JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION

NATIONAL NUCLEAR SECURITY ADMINISTRATION

OFFICE OF PERSONNEL AND FACILITY CLEARANCES AND CLASSIFICATIONS

PSYCHOLOGICAL ASSESSMENT SERVICES

DE-NA0001419

June 6, 2017

I. IDENTIFICATION OF THE AGENCY AND THE CONTRACTING ACTIVITY

The Office of Personnel and Facility Clearances and Classification (OPFCC), U.S.

Department of Energy (DOE), National Nuclear Security Administration (NNSA) requests an increase to the ceiling value on a contract using other than full and open competition. The contracting activity is NNSA, Office of Acquisition Management (NA-

APM-124).

II. NATURE AND/OR DESCRIPTION OF THE ACTION BEING APPROVED

The proposed action is to issue a short-term, bridge task order to National Security Psychological Services, LLC to provide necessary and critical psychological assessment services for a period of up to 9 months. This action is to modify an existing single award IDIQ Contract to increase the ceiling in the amount of $636,750.00 from $3,087,699.31 to $3,724,449.31. The current task order is a hybrid Firm-Fixed-Price (FFP), Time and Materials (T&M) order, which was awarded on December 16, 2011 and is due to expire on June 15, 2017. In order to ensure continuity of service a new task order with a basic period of six months, and a three-month option is required. The six month basic period will provide a short-term solution for continuity of services while the follow-on contract is awarded. The three month period will provide adequate time for the transition period of the new contract if needed. The Period of Performance and estimated values for the base and option period for the new task order is as follows:

6 month base period (6/16/2017 – 12/20/2017): $424,500.00

3 month option period (12/21/2017 – 3/20/2018): $212,250.00

III. DESCRIPTION OF SUPPLIES AND/OR SERVICES REQUIRED

Psychological Assessment Services are needed to provide board certified psychiatrists and licensed clinical psychologists who can conduct Personal Security File (PSF) reviews, clinical evaluations, final reports, formal testimonies at administrative review hearings and other related special requests, as required by Title 10 Code of Federal Regulation (CFR) Part 710, Criteria and Procedures for Determining Eligibility for Access to Classified Matter of Special Nuclear Material. The services are used by OPFCC in determining an individual’s eligibility for a DOE/NNSA access authorization

(security clearance). OFPCC requires uninterrupted reviews, a process that takes 2- 3 months to clear new and existing employees and contractors.

IV. STATUTORY AUTHORITY

The statutory authority permitting other than full and open competition is 41 USC 3304(a)(1), as implemented by the Federal Acquisition Regulation (FAR) Subpart 6.302- 1 entitled “Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements”.

V. APPLICATION OF AUTHORITY

The current contractor has specialized experience with this requirement and practiced clinicians that provide psychological assessment services. A new competitive contract is anticipated to be in place within the next 6 months, which may include a 3 month phase-in process. The program would be negatively impacted to have two turnovers of new contractors in a one year period, therefore it is essential that National Security Psychological Services, LLC perform uninterrupted services to perform current and new cases until the new contract is in place.

VI. EFFORTS TO IDENTIFY ADDITIONAL SOURCES

A competitive, total small business set-aside acquisition is currently being worked. A previous Solicitation was posted in 2016 for this effort and was cancelled due to non-responsiveness and an error in the Government’s cost estimates. The new follow-on contract is expected to be awarded no later than September 2017. In accordance with FAR 5.3, notification of this action was posted in FedBizOpps on May 4, 2017 under Solicitation number DE-NA0001419. No inquiries have been received to date.

VII. DETERMINATION OF REASONABLENESS OF COST OR PRICE

In accordance with FAR 15.404(b)(2)(ii), Comparison of proposed prices to historical prices paid; the anticipated cost to the government is considered to be fair and reasonable as prices for services are in line with the current IDIQ contract. The only increase in price allowed will be the current escalation rates as identified within the contract. An Independent Government Cost Estimate based on historical data was developed for estimating the ceiling value increase.

VIII. MARKET RESEARCH

The data collected from the cancelled solicitation for the follow-on effort as well as historical data from the existing contract was used as market research information for this action. As discussed in section VI of this JOFOC, there were multiple small business respondents.
