non-target wildlife and plants (including on Fort Benning properties and on lands adjacent to Fort Benning properties) and any other non-target components of the environment. The contractor must not apply pesticides outdoors during excessive winds (5 MPH or greater), moderate to heavy rain, while runoff is occurring, or when conditions could result in runoff. The contractor must not apply pesticides within 50 feet of any well that provides potable water. The contractor must not apply pesticides to any wetland, aquatic area, or drainage unless the pesticide is labeled for such use. The contractor will be responsible for any additional restrictions directed by a pesticide label, State regulations, or the PMQAE.

o Contamination. Particular care must be taken to ensure that food, water, or other substances subject to ingestion are not contaminated by pesticides.

o Threatened & Endangered Species. All contractor pest control operations and pesticide application must be performed in accordance with the provisions of the Fort Benning Integrated Natural Resources Management Plan and related Federal and State compliance agreements. Coordination with DPW Conservation Branch is required for any pest control activities with the potential to impact protected plant and/or animal species. The contract representative will be notified of any potential adverse impacts to threatened and endangered species in the Record of Environmental Consideration (REC) that results from the Request for Environmental Analysis (Form FB 144-R) review performed by DPW Environmental Management Division (EMD) prior to contract implementation.

o Wildlife Pests. The control of wildlife (vertebrate) pests in the State of Georgia requires a current Nuisance Wildlife Control Permit and a Trapping License issued by the Georgia Department of Natural Resources. The use of chemicals or poisons to control wildlife is prohibited. If control of wildlife pests in the Alabama portion of the Installation is necessary, contact the Conservation Branch of Environmental Management Division for guidance.

o Cultural, Historical, and Archeological Resources. Particular care must be taken to ensure that sites managed under Fort Benning’s Cultural Resources Management Program are not negatively affected by pest management operations. The contract representative will be notified of any potential adverse impacts to cultural, historic, or archeological sites in the REC that results from the Form FB 144-R review performed by EMD prior to contract implementation.

o Pesticide Spills. All pesticide spills must be contained and cleaned up in accordance with the Installation Spill Contingency Plan (ISCP) and reported to the appropriate offices as required by the ISCP. Containment and disposal of waste material from major pesticide spills will be conducted by the Installation, at contractor expense. The contract representative will be notified of spill protocol in the REC that results from the Form FB 144-R review performed by EMD prior to contract implementation.

o Child-Occupied Facilities. In accordance with AR 608-10 (Child Development Services) weed control in children’s play areas will not include the use of herbicides. Other pesticide application in the vicinity of playgrounds or other child-occupied facilities must only be performed when children, parents, and staff are not utilizing the facility. The

State of Georgia requires the posting of signs when pesticides are applied to or in the vicinity of child-occupied facilities. The contractor will determine the ‘safe re-entry time’ following pesticide applications at these child-occupied facilities, in accordance with the manufacturer’s label and/or State regulatory agency guidelines, and notify the appropriate authority when re-entry into a treated area is allowed.

o Environmental Review. In accordance with 32 CFR Part 651, the implementation of a pest control contract is a proposed action that requires environmental impact analysis under the National Environmental Policy Act (NEPA). The contract representative must submit Form FB 144-R to EMD prior to initiating contract activities; subject-matter experts will review the contract for potential environmental impacts and provide guidance to avoid impacts in the form of a signed REC that is returned to the contract representative. Contractor pest control personnel should retain a copy of the REC in their possession while conducting pest control operations on Fort Benning property in order to have access to REC guidance.
