PRICES BLOCK 23
Background:
United States Embassy Lusaka and its tenant agencies, herein referred to as the United States
Government (USG), greatly rely on local Internet Service Providers (ISP) for high end, professional-grade data services. Currently, the USG receives data services from a variety of
ISPs.
The USG Contracting Officer (CO) and the Contracting Officer’s Representative (COR) have a fiduciary responsibility to obtain the best ISP services for the least cost. The USG is also committed to fair and transparent procurement.
The USG is in the process of consolidating and streamlining data services. As requirements change, so will the need for additional bandwidth. As such, the USG is seeking a scalable solution to bandwidth pricing. As the number of contracted megabits (Mbps) increases, the price per megabit shall decrease at a formulated rate.
The USG currently uses three circuits as listed below:
1) Department of State (DOS) Virtual Private Network (VPN), currently running at 3 Mbps.
2) DOS Dedicated Internet Network (DIN), currently running at 2 Mbps.
3) USAID VPN, currently running at 4 Mbps.
Each of the three circuits is funded via different mechanisms and separate contracts exist for each circuit; therefore, it is difficult for the USG to coordinate the simultaneous contracting of all three. Such is the reasoning behind our request for the contractor to provide per Mbps costing.
With per Mbps costing, the USG will be given the flexibility to add or subtract Mbps in accordance with current needs.
I. Scope of Services
Unless otherwise specified herein, the contractor shall complete all work, including furnishing all engineering, tools, supplies, labor, material, equipment, and services, required under this contract. The stated services shall be completed within the timeframe specified herein. The price listed below shall include all labor, materials, overhead, and profit. In consideration of satisfactory performance of all scheduled services required under this contract, the contractor shall be paid a firm fixed-price for all services.
II. Base Period
The contract will be for a one-year period from the date of the contract award and a notice to proceed with four (4) option years.
III. Prices
In consideration of satisfactory performance of the services required under this contract, the contractor shall be paid a Firm Fixed Price (FFP) per month for line items 1, 2, and 3. Line items 1(a), 2(a), and 3(a) will be on a Requirements basis with the issuance of a Task Order and if they are required.
The prices below are stated in …………………..(offeror shall insert currency).

Q. Circuit Downtime and Credits:
Credits shall be assessed against the contractor when service does not meet minimum acceptance levels.
Circuit Availability Acceptance Level:
The yearly circuit availability acceptance level shall be calculated by 365 days per year times 24 hours per day times 99.5 per cent (365 * 24 * 0.995 = 8,716.20 available hours/year).
The monthly circuit availability acceptance level shall be calculated by the number of days per calendar month times 24 hours per day times 99.5 per cent (i.e. December: 31 * 24 * 0.995 =
740.28 available hours/month).
Downtime:
Downtime shall be defined as the period from the time the circuit becomes inoperable or unusable to the time the circuit is completely restored. A five per cent down downtime shall be allowed for the contractor to perform routine and preventive maintenance.
The maximum downtime for 365 days of service shall be calculated by 365 days per year times
24 hours per day times 5 per cent (365 * 24 * 0.05 = 740.28 allowable hours/year downtime).
The maximum downtime for calendar month of service shall be calculated by the number of days per calendar month times 24 hours per day times 5 per cent (i.e. December: 31 * 24 * 0.05 = 3.72 allowable hours/month downtime).
The downtime period shall commence at the time of the first attempt by the USG to contact the contractor. The downtime period shall continue to the time the circuit is fully operational and returned to the USG.
Downtime credits shall be assessed and accumulated when the circuit availability falls below the defined acceptance levels. Downtime credits shall be assessed in minimum increments of one hour. For example, an outage lasting 1.5 hours would be assessed at two hours.
3. Exceptions to Accumulation of Downtime:
Accumulating of circuit downtime shall include all unscheduled downtime deemed to be the responsibility of the contractor, with the following exception:
An exception shall be granted when the failure to perform arises out of causes beyond the control and without the fault or negligence of the contractor or subcontractor as defined in the
Termination for Default clause in Section I of this contract.
Malfunction of equipment, frequency fading and interference, errors of commission and/or omission by the contractor or subcontractor, and commercial power surges or failures are considered to be normal hazards of the industry and therefore do not qualify as causes beyond the control of the contractor or subcontractor. ―No trouble found,‖ ―came clear while testing,‖ or other such resolutions do not qualify as causes beyond the control of the contractor or subcontractor.
The Contracting Officer shall make final determination as to whether downtime is the responsibility of the contractor. If requested by the Contracting Officer, the contractor shall provide documentation to support claims of excusable downtime. For downtime determined to be the contractor’s responsibility, the Contracting Officer may elect to assess a credit for each instance of non-performance.
4. Payment Reduction for Downtime Credits:
When circuit downtime credits are owed to the USG, the total number of creditable hours shall be accumulated for the month and will be deducted from the payment due the contractor in the month the credits were accrued.
5. Trouble Escalation Procedure
a. The Government shall refer the problem to the carrier after performing tests as prescribed in the Trouble Analysis procedure. Obtain the name of the carrier test person and a carrier ticket number; record this information on the Government’s Remedy Ticket.
b. After the trouble has been referred to the carrier for two (2) hours, recall the carrier for an update on the current trouble. Record the carrier’s response, the name of the individual you talked with, and the carrier ticket number on the Remedy Ticket.
c. After the trouble has been referred to the carrier for four (4) hours, recall the carrier for an update on the current trouble. If the carrier’s response is not satisfactory escalate the trouble to the carrier’s management. Record the carrier’s response, the name of the individual you talked with, and the carrier ticket number on the Remedy Ticket.
d. After the trouble has been referred to the contractor for six (6) hours the COR shall escalate the trouble to the contractor’s manager; also notify IRM/IMO and the Contracting Officer and the STATE IRM/ISC Office. Record the contractor’s response, the name of the individual you talked with, the contractor ticket number, and the names of the IRM managers that were notified on the Remedy Ticket.
e. Continue to status the contractor for the remainder of the outage or until you have received a problem resolved status.
