Simplified Procedures for Commercial Items Prourements Exceeding the Simplified Acquisition Threshold Pursuant to FAR Subpart 13.5

Pursuant to the requirements under the authority of the simplified acquisition procedures for commercial items at 41 U.S.C. § 1901, as implemented by Federal Acquisition Regulation (FAR) 13.501 and consistent with the content requirements of FAR 6.303-2, the justification for the use of this statutory authority is justified by the following facts and rationle as follows:

Agency and Contracting Activity.

The Department of Homeland Security (DHS), Customs and Border Protection (CBP), Office of Acquisition, Procurement Directorate’s Aviation, Maritime and Border Technologies Contracting Division proposes to enter into a Purchase Order on a basis other than full and open competition in support of Air and Marine Operations.

Nature and/or description of the action being approved.

CBP Air and Marine Operations (AMO) has a requirement to obtain continuous internet connection for aircra t to the UniTrac service in the Air and Marine Operations Center (AMOC) located in iverside, California. CBP AMO plans to satisfy this requirement by making a sole source award to Outerlink Global Solutions (Outerlink).

The proposed Contractor:

Contract Type: Firm-Fixed Price

Description of Supplies/Services.

This requirement is to procure satellite airtime for exisiting Outerlink tracking systems installed on CBP aircraft. Only Outerlink has access to the Global Positioning Systems (GPS) tracking device signal data which is proprietary in nature. OuterLink also provides uninterrupted internet connection to the AMOC via their satellite network and servers to retrieve the GPS data. The satellite airtime allows tracking of AMO’s aircraft. This is essential for officer safety when the aircraft is below or out of radar coverage. The tracking information also allows CBP field commanders to position law enforcement aircraft for air and ground enforcement support.

11. A Statement of the Actions, if Any, the Agency May Take to Remove or Overcome Any Barriers to Competition Before Any Subsequent Acquisition for Supplies or Services Required.

CBP will continue to conduct a web search of different companies that provide tracking devices and satellite services. The current satellite service will continue to be a requirement until CBP identifies a need for a new system. This could happen with the procurement of a new aircraft, as CBP considers incorporating updated systems, radios, radar, monitors sensor turrets, etc. At this time, the OuterLink CBP3i is CBP’s standard system. Future satellite airtime contracts with OuterLink are based on the requirements Air and Marine Operations has established by purchasing OuterLink systems.

12. Posting Requirement. CBP will post this requirement on SAM.gov pursuant to FAR 6.305.
