Background and Purpose:
The United States of America (USA), acting by and through the United States Department of Agriculture, Forest Service (USDA-FS), and Stimson Lumber Company/Stimson Washington Inc. (SLC) are engaged in a land for land exchange proposal wherein SLC has offered some of its land holdings for lands offered by, and in the possession of, the USA. The USDA-FS has authority to pursue this proposed exchange using a ‘Dual Authority Exchange’ which incorporates the authorities granted to it under the Weeks Act of 1911 (16 U.S.C. 516) and the General Exchange Act of 1922 (16 U.S.C. 485, 486).
The Land Description Verification (LDV) and narrative report is required, per USDA-FS policy, to be completed by a Land Surveyor for the purpose of providing for a complete and accurate legal description of all the lands being offered for exchange by each of the parties and to review all title documents and the Preliminary Title Commitments excepted documents for patent and latent defects or ambiguities or any other items affecting title to, or boundaries of, all lands acquired or conveyed by the USDA-FS. This LDV and narrative report includes only those Non-Federal lands offered for exchange and currently held by SLC. A separate LDV and narrative report has been completed which includes all Federal lands proposed for exchange by USDA-FS.
The Non-Federal lands offered for exchange are located within Stevens and Pend Oreille Counties in northeastern portion of the State of Washington. These lands are comprised of 160 unique parcels narrowed by Township, Range, Section, and Tax Lot and are located within the 27 townships and the several jurisdictional boundaries identified on the cover page of this report. The pattern of ownership within the project area is intermingled private, State, and Federal ownership configured largely as a result of the Railroad land grants, homestead and cash entries and the many reacquisitions made by the USA starting in the 1930’s by the Resettlement Administration and the Farm Security Administration pursuant to the Northeast Washington Scattered Settlers Project, and later by the USDA-FS and United States Department of Interior, Fish and Wildlife Service (FWS) through their respective purchase and exchange authorities.
LDV Deliverables:
Considering the large scale of this proposed land for land exchange and in the interest of reducing redundancy in reporting the information relevant to the subject lands offered for exchange, this report incorporates by reference the following items delivered in conjunction with this report and which are available within the electronic LDV casefile, these include the following:
This LDV and narrative report including appendixes;
The LDV and narrative report for Federal lands offered for exchange including appendixes;
The recommended legal description for the conveyance of the Non-Federal lands offered for exchange;
The recommended legal description for all the Federal lands offered for exchange with four additional recommended legal descriptions for:
o (1) The conveyance of Federal lands under the General Exchange Act authority by
Quit Claim Deed issued by the United States Department of Interior (USDOI), Bureau of Land Management (BLM);
o (2) The conveyance of Federal lands under the Weeks Act authority by Quit Claim Deed issued by the USDA-FS;
o (3) The conveyance of Federal lands by original patent issued by the BLM;
o (4) The Federal Register Notice to withdraw the Federal lands offered for exchange from the Executive Order (EO) 7693, should one be required;
The recommended legal description for those Non-Federal lands offered for exchange located within Little Pend Oreille National Wildlife Refuge which will become parts thereof following acquisition by the USDA-FS pursuant to EO 8104;
Electronic mapping products created and used for the maps provided in the attached Appendix A through C in the formats common to most Geographic Information Systems (GIS), these mapping products include:
o Polygons for Federal and Non-Federal lands offered for exchange o Lines for National Forest boundary lines removed and created o Polygons for Outstanding Rights Appurtenant to or Encumbering the subject lands (mineral rights, easements, etc, of record) Spreadsheets for each of the Federal and Non-Federal parcels with detailed information applicable to each parcel obtained during this review, including all information provided in the attached Appendix A through C and incorporating all exceptions and excepted documents contained within the two Preliminary Title Commitments reviewed;
The USDA-FS right of way access database for the Colville National Forest including a new field indicating the approximately 890 entries mapped during this review and updated using information gathered from other sources, including copies of the original easements obtained;
Electronic copies of record information relevant to the subject lands offered for exchange, including:
o The Preliminary Title Commitment numbered 136323, as provided by Stewart Title Guaranty Company with an effective date of February 4, 2021, and the Preliminary Title Commitment numbered 49001, as provided by Pend Oreille Title & Escrow with an effective date of June 22, 2021 including notes and comments entered thereon related to the encumbrance evaluation, exceptions mapped, errors and omissions with suggested corrections, and of any noted problematic clauses in excepted documents which may require curative actions.
o The approximately 500 title documents recorded at the County Auditor’s Offices, identified by Auditors File Numbers (AFN), sorted by township and range and including notes and comments thereon including the documents affect on the title of the lands offered for exchange, and any problematic clauses or language contained therein which may require curative actions;
o The relevant BLM status records and original patents issued for the Non-Federal lands offered for exchange.
o The relevant water right claim documents associated with the subject lands.
o Additional survey records, historical records, statutes, executive orders, and treaty documents compiled from various public sources.
Parcel Identifiers:
The Non-Federal lands offered for exchange comprise 163 individual parcels including three parcels omitted in this report and intentionally deleted by agreement of the parties prior to this beginning of this review, leaving 160 parcels. Each of these parcels are contain a single section of land or a portion thereof being further subdivided, as needed, in a manner consistent with the ownership history, county tax lot configuration and their respective vesting deed legal descriptions.
Appendix A of this report details each of the individual parcels unique identifiers including:
The parcel identification number produced by the Forest Service and used in the request for this LDV;
The parcel identification number produced by the Title Companies for the parcel;
The County of jurisdiction over each parcel and their parcel identification number;
The State of Washington Geographic identification number for each parcel;
The individual Legal Description for each parcel including the Township, Range, Section and the parcels’ aliquot part(s), mineral claim name, or the unique parcel description for the several non-conforming legal descriptions; and, The parcels official area as determined in this review;
o Areas are further assigned to specific jurisdictional boundaries and where several jurisdictions are present within a Township the areas assignments are provided in a separate table.
Legal Descriptions:
The Non-Federal lands offered for exchange have been combined into a singular legal description recommended to be used for the purposes of appraisal and for the conveyance by Warranty Deed to the USDA-FS. Additionally, the Appendix A of this report provides an individual legal description for each parcel.
Appendix B of this report provides the Auditor’s File Number (AFN) refence for all the chain of title and vesting documents which were reviewed to verify the recommended legal description for each parcel is consistent with the historical record. Further, the legal descriptions provided in the aforementioned Preliminary Title Commitments were reviewed for the same consistencies and errors have been reported for corrections in a future supplement.
The recommended legal descriptions are consistent with the historical record and will convey the lands intended by the parties. Those several parcels and parcel exceptions which are non-conforming to the Public Land Survey System (PLSS) are provided in numbered list format and are reported in consistent style, each providing the essential descriptive information along with the direct reference to an appropriate vesting document with language appropriate for the intended application of said vesting document. These non-conforming descriptions are, for all purposes, consistent with the vesting documents and the addition of reference recital is a common practice utilized for the purpose of ensuring all the lands relevant to the parcel and vested in the Grantor will be conveyed to the Grantee.
Areas:
The total area of the Non-Federal lands offered for exchange is reported at several levels of detail. The official areas for each parcel and the allocation of said areas are filtered down to the several jurisdictional boundaries. All of this information is provided in the Appendix A of this report. In summary, the areas of the Non-Federal lands offered are as follows:

Surveying and National Forest Boundary Adjustments:
The cumulative National Forest boundary adjustments that will result from this proposed land for land exchange is a reduction of 190.5 miles of National Forest boundary line resulting from the elimination of 263.75 miles of existing boundary line and the addition of
73.25 miles of new boundary line. This great reduction is primarily influenced by the large number of inholding parcels which are currently nearly or completely surrounded by existing National Forest System Lands (NFSL).
Land surveys are not necessary in advance of the proposed exchange and following the exchange the Colville National Forest, though its Land Surveyor, should review the provided GIS lines depicting the removed and created boundary lines and prioritize the survey of new boundaries and signage removal on eliminated boundary. Prioritization of higher risk boundaries nearest to developed lands is recommended over those adjacent to industrial lands and over the removal of signage along eliminated boundaries.
Originating Title Documents and Chain of Title:
The subject parcels are a portion of the lands originally ceded to the United States of America (USA) in 1887 by “Agreement with the Pend D’Oreille or Calispel Indians” and “Agreement with the Coeur D’Alene Indians”.
The USA later granted these lands into private ownership by the issuance of Serial Patents, Railroad Land Grants, Patent Certificates, and Miscellaneous Volume Patents as identified in the Appendix B of this report. Many of these patent documents contained reservations to the USA, any such reservations are vested in the USA and will merge with the fee lands upon reacquisition by the USA.
Additional chain of title documents are identified in said Appendix B by their AFN recording references. Each parcels vesting deed, the deed which has vested SLC in the parcel, is identified along with any other deeds identified to be within the parcels chain of title.
Additionally, all deeds conveying or reserving the mineral estate, or some right associated with the lands mineral interests, are identified. Copies of each document listed were reviewed for consistency in description and for reservations or easement interests stemming from them, these review copies with notes are provided in the electronic LDV casefile.
Mineral Estate:
All but 22 parcels of the Non-Federal lands offered for exchange are in some way affected by historical reservations and conveyances of some portion of the mineral estate. These rights are as identified in the mineral deeds identified on the Appendix B of this report and include documents reuniting the mineral estate where found. The scope of this LDV is to identify the applicable documents and rights associated and to ascertain if adjustments to the legal description are required to account for them. Because of the variety of interests left outstanding the recommended legal description does not address these rights and they should instead be addressed in the ‘subject to’ portion of the deed as is common practice. Attention is drawn to the mineral potential report and other related documents being compiled in conjunction with this proposed land for land exchange, and separate from this LDV, which address these outstanding rights and their potential effect on the future management of the remaining estate following reacquisition by the USA.
Improvements, Occupations, and Encroachments:
The proposed land for land exchange will largely result in the reduction of private inholdings, creating more contagious areas of NFSL and thereby reducing the risk for encroachment, timber trespass and a reduction in administration of access rights currently needed for ingress and egress to said inholdings. Historical improvements identified in the original GLO surveys and consisting primarily of homestead cabins were identified and submitted to the Forest Service for the purposes of field inspection and reporting back has indicated none of these historical improvements remain standing.
A virtual inspection using the most recent and historical aerial imagery of the Non-Federal lands offered for exchange which identified several borrow pits, numerous utility transmission lines, networks of private logging roads, and a communication site located in the NE1/4NE1/4 of section 21, T.34N., R.42E., W.M. No improvements which may constitute a claim of ownership were observed. Further attention is drawn to the Certificate of Inspection and Possession for a more complete analysis of improvements and occupations of the Non-Federal lands offered.
Preliminary Title Commitment Review & Encumbrances:
The Preliminary Title Commitment numbered 136323, as provided by Stewart Title Guaranty Company with an effective date of February 4, 2021, and the Preliminary Title Commitment numbered 49001, as provided by Pend Oreille Title & Escrow with an effective date of June 22, 2021, were reviewed and notes comments entered directly thereon related to the encumbrance evaluation, exceptions mapped, errors and omissions with suggested corrections, and of any noted problematic clauses in excepted documents which may require curative actions.
The Appendix B & Appendix C of this report is used to assign the special exceptions from the title reports to the applicable parcel(s). Each exception is identified on the Appendixes using the following format: the abbreviation ‘SE’ followed by the exception number and the AFN recording reference. For example, “SE38-8904729” entered for parcel number 12 is special exception number 38 on the Stevens county Preliminary Title Commitment and the excepted document is AFN 8904729. For applicable documents not identified in the special exceptions only the AFN recording reference is provided. Should future supplements to these title commitments be issued to incorporate some of the non-excepted documents identified the LDV comments of each document are provided on the review copy located in the electronic LDV casefile. These non-excepted documents were reviewed in the same manner as those identified as exceptions and the notes entered on said review copies should suffice for the LDV review without requiring an update to the LDV narrative report.
Access Roads, Appurtenant Interests and Permits:
The Appendix C of this LDV narrative identifies all easements and other similar documents reviewed and assigns them to the parcel(s) for which the rights benefit or affect. This includes all those documents identified as special exceptions in the Preliminary Title Commitments. Additionally, the USDA-FS right-of-way atlases and separate access database were cross-referenced and all applicable easement segments were incorporated into said Appendix C. All those encumbrance and appurtenant interests which could be mapped were and are provided in above referenced GIS deliverables and as shown on the maps provided with the said Appendix C.
The access database was also updated to include a field indicating which easement segments were mapped along with updates in other fields where additional or conflicting information was located for the segment during this review. In total 929 features are included in the GIS dataset, each representing an interest or right held by the USA or another party and within the project area, including both the Federal and Non-Federal lands offered for exchange and other lands in the vicinity of the same.
Attention is drawn to the above-described Preliminary Title Commitment review provided with this report for detailed information about which exceptions were mapped and which documents were identified as containing language that may require curative action, administrative waiver or were unacceptable.
Water Rights:
Water Rights located and determined to be associated with the Non-Federal lands offered for exchange are provided on the Appendix C of this report. Copies of each of these documents are provided in the Electronic LDV casefile.
Zoning:
The Non-Federal lands offered for exchange are largely zoned under Land Use Code 88- Designated forest land under chapter 84.33 RCW. Parcels 133 and 154 are zoned under Land Use Code 91-Undeveloped land. Neither of these designations should conflict with the activities conducted on general National Forest System Lands.
