5. Demonstration that the Contractor’s Unique Qualifications or Nature of the

Acquisition Requires the Use of the Authority Cited Above (applicability of authority):

Only One Responsible Source (FAR 6.302-1) EXIM OIG has been using Wingswept – Case Management Tracking System (CMTS) and CMTS Cloud for 5 years. EXIM OIG previously awarded Wingswept (1) sole source, (4) option year contract with this company. The CTMS software license is proprietary to Wingswept. Wingswept owns the patent, software license and all Intellectual Property Rights for CMTS. Wingswept CMTS is a highly specialized, industry-specific product designed for Office of Inspector Generals (OIGs) that offers affordable investigative efficiency through a configurable web-based reporting solution. Several Federal OIGs are using this resource to satisfy their requirement for a case management system. Wingswept-CMTS is a secure cloud-based platform that is cost efficient, customizable, and specifically designed for OIG case management. CMTS configuration has dropdown windows to match multidimensional workflow and business rules. CMTS offers enhanced flexibility for the organization of electronic case files to store and house volumes of evidentiary exhibits. CMTS facilitates the use of structured and ad-hoc reporting to fully support detail oriented investigatory progress during the entire time cycle of a case or complaint from start to final disposition. CMTS is the central repository for all EXIM OIG investigative matters - administrative, civil, and criminal in nature.

Wingswept has resulted in substantial cost savings to the Government by providing a comprehensive case management interface suited specifically to serve our investigative critical needs. CMTS increases efficiency by reducing reporting time which creates considerable cost savings with manpower and time management. CMTS features can produce multiple notifications for time sensitive tasks and use event-based reminders to assist with meeting deadlines resulting in greater resource allocation. CMTS also can easily import case data from excel spreadsheets to create customizable graphs and charts with case information. There are numerous options to tailor CMTS without the need for additional software programming requirements reducing the need for additional IT services and increasing productivity. Wingswept has extensive experience and a proven history of excellence working with other OIG offices with similar mission objectives. Wingswept comes highly recommended from other federal agencies having specific organizational goal parameters closely aligned with our office.

The risk to using another contractor to provide these services would be a substantial duplication of costs to the government that is not expected to be recovered through competition. Interruption to the continuity of operations would cause unacceptable delays due to the efforts related to data conversion and data migration processes associated with the EXIM OIG Office of Investigations collective of voluminous casework from 2007 to the present. This entails considerable startup costs versus the alternative of continuing to utilize Wingswept for these services.

Wingswept has always successfully fulfilled its obligations associated with the prior contact agreement and exceeded expectations with outstanding customer service performance concerning any inquiries servicing CMTS. Wingswept has been an excellent partner with EXIM OIG Office of Investigations.

Accordingly, Wingswept is the only company capable of providing the supplies and services described in Section III above without EXIM OIG experiencing substantial duplication of cost that could not be expected to be recovered through competition and unacceptable delays in fulfilling its requirements.

6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable:

In accordance with 41 U.S.C. 3304, the Bank has sought to identify as many potential sources as practicable under the circumstances. The specialized capabilities required, to enable EXIM OIG investigators and analysts to effectively investigate allegations of waste, fraud and abuse against the EXIM Bank limits the likelihood of identifying multiple firms possessing the requisite skill set.

7. Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable:

(FAR 6.303-2(a)(7))

The Contracting Officer has determined that the anticipated cost to the Government for the supplies/services covered by the J&A will be fair and reasonable based upon prior experience with this contractor, comparison to rates of published rates publicly available.

8. Description of the Market Research Conducted and the Results, or a Statement of the

Reasons Market Research Was Not Conducted:

Market research was conducted, in accordance with FAR Part 10, in the GSA eLibrary among the Multiple Award Schedule (MAS) category NAICS code 511210 – Software Licenses. Market research revealed Wingswept has proprietary rights to this data platform and is the only company that provides this business platform. Wingswept also has no authorized resellers.

9. Any Other Facts Supporting the Use of Other than Full and Open Competition:

(FAR 6.302-1(b)(2) and 6.303-2(a)(9)(i)) Using this resource amounts to time savings with the ability to effectively and efficiently catalogue all our collective investigative materials. With CMTS, EXIM OIG has the capacity to seamlessly flow between different file interfaces, track case histories, monitor case progression, and accurately inventory relevant evidentiary items. Wingswept has

CMTS, which provides a comprehensive case management apparatus suited specifically to serve our investigative critical needs.
