JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION

SOLICITATION SPE7MX-20-R-0081

DLA Land & Maritime Justification for Other Than Full & Open Competition

(May 2018) P a g e | 2 manufacture of the item have been exhausted (See Attachment 1, Technical Certification – CL19269004). The approved source is the only known source with the data rights, manufacturing knowledge, or technical data necessary to manufacture this item. CLIN 0001 has a Weapons System Indicator Code (WSIC) code of F, indicating that failure of the part will render the end item inoperable. This replacement part is proven to perform in the weapons systems listed above in Table II. Procurement history and Market Research yields that this is only available from Acme Aerospace (6HAR8).

Note, ECI Defense (3SDB5) is no longer an approved source for this NSN. To the Contracting Officer’s knowledge, this is the only replacement part proven to function properly in the end item in accordance with military requirements. While the item is commercial, this item contains unique features in that it has minor modifications from the typical commercial version including (1) the total number of battery cells was reduced from 15 to 14 to optimize the unit energy requirement; (2) the cell arrangement was adjusted to conform to the application allowable envelope; and (3) a heater blanket was added for cold temperature operation. No other known source can provide this item with these unique modifications (See Attachment 2, Commercial Item Determination and Market Research Report). Therefore, competition must be limited to offers of the product of the company listed in Table III.

In addition, technical review in support of a potential LTC was performed on 29 October 2019. The NSN was determined to be suitable for an LTC at that time by SAPD Quality Assurance Specialist Erik Elmendorf, FLBC/LTC. (See Attachment 3, DLA L&M FLBC/LTC Communication).

8. Efforts to ensure that offers are solicited from as many sources as practicable are: [X] The acquisition will be synopsized and posted to DIBBS on or about 8 May 2020, and the Contracting Officer will directly send the synopsis and solicitation to the known contacts at all approved sources on or about 8 May 2020.

9. I hereby determine that the anticipated cost to the Government will be fair and reasonable.

This will be a five-year, firm fixed price, indefinite delivery indefinite quantity type contract. The five-year period is inclusive of one (1) three-year base period and two (2) 1-year option periods. As such, the price analysis for the future year will be based on the Global Insights Producer Price Index (PPI) forecasts. The Global Insights PPI forecast provides timely, accurate price and cost analysis, and historical records for thousands of commodity prices and wages around the globe, allowing procurement professionals to understand supplier cost structure and better negotiate supplier quotes. Based on the results of market research, the buyer anticipates receiving an offer of a sole manufacturer’s parts from the large manufacturer. Adequate price competition is not expected to exist at time of evaluation of proposals. The buyer anticipates using comparison to past reasonable purchases (adjusted for passage of time and quantity sensitivity), previous procurement history, and unredacted commercial invoices provided by the vendor, in addition to comparison to commercial market prices, to support a reasonableness determination. Finally, as certified cost or pricing data is not required from this Transdigm subsidiary for this commercial item acquisition, we will require uncertified cost or pricing data as justification for a fair and reasonable determination.

10. Market Research/Efforts to Obtain Competition:

During the preliminary stage of project development, the DLA Land and Maritime Sourcing Strategy Specialists (SSS) Branch ZAA provided the NSN Data Pull. The Contracting Specialist posted a Sources Sought for the purpose of market research on December 3, 2019, and posted on beta.sam.gov (formerly FedBizOpps) for a period of 15 days. Additionally, the Contracting Officer e-mailed formal Market Surveys to known contacts at the approved source on December 5, 2019. The Market Survey incorporated a request for the contractor to consider a 3-year base period, as well as questions regarding business size and type of business (manufacturer vs. dealer), JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION
