Solicitation is issued as a one (1) year firm fixed price, Indefinite Delivery/Indefinite Quantity (IDIQ) type contract with two(2) - one(1) year options.

SUBCONTRACTING PLAN: Large Businesses submitting a proposal are required to submit their subcontracting plan as part of their proposal by the scheduled closing date and time. Failure to submit a subcontracting plan may result in the proposal being found technically unacceptable and may not be considered for further evaluation.

Contractors are required to submit the material by the closing date, Tuesday, October 2, 2018 at 2:00 PM Eastern time zone to the address listed below.

Samples that are not received by the closing date and time will not be evaluated and the proposal will not be considered further for award. Please note solicitation SV0096-18 and your company's name/address on the packing slip for the material that is sent. Contractors are responsible for the total cost of the sample, including shipping of the material for evaluation. See Clause 52.214-20.

UNICOR's desired delivery is 30 days or sooner after issuance of each delivery order in order to meet customer requirements. Vendors are required to provide their best manufacturing/delivery time for evaluation, and delivery schedule will be established at time of award. Delivery orders will be issued in accordance with 52.216-19.

DESCRIPTION

The contractor, through their shoe manufacturer agrees to provide the following products to UNICOR.

A. Standard requirements for 4" oxford and 6" composite toe work boots:

1. composite toe cap - non metallic

2. non metallic eyelets

3. must offer medium wide(E)and wide wide(EEE) widths in men's and women's sizes

4. extra double stitching

5. bamboo shank or non metal shank

6. outsole EH (electrical hazard) rated; meets ASTM standards; must provide certificate from testing agency

7. non-marking, oil resistant outsole

8. black in color

9. all leather or action leather-polyurethane (PU) coated; lightweight; water resistant

10. interior lining: cambrelle style look and finish; non-staining, breathable

11. heavy duty, round, nylon laces

12. each pair individually boxed w/ model size and width easily displayed on the box

13. available packed solid sizes per case (6 pairs or 12 pairs in a case)

14. size requirements: Men's sizes 5-11, 12, 13, 14, 15 and Women's sizes 5-10, 11, 12 in both E and EEE widths

The above shoes must meet or exceed all ANSI's standards for impact compression and EH.

UNICOR reserves the right to reduce its requirement of boots with a 30 day notice to the vendor, should it develop the processes to manufacture one or more popular sizes of boots in one or more of its factories in order to provide a cost savings and/or inmate work environment to reduce inmate idleness.

PART I: INFORMATION

This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6 as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; offers are being requested and a written solicitation will not be issued. The solicitation number is

SV0096-18 and this solicitation is issued as a Request For Proposals (RFP). The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-99. The North American Industry

Classification System code is 316210. This requirement is unrestricted. UNICOR, Federal Prison Industries, Inc., intends to enter into a ONE-year, firm-fixed-price, Indefinite Delivery/Indefinite Quantity (IDIQ) type contract with two one-year options for the following commercial item(s):

Composite-toe safety boots and canvas slip on shoes for the Petersburg Distribution Factory.

ITEMS WILL BE AWARDED INDIVIDUALLY. MORE THAN ONE ITEM MAY BE AWARDED TO ONE OFFEROR.

ALL QUANTITIES ARE BASED OFF PRIOR CONTRACT REQUIREMENTS AND ARE ESTIMATES ONLY AND ARE NOT GUARANTEED TO BE

PURCHASED.

Vendor is required to keep adequate inventory of footwear for each item in their inventory to meet requirements. If delinquencies should arise at any time during the contract term, consideration fees will be taken for non-excusable delays, Re- Procurement cost, Administrative costs incurred and possible cost of loss of customer.

Any contract resulting from this solicitation will not be an obligation. Funds will be obligated by delivery orders.

The Estimated period of performance will be as follows, if option years are exercised:

Base Year: November 1, 2018 to October 30, 2019

Option Year One - November 1, 2019 to October 30, 2020

Option Year Two - November 1, 2020 to October 30, 2021

NOTICE TO GOVERNMENT WHEN CONTRACTOR(S) DELAYS:

In the event the contractor(s) encounter difficulty in meeting performance requirements, or when there is an anticipated difficulty in complying with the delivery terms or completion dates, or whenever the contractor has knowledge that any actual or potential situation is delaying or threatens to delay the timely delivery/performance of this contract, the contractor must immediately notify the Field Administrative Contracting Officers at UNICOR

Petersburg, VA or in writing, giving pertinent details. This information will not be construed as a waiver by the

Government of the required delivery schedule, or the Governments rights to impose consideration against delinquencies or other remedies provided by this contract.

Contractor agrees that FPI is in the category of the most favored or best commercial customer category of the

Contractor and as such, the Contractor will:

During the contract period, the Contractor shall report to the Contracting Officer all price reductions offered to the category of customers that are considered by the Contractor to be their most favored or best commercial customer.

1. A price reduction shall apply to purchases under this contract if, after the award date, the Contractor-

i) Revises downward its commercial catalog, price list, schedule, etc., to its best commercial customers (or category of customers) below the awarded price under this contract;

ii) Grants more favorable discounts or terms and conditions to its best commercial customers than those contained in this contract that would result in prices below the awarded price under this contract, an/or

iii) Grants special discounts to its best commercial customer (or category of customers) that would result in prices lower than the awarded price under this contract.

2. The Contractor shall offer the price reduction to FPI with the same effective date, and for the same time period, as extended to the commercial customer (or category of customers).

The Contractor may offer the Contracting Officer a voluntary price reduction at any time during the contract period.

The Contractor shall notify the Contracting Officer of any price reduction subject to this clause as soon as possible, but not later than 15 calendar days after its effective date.

Future requirements for these or similar items from this or other UNICOR factories may be added to the resulting contract if considered to fall within the scope of work and the price is determined to be fair and reasonable.

(d) Comptroller General Examination of Record. (a) Any supplies and services to be furnished under this contract shall be ordered by issuance of delivery orders or task orders by the individuals or activities designated in the Schedule. Such orders may be issued from _date of award_ through _5 years thereafter.

2852.233-70 PROTESTS FILED DIRECTLY WITH THE DEPARTMENT OF JUSTICE

(JAN 1998)

(a) The following definitions apply in this provision:

(1) "Agency Protest Official" means the official, other than the contracting officer, designated to review and decide procurement protests filed with a contracting activity of the Department of Justice.

(2) "Deciding Official" means the person chosen by the protestor to decide the agency protest; it may be either the

Contracting Officer or the Agency Protest Official.

(3) "Interested Party" means an actual or prospective offeror whose direct economic interest would be affected by the award of a contract or by the failure to award a contract.

(b) A protest filed directly with the Department of Justice must:

(1) Indicate that it is a protest to the agency.

(2) Be filed with the Contracting Officer.

(3) State whether the protestor chooses to have the Contracting Officer or the Agency Protest Official decide the protest. If the protestor is silent on this matter, the Contracting Officer will decide the protest.

(4) Indicate whether the protestor prefers to make an oral or written presentation of arguments in support of the protest to the deciding official.

(5) Include the information required by FAR 33.103(d)(2):

(i) Name, address, facsimile number and telephone number of the protestor.

(ii) Solicitation or contract number.

(iii) Detailed statement of the legal and factual grounds for the protest, to include a description of resulting prejudice to the protestor.

(e) The deciding official must conduct a scheduling conference with the protestor within five (5) days after the protest is filed. The scheduling conference will establish deadlines for oral or written arguments in support of the

agency protest and for agency officials to present information in response to the protest issues. The deciding official may hear oral arguments in support of the agency protest at the same time as the scheduling conference, depending on availability of the necessary parties.

(g) The protestor has only one opportunity to support or explain the substance of its protest. Department of Justice procedures do not provide for any discovery. The deciding official may request additional information from either the agency or the protestor. The deciding official will resolve the protest through informal presentations or meetings to the maximum extent practicable.

(h) An interested party may represent itself or be represented by legal counsel. The Department of Justice will not reimburse the protester for any legal fees related to the agency protest.

(i) The Department of Justice will stay award or suspend contract performance in accordance with FAR 33.103(f). The stay or suspension, unless over-ridden, remains in effect until the protest is decided, dismissed, or withdrawn.

(j) The deciding official will make a best effort to issue a decision on the protest within twenty (20) days after the filing date. The decision may be oral or written.

PART III: PROVISIONS

52.212-1, Instructions to Offerors - Commercial Items (FEB 2012);

52.212-2, Evaluation - Commercial Items (OCT 2014), significant evaluation factors are past performance, delivery, technical factors and price. Past performance and technical factors are significantly more important than price.

Technical evaluation will be evaluated as a "go" / "no go" evaluation based on the specifications listed in sections

B, unless the vendor receives a waiver approved by the Contracting Officer. Vendors are required to provide their best manufacturing/delivery time for evaluation, and delivery schedule will be established at time of award. Quality and customer service will be evaluated under past performance. The Government may make award without discussions;

therefore, the offeror's initial offer should contain their best pricing. Award will be based on the best value to the Government considering the evaluation factors listed above. Best value may be determined using tradeoffs among the evaluation factors, so that award may be made to other than the lowest-priced or highest technically-rated proposal. Please note that all offers which fail to furnish required representations and certifications or past performance information or reject the terms and conditions of the solicitation may be excluded from consideration for award;

52.214-20 Bid Samples (APR 2002)

(a) "Bid sample" means a product sample required to be submitted by a bidder to show those characteristics of the offered products that cannot adequately be described by specifications, purchase descriptions, or the invitation for bid (e.g., balance, facility of use, or pattern).

(b) Bidders must furnish bid samples as part of the bid. The Government must receive the bid samples by the time specified in the invitation for bids. If the bidder fails to submit samples on time, the Government will reject the bid, except that the Contracting Officer will consider a late sample sent by mail under the Late Submissions, Modifications, and Withdrawals of Bids provision of this solicitation.

(c) The Government will test or evaluate bid samples to determine compliance with all the characteristics listed for examination in this solicitation. The Government will reject the bid when the sample fails to conform to the required characteristics. Products delivered under any resulting contract must conform to-

(1) The approved sample for the characteristics listed for test or evaluation; and

(2) The specifications for all other characteristics.

(d) Unless otherwise specified in the solicitation, bid samples shall be-

(1) Submitted at no expense to the Government; and

(2) Returned at the bidder's request and expense, unless they are destroyed during pre-award testing.

Alternate I (May 2002):

(e) At the discretion of the Contracting Officer, the requirement for furnishing bid samples may be waived for a bidder if-

(1) The bid states that the offered product is the same as a Boots/Shoes offerered by the bidder on the last contract.

(2) The Contracting Officer determines that the previously offered product was accepted or tested and found to comply with specification and other requirements for technical acceptability conforming in every material respect with those in this solicitation.
