JUSTIFICATION AND APPROVAL

FOR USE OF OTHER THAN FULL AND OPEN COMPETITION

1. Contracting Activity

The Naval Sea Systems Command (NAVSEA), Naval Surface Warfare Center, Corona Division (Corona Division), Contracts Department, Code 0221.

2. Description of the Action Being Approved

This Justification and approval (J&A) authorizes the award of a Firm-Fixed-Price, contract on a sole source basis for the procurement of one (1) L/S-Band Digital Beamforming (DBF) Tracking Antenna System and one (1) C-Band DBF Tracking Antenna System to Creative Digital Systems Integration (CDSI). These antenna systems are used on the ADVANCED TELEMETRY SYSTEM – CLASSIFIED/ UNCLASSIFIED (ATS-C/U) in support of NAVSEA Integrated Warfare Systems (IWS3) – Flight Three Arleigh Burke-class Destroyer (FLTIII). This J&A shall be effective from the date of approval to the end of the contract term.

3. Description of Supplies/Services

The Corona Division Telemetry Systems Branch (PA44) has a requirement to provide a telemetry system capable of supporting missile testing for multiple projects at various missile test ranges as well as broad open-ocean testing beginning FY24. The table below identifies the specific systems required for this sole source requirement:

The Government’s minimum needs have been verified by the certifying technical and requirements personnel.

4. Statutory Authority Permitting Other Than Full and Open Competition

10 U.S.C. 2304(c)(1) Only one responsible source and no other supplies or services will satisfy agency requirements. The procedures in FAR subpart 13.5 will be utilized for this procurement in accordance with 41 U.S.C. 1901.

5. Rationale Justifying Use of Cited Statutory Authority

The CDSI’s L/S-Band Digital Beamforming (DBF) Tracking Antenna System and C-Band DBF Tracking Antenna System are the only units that can meet the Government’s minimum requirement. This equipment is needed to meet mission requirements.

The statutory authority permitting other than full and open competition applies to this procurement, because the CDSI DBF Tracking Antenna Systems are the only components of their kind available in the market, which would meet all of Corona Division shipboard ATS-C/U requirements for the reasons below:

a) The CDSI DBF Tracking Antenna Systems complies with the Government’s prerequisite requirements and possess the required configuration that meets all requirements of form, fit and function of the ATS-C/U. The form and function requirements are particularly critical for shipboard telemetry systems. They have to fit in tight spaces, and these items are carried through hatches and doors when deployed on a ship. The limited space that is allocated to install this equipment is a hard requirement that cannot be adjusted. These are the only DBF antenna of their type that meets this limited space requirement. The CDSI DBF Tracking Antenna Systems are a proprietary component manufactured solely by CDSI.

b) The proposed antenna systems are based on CDSI’s proprietary Universal Beamforming Technology (UBT), which is derived from their work over the past two decades in DBF. The most recent implementation of UBT has developed a versatile Digital Beamforming Module (DBM). The DBM is an intelligent subarray that can be used alone or combined with other DBMs to create an antenna of any desired shape or size. Each DBM is a “plug-and-play” line-replaceable unit (LRU) that can be interconnected to other DBMs via a mesh network, allowing them to function as a coherent antenna aperture. A DBM-based telemetry (TM) system can automatically acquire and track several independent sources (target channels) simultaneously once the frequency and bandwidth has been configured for each channel. CDSI is the only vendor of its kind to offer UBT.

c) The CDSI DBF Tracking Antenna Systems are compatible and augment the ATS-C/U information technology capabilities. It is the only equipment with this type of function approved under the valid information assurance (IA) certifications.

Any other equipment would invalidate the current certification. Moreover, recertification lead-times would cause unacceptable delays in fulfilling the scheduled mission requirements. These lead-times for adding new equipment to our current certification can take upwards of a year to receive approval, which is unacceptable.

d) The associated cost to the Government of identifying a potential alternate product, field-testing it, re-training staff, and transitioning all products to the new system is extremely large. An RFI would be required and would include two (2) months and approximately 120 hours to prepare, publish, and evaluate responses. To test the product, each mission will have a minimum of 100 engineers supporting (labor per event estimated at $1,000,000). In addition, the cost of operating the ship: fuel, shipboard crew (minimum 25), wear & tear, etc. will be in excess of $800,000 per event. There is an associated cost with reserving the range for use, estimated at a minimum of $200,000 per event. That is a minimum estimate of $2 million per event in labor, ship and range costs, with multiple events planned soon after the Required Delivery Date. Although very large, that $2 million cost pales in comparison to the cost of incurring delays to the overall program and possibly even missing acquisition Milestone gates. That cost would be measured in the tens of millions of dollars, if not hundreds of millions. Weapons tested onboard are slated for deployment onboard AEGIS Destroyers, each of which, costs over $1 billion dollars to build and field for the US Navy.

These costs would not be recovered and/or saved if the Navy had to compete this requirement.

In addition to the cost and performance risks, the delay in performance of finding an alternate product (2 months), testing it (1 months), procuring it (4 months), staff training (2 elizabeth.groncki Highlight elizabeth.groncki Highlight elizabeth.groncki Highlight elizabeth.groncki Highlight elizabeth.groncki Highlight elizabeth.groncki Highlight elizabeth.groncki Highlight months), and installation of the new component (2 months), testing and correction of issues (3 months) would be at least fourteen months. The impact of it could result in Corona Division not meeting critical data delivery requirements specified in Mission Operations Requirements documentation.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable

Other comparable vendors such as L3 Harris Corporation and Raven Defense Corporation were researched and considered. Both manufacturers offer similar beamforming technology, but neither offers the “plug-and-play” mesh network capability of operation with either a continuous or discrete array. Additionally, neither manufacturer’s systems are compatible with the existing equipment with regards to form, fit and function and would cause costly delay in operational readiness and effectiveness of the Government, if procured for these location-driven missions.

A Sources Sought Notice (SSN) was posted on the Contract Opportunities (SAM.gov) website, indicating the Government’s intent to sole source this requirement to CDSI. The posting was issued on 8 July 2021 and closed on 11 July 2021. At the close of the SSN, zero (0) responses were received.

7. Determination of Fair and Reasonable Costs

The Contracting Officer has determined that the anticipated cost to the Government for the supplies covered by the J&A will be fair and reasonable. The Contracting Officer will use price analysis, including commercial price lists, to determine that the final price to the Government is fair and reasonable.

8. Actions to Remove Barriers to Competition

For the reasons set forth in Paragraph 5, Corona Division has no plans at this time to compete future contracts for the types of supplies covered by this document. If another potential source emerges, Corona Division will assess whether competition for future requirements is feasible.
