JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION

(JOFOC)

For 80NSSC24Q0056 NCCIPS Zone A Rack Security Infrastructure Phase 3

1. Federal Acquisition Regulation (FAR) 6.303-2(b)(1) – Identification of the agency and the contracting activity, and specific identification of the document as a “Justification for other than full and open competition.”

This document is a justification for other than full and open competition prepared by

National Aeronautics and Space Administration (NASA) NASA Shared Service Center

(NSSC).

The procuring agency is the National Aeronautics and Space Administration (NASA), and the contracting activity is NSSC.

2. FAR 6.303-2(b)(2) – The nature and/or description of the action being approved:

This justification provides the rationale for contracting by other than full and open competition to award a sole-source contract, to SIEMENS Industry, Inc. for the procuring, configuring, and integration of eight (8) iSTAR Ultra Rack Mount Control Panels, and thirty-two (32) iSTAR Ultra ACM boards, as well as the required licenses, dual input rack mountable power supplies, enclosures, battery backups, and battery backup enclosures.

3. FAR 6.303-2(b)(3) – A description of the supplies or services required, to meet the

Agency’s needs (including the estimated value):

The NASA National Center for Critical Information Processing and Storage security system (NCCIPS) requires a comprehensive, in-depth technical knowledge of all installed components. Siemens is the incumbent provider for NASA NCCIPS Security infrastructure and has this in-depth knowledge of the security system and equipment. The installation project is an expansion of the current system, which Siemens is responsible for all preventative and corrective maintenance, which covers a large portion of the building for the Department of Homeland Security. The system safeguards critical national security assets.

The estimated Period of performance is the date of award through September 30,2024.

Siemens has an intimate knowledge of the unique settings on the C-Cure software that controls the Intrusion Detection System (IDS). NCCIPS has specific alarm settings that are programmed into the system (for example there are programmed sensors in the ceiling and beneath the floor that are linked to the Siemens system that communicates with C-Cure).

4. FAR 6.303-2(b)(4) – An identification of the statutory authority permitting other than full and open competition:

The statutory authority permitting other than full and open competition is 41 U.S.C 1901 as implemented by FAR 6.302- 1, Only one responsible source and no other supplies or services will satisfy agency requirements.

5. FAR 6.303-2(b)(5) – A demonstration that the proposed contractor’s unique qualifications or the nature of the acquisition requires use of the authority cited:

The rationale supporting the use of 10 U.S.C. 3204(a)(1) is due to the specialized nature of this requirement, there are no known actions which the Agency may take to give consideration to other repair providers for the requirements as described below.

Siemens Industry Inc. is the Original Equipment manufacturer (OEM) of the NCCIPS Fire Alarm, Fire Suppression, and Security infrastructure located at the National Center for Critical Information Processing and Storage security system (NCCIPS) Complex. Siemens Industry, Inc. has OEM-certified engineering, technical and material support available 24x7.

Siemens Industry, Inc. is the owner of proprietary drawings and specifications for the Fire Alarm, Fire Suppression, and Security infrastructure located at the NCCIPS facility.

Siemens Industry, Inc. is also the incumbent provider for preventative and corrective maintenance services. The Siemens’ warranty states that it would be voided should any changes, adjustments, service, or repairs be made to the covered equipment by any other party other than Siemens Industry, Inc. Additionally, Siemens may, at its option, terminate its obligation to render further service for the equipment so affected. Should such a scenario occur, Siemens would not offer any refund of any portion of the service fee back to the Government. Since this equipment is under an existing maintenance contract, awarding these modifications to a party other than Siemens could potentially put the NCCIPS security system, Fire Alarm, Fire Suppression, and Security infrastructure at risk. Should the Government opt to procure parts and services from a third-party vendor, continuation of all services to this critical system, to include preventative and corrective maintenance services, would be at the sole discretion of Siemens Industry Inc., placing an undue level of risk on the Government with no refund of service fee.

Furthermore, competing these services could significantly impact projected timelines for completion and potentially compromise the timeline for relocating future tenants to the NCCIPS. The services in this request are pertinent to maintaining and modifying both the physical and the virtual security infrastructure of a Mission Critical Facility. Utilization of a vendor other than Siemens Industry, Inc. introduces the risk of parts being incompatible with the current system, which ultimately bears the risk of voiding the warranty of the existing system, increasing the risk of distribution of CUI and other pertinent facility engineering documentation, and leading to a lapse in security and fire suppression coverage for the facility with cognizance over these functions, which could put the NCCIPS complex, and its tenants at risk.

6. FAR 6.303-2(b)(6) – A description of the efforts made to ensure that offers are solicited from as many potential sources as practicable, including whether a notice was or will be publicized as required by Subpart 5.2 and, if not, which exception under 5.202 applies:

A notice to the Government Point of Entry (GPE) website (Sam.gov) was published on April 15, 2024 and closed on April 19, 2024, for a total of 5 days in accordance with FAR Subpart 5.2. This posting informed potential sources of NASA’s intent to award this sole-source contract to Siemens Industry, Inc. The results of this synopsis are summarized in Section 10 below.

7. FAR 6.303-2(b)(7) – A determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable:

The Contracting Officer’s signature on this document indicates that the Contracting Officer has determined that the anticipated cost to the government will be fair and reasonable. The Contractor shall be required to submit a proposal to be evaluated and negotiated by the Government. Prior to execution of the contractual instrument, a proposal analysis will be performed. The proposal analysis will ensure that the final agreed-to price for the contract action is fair and reasonable.

8. FAR 6.303-2(b)(8) – Description of the market research conducted, and the results, or a statement of the reasons market research was not conducted:

Market research was performed in April 2024. While there are other vendors provide fire suppression and security systems, our market research did not identify any that could integrate their components into the Siemens security and fire suppression systems. In fact, the synopsis did not receive any responses after being posted, which indicates that either no vendor has compatible components or, if there are compatible components, such components would require certification by Siemens and acceptance into the existing systems in order to not void the warranty. The certification process would certainly cause a delay in upgrading the system, which would lead to a lapse in warranty coverage of the entire system until Siemens either certified the components and accepted them into their warranty program or opted to not accept the parts and completely voided the warranty on the entire system, exponentially increasing the risk to the facility, the data and the tenants.

9. FAR 6.303-2(b)(9) – Any other facts supporting the use of other than full and open competition:

Siemen's reserves the right to discontinue maintenance coverage to covered equipment serviced by anyone other than Siemens. In addition, since this equipment is under an existing maintenance contract, awarding these modifications a vendor other than Siemens could potentially put the NCCIPS Fire Alarm, Fire Suppression, and Security infrastructure at risk.

Continuance or termination of preventative and corrective maintenance services would be at the discretion of Siemens Industry Inc., with no refund of service fee, and a potential voidance of the system warranty by Siemens should NASA use third-party parts in the Siemens proprietary system. Awarding this service to a vendor other than Siemens would cause a delay in coverage of the new system and loss of coverage to the existing system as the system would not be covered under the Siemens warranty and maintenance contract in the interim period. In order to get Siemens to assume coverage for the components and recertify the existing system under the existing maintenance agreement, Siemens would have to send out two technicians for approximately 16-24 hours (at an average rate of $100 an hour with overhead costs) to inspect and test the systems installation and integration into the existing security system before Siemens would honor the warranty and incorporate it into our existing maintenance contract, which could take 30-60 days to complete the inspection and recertification process during which time the current system would be without maintenance service coverage. During this period, the components would not be covered with 24x7 maintenance support, and the critical security of the facility would be vulnerable as there would be no on-call technical support. Due to the nature of the facility, we would be required to redirect NCCIPS personnel to provide physical security to all areas until integration and recertification were complete.

10. FAR 6.303-2(b)(10) – A listing of the sources, if any, that expressed an interest in writing in the acquisition:

A notice of NASA’s intent to award this sole-source action was synopsized on the GPE website (Sam.gov) for 5 days per FAR Subpart 5.2 (See Section 6 above). The notice of intent yielded no responses from any vendors that can provide the components to integrate into Siemens current system.

11. FAR 6.303-2(b)(11) – A statement of actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required:

The Agency will continue to examine the market in the future for alternative solutions or new sources before executing any subsequent acquisitions for the same requirements.
