SECTION C – DESCRIPTION/SPECIFICATIONS
NHTSA Oracle License Self-Assessment
C.1 Purpose
NHTSA currently operates a network environment that includes approximately over 40 Oracle databases, 60 WebLogic instances, and approximately 500 Java installation instances that operate in a virtual VMware environment. Over the years, NHTSA has undergone multiple physical infrastructure upgrades and modernization renditions which need to be recalculated for assurance of compliance. Additionally, the agency is currently in the process of migrating/transitioning many of these IT-systems to the Cloud. In the interest of compliance, NHTSA OCIO seeks industry professional services in conducting and completing a self-assessment of its Oracle environment using a vendor’s Oracle software script running tool to identify all Oracle based software in use on NHTSA’s servers.
C.2 Scope
NHTSA seeks licensing guidance, risk reduction, cost savings recommendation, and efficiency in proactively managing its Oracle software usage and license entitlements to maintain license compliance, and to identify opportunities to optimize current and/or future Oracle license costs.
NHTSA seeks to achieve, but not limited to, the following:
• Current State License Compliance Assessment.
• Optimization Assessment.
• Java Strategy and Assessment.
• Audit Strategy Development.
• Ongoing Usage and License Compliance Monitoring.
• Identify future license cost-saving opportunities, where applicable.
• Monitor database configurations for CIS security compliance and alert on vulnerabilities.
• Mapping of Oracle products and license count to the various NHTSA systems.
C.3 Objectives
NHTSA seeks to achieve a comprehensive assessment of Oracle Licenses that NHTSA holds, by meticulously examining four critical areas of interest:
• license compliance assessment;
• optimization assessment;
• audit strategy assessment; and
• ongoing license compliance monitoring.
First, the license compliance assessment will involve a comprehensive review of our Oracle software deployment to ensure alignment with Oracle licensing agreements. This includes a meticulous analysis of the current license inventory, identifying potential compliance risks, and rectifying any deviations to ensure adherence to Oracle's licensing policies. By undertaking this assessment, we aim to optimize resource utilization and minimize the risk of non-compliance.
Second, the optimization assessment will focus on enhancing our Oracle software deployment to achieve cost-efficiency and performance optimization. This involves a detailed evaluation of the existing infrastructure, identifying opportunities for consolidation, and recommending adjustments to align with Oracle's licensing models. The goal is to maximize the value derived from our Oracle investments while minimizing unnecessary expenses.
The audit strategy assessment is crucial in preparing for potential Oracle audits. This assessment will involve developing a robust strategy to respond to audit requests, ensuring that all necessary documentation is readily available, and establishing internal processes to proactively manage audit-related activities. By having a well-defined audit strategy, we aim to navigate potential audits seamlessly, mitigating risks and demonstrating a commitment to compliance.
Finally, ongoing license compliance monitoring is essential for maintaining a proactive and vigilant approach to Oracle software management. This involves implementing continuous monitoring mechanisms to track changes in software usage, promptly addressing any deviations, and staying abreast of updates in Oracle's licensing policies. By establishing a system for ongoing monitoring, we aim to foster a culture of sustained compliance and minimize the likelihood of future compliance issues.
In conclusion, NHTSA’s objective is to spearhead a comprehensive Oracle license assessment Professional Services initiative that encompasses license compliance assessment, optimization assessment, audit strategy assessment, and ongoing license compliance monitoring. Through these efforts, we aim to not only ensure current compliance but also optimize our Oracle software deployment for enhanced efficiency and cost-effectiveness. This proactive approach will position the agency to navigate the complexities of Oracle licensing confidently and strategically, ultimately fostering a sustainable and compliant software environment.

(viii) FAR 52.212-1 – Instructions to Offerors--Commercial Products and Commercial Services (Sep 2023) applies to this acquisition.
(ix) 52.212-2, Evaluation--Commercial Items (NOV 2021) is applicable to this solicitation.
As prescribed in 12.301(c), the Contracting Officer may insert a provision substantially as follows:
Evaluation—Commercial Items (NOV 2021)
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:
Listed in descending order of importance:
1. Technical Acceptability
This factor will be scored based upon the offeror’s ability to meet the specifications required as described in Section C.1, C.2, & C.3 above.
2. Past Performance
This factor will be scored based upon the offeror’s corporate experience and past performance performing similar work as described in Section C.1, C.2, & C.3 above.
The offeror’s record of financial responsibility as it relates to the use of federal funding.
Note: Offerors, for which no historical record of past performance has been established, will only be rated on “Corporate Experience” for this factor. Offerors, whose established record of past performance is poor, will be given a “poor” rating for the evaluation factor.
3. Price
The Offeror is expected to establish a reasonable price relationship between all price elements listed in their Quote. An evaluation of the Offeror’s Quote will be made to determine if the cost is realistic for the work to be performed, reflects a clear understanding of the requirements, and is consistent with the work as described in Section C.1, C.2, & C.3 above.
Reasonableness determinations will be made by determining if competition exists, by comparing proposal prices with established commercial market prices, General Services Administration price schedules, and/or by comparing proposal prices with the Independent Government Cost Estimate (IGCE).
Quotes will be evaluated on a Lowest-Price, Technically Acceptable (LPTA) basis.
(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
