MEMORANDUM FOR RECORD
SUBJECT: Brand Name Solicitation /Contract # SP3300-22-Q-5008
REFERENCE: FAR 11.105, Items peculiar to one manufacturer.
1. Identification of the Agency and Contracting Activity
DLA Distribution, DLA Distribution J7 BLDG 430 Mifflin Ave New Cumberland PA 17070
2. Describe the contract action, to include the dollar value and the type of limited justification.
A Firm Fixed Price (FFP) purchase order in the amount of $96,759.14 is contemplated.
This acquisition will be a Brand Name Firm Fixed Price (FFP) conducted under FAR
11.105. The Kubota brand name, is essential to the Government’s requirements, and market research indicates other companies’ similar products, do not meet, or cannot be modified to meet, the agency’s needs.
3. Description of the Supplies/Services
Four (4) Kubota Utility Vehicles, Part Number RTV-X1100CW-H.
4. Justification Rationale for Use of Brand Name Restriction of sources for this acquisition is justified in accordance with FAR 11.105.
The Kubota vehicles are compatible with the existing Kubota vehicles that have been ordered in the past and are currently using. The Kubota vehicles in the current inventory have interchangeable attachments that only fit Kubota vehicles. DLA requires the ability to be able to utilize these attachments on the new vehicles when necessary. This would avoid the expenditure of buying new attachments that would not be compatible with the current inventory of LSVs.
5. Market Research and Interested Sources GSA Advantage was consulted. The Kubota vehicles were found on GSA Advantage at a starting price of $16,958.39. Any source that can supply the brand names requested will received consideration for award.

6. Determination It is the contracting officer’s determination that the order represents the best value, consistent with FAR 11.105. The Kubota brand name is essential to the Government’s requirements and necessary for compatibility with existing equipment.
Therefore, this requirement will be specified as a Brand Name procurement.

8. Fair and Reasonable
The Contracting officer will determine the price fair and reasonable at time of award using the Simplified Acquisition Award Documentation (SAAD).
9. Certification, Review, and Approval The following endorsements/approvals are to be provided for the Justification.
