About this file
The document is a Justification and Approval (J&A) for a sole-source contract with Northrop Grumman Systems Corporation (NGSC) for the Department of the Navy (DoN) Large Aircraft Infrared Countermeasure (LAIRCM) system. The J&A argues that awarding the contract to any source other than NGSC would result in unacceptable delays, citing that a new source would require approximately 24 months to compete and an additional four years to achieve product maturity.
The contract covers procurement of weapon replaceable assemblies (WRAs) including advanced threat warning sensors, control indicator units, processor units, laser transmitter assemblies, high capacity cards, smart connector assemblies, and battery kits for the Navy, Marine Corps, Army, and Air Force Special Operations Command. The total contract value is $127,559,450, with work to be performed across multiple locations in the United States and expected completion by January 2027. Funding comes from fiscal years 2022-2024 aircraft procurement and research and development budgets from Navy, Air Force, and Army appropriations.

CJ&A_ 21_0283
Award of any of the efforts required for this contract to any source other than NGSC would result in an unacceptable delay. Based on current competitions within Program Manager, Air (PMA)-272, approximately 24 months would be required to conduct a competition to select a new source. In addition, a new source would require at least four years to achieve the desired product maturity in order to provide the required hardware. The unacceptable delay calculation includes three years for development and verification and one year for productionization for a low rate production line. This estimate is based on subject matter expert analysis of historical information, including the most recent production lots. Any interruption in production would pose critical setbacks to current installation schedules and Combatant Commanders requirements for platforms to self-protect against in-theater threats. Without hardware, platforms will not have the Weapon Replaceable Assemblies (WRAs) required for installation, affecting the ability to protect aircrew and complete their mission.
The rationale above also applies to future engineering changes developed for the DoN LAIRCM system.
The Government also does not possess adequate data, rights, drawings, and equipment necessary to competitively award future engineering changes to the system, which would result in the same unacceptable delay and impact.
The efforts described herein cannot be performed by a source other than NGSC without unacceptable delays in deliveries to the Fleet. No other type of supplies or services beyond the DoN LAIRCM will satisfy the agency requirements.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.
The Sources Sought required by DFARS PGI 206-302.1 was posted on 19 October 2021. In accordance with FAR 5.201(b)(1), the proposed contact was synopsized on 09 November 2021 and posted on the beta.sam.gov website. No responses have been received to date; any responses received will be evaluated by the Contracting Officer prior to negotiations. For these reasons, no other supplier can fulfill the Government’s requirement.
7. Determination of Fair and Reasonable Cost.
The Contracting Officer has determined the anticipated cost to the Government of the supplies/services covered by this CJ&A will be fair and reasonable.
8. Actions to Remove Barriers to Future Competition.
For the reasons described in paragraph 5, NAVAIR has determined competing this requirement to be impractical and has no plans at this time to compete future contracts for the types of supplies/services covered by this document. If another potential source emerges, NAVAIR will assess whether competition for future requirements is feasible. Because this effort is a follow-on for supplies and services previously awarded on a non-competitive basis, in accordance with DFARS PGI 206.304(a)(i), the prior J&A was provided to the approval authority for review. Approval of this CJ&A signifies the approval authority has made the determination required by DFARS PGI 206.304(a)(ii).
