About this file

This is a Request for Proposals (RFP) issued by the Schuylerville-Victory Board of Water Management for General Legal Counsel Services. The Board, which administers the Joint Water System serving the Village of Schuylerville and Village of Victory in Saratoga County, New York, seeks qualified attorneys or law firms to provide ongoing legal counsel with expertise in New York municipal law, intermunicipal agreements, public water systems, governmental contracting, regulatory compliance, and public infrastructure. The scope of services includes general municipal counsel, board governance and meeting attendance, intermunicipal agreement interpretation, water system regulatory matters, customer service issues, contracts and procurement, capital projects, grant funding assistance, and claims and litigation support. The RFP was issued on September 23, 2026, with a deadline for questions by October 13, 2026, and proposals due by October 19, 2026, at 4:00 p.m. The Board anticipates selecting General Counsel by October 19, 2026, with interviews potentially conducted between October 20-23, 2026, if necessary. The initial term of appointment is one year, with the possibility of renewal or extension upon mutual agreement and Board authorization.

The Board seeks compensation through a fixed monthly retainer covering routine legal services, explicitly stating it does not intend to select counsel based on a predominantly hourly billing model. Proposers must clearly identify the monthly retainer amount and specify which services are included, such as telephone consultations, email consultations, resolution review and drafting, contract review, legal correspondence, board meeting attendance, procurement and regulatory consultation, and routine legal research. Proposers may exclude extraordinary matters such as substantial litigation, Article 78 proceedings, complex administrative proceedings, major real estate transactions, and bond counsel services, with alternative compensation methods proposed for such excluded work. The incumbent, Attorney Phillip Dixon, currently serves as legal counsel for the Board. The Board will evaluate proposals based on municipal law experience, water system expertise, intermunicipal organization experience, regulatory familiarity, responsiveness, references, absence of conflicts of interest, and overall value, noting that price alone will not be the determining factor. Proposals must include firm information, assigned attorney credentials, relevant experience, professional references, conflicts disclosure, and evidence of professional liability insurance.

The Board expects routine legal questions to receive timely acknowledgment and, when reasonably possible, substantive guidance without unnecessary delay.

Proposals should demonstrate that the attorney or firm:
