DEPARTMENT OF THE NAVY

NAVAL SURFACE WARFARE CENTER

CORONA DIVISION

PO BOX 5000

CORONA, CA 92878-5000

IN REPLY REFER TO

J&A No. 50,221 Ser 02/1667

JUSTIFICATION AND APPROVAL

FOR USE OF OTHER THAN FULL AND OPEN COMPETITION

1. Contracting Activity

The Naval Sea Systems Command (NAVSEA), Naval Surface Warfare Center, Corona Division (Corona Division), Contracts Department, Code 0221.

2. Description of the Action Being Approved

This Justification and Approval (J&A) authorizes the award of a Firm-Fixed-Price, Contract on a sole source basis for the procurement of designing, developing, and maintaining web-based training (WBT) in support of NAVSEA Corporate Operations and Total Force Directorate to Sunset Design & Programming, Inc., 3217 Ocean Drive, Oxnard, CA 93035. This J&A shall be effective from the date of approval to the end of the contract term.

3. Description of Supplies/Services

NAVSEA has a requirement to establish and maintain four (4) web-based awareness-training courses that will be accessible through the Total Workforce Management Services (TWMS) system. The purpose of this training is to develop the skills, training, competencies, and certifications for the Divisions and Branches of Naval Surface Warfare Center Philadelphia Division (NSWCPD) and numerous additional Field Activities. The Government has identified the following WBTs as shown below:

Description of Web—based Training Base OY(s) Cyber Familiarization 1 Lot 4 Lot NSWCPD Program Management 1 Lot 4 Lot Introduction to Surface Ship Air Systems 1 Lot 4 Lot Electronic Chart Display Information Systems Overview

1 Lot 4 Lot

This J&A has a total estimated value (including options) of $330,814.94 for the quantities identified above. This requirement will be funded with Naval Innovative Science and

Engineering (NISE) funding for Fiscal Year (FY) 2021 with possible options that extend the period of performance until FY 2025.

FY21 FY22 FY23 FY24 FY25 Total

The Government’s minimum needs have been verified by the certifying technical and requirements personnel.

4. Statutory Authority Permitting Other Than Full and Open Competition

10 U.S.C. 2304(c)(1), only one responsible source and no other supplies or services will satisfy agency requirement as implemented by Federal Acquisition Regulation (FAR) 8.405-6 (a)(1)(i)(B). The procedures in FAR subpart 13.5 will be utilized for this procurement in accordance with 41 U.S.C. 1901.

The acquisition is conducted under the authority of the Multiple Award Schedule Program.

5. Rationale Justifying Use of Cited Statutory Authority

The web-based training modules are designed to be executed through the Department of Navy’s TWMS system. This requirement includes the use of software that must be compatible and interoperable with the TWMS system. Additionally, Section 508 of the Rehabilitation Act of 1973 requires Federal agencies to make their electronic and information technology (EIT) accessible to people with disabilities. Sunset Design & Programming has been developing web-based training modules that are Section 508 compliant for Naval Sea Systems Command since 2014 using the TWMS system as the platform for distribution of the developed web-based training.

In the last 19 months, the Government awarded three contracts for similar training requirements to the following vendors:

Synchron LLC, Sonalyst, Inc., and Sunset Design & Programming.

At that time, neither Synchron LLC nor Sonalyst, Inc. could create training that met the Government’s requirements. The other vendors were unable to create training that was 508 compliant or compatible with TWMS.

To approve another vendor, the Government would need to develop competitive guidelines that would allow the requirement to be competed on the open market. This would include screening existing work by prospective vendors followed by 508 compliance auditing to ensure Federal guidelines have been utilized in the development of the web-based training. This process would unnecessarily delay the implementation of the developed training while the vendor develops the modules with 508 compliant features and attempts to upload and interface the training with the TWMS system. The new vendor would also need to acquire access to the Navy Network.

Effort Hours Labor Rate Cost Web Application/ Programmer 1250 Project Manager 500 Copyrighter/ SME 400 Graphic Design 675 Quality Control 850 Voice Over 5

Further, since those previous procurements, the Government has conducted market research including posting a Sources Sought Notice. It has been determined that the previously reviewed companies could still not meet the Government’s requirement.

Additionally, no new companies that are capable to meet the 508 compliance and TWMS compatibility requirements have been identified. Therefore, if the government were to develop a competitive specification instead of purchasing from Sunset Design & Programming, there will be a minimum delay of 7 weeks at a minimum cost of $264,902 to the Government. This is unacceptable and will have a negative impact on readiness.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable

A sources sought notice was posted on the beta.sam.gov website to announce the Government’s intent and request interested parties submit a capability statement indicating if they can meet the specifications listed in the statement of work. The posting was issued on 27 January 2021. Zero (0) businesses responded.

7. Determination of Fair and Reasonable Costs

The Contracting Officer has determined that the anticipated costs to the Government for the items covered by this J&A will be fair and reasonable. Significant (or similar) quantities of this requirement have been purchased from this offeror in the past and cost/pricing information was received on those past procurements. This information should be sufficient to support the fair and reasonable cost determination of this procurement.

8. Actions to Remove Barriers to Competition

For the reasons set forth in Paragraph 5, Naval Sea Systems Command, Naval Surface Warfare Center, Corona Division, Contracts Department, Code 02 has no plans at this time to compete future contracts for the types of items covered by this document. If another potential source emerges, Code 02 will assess whether competition for future requirements is feasible.
