The Second Set of Questions and Answers (Qs&As) for the TMC solicitation No. STH200-14-Q-0001 Question #1: In the answer provided to question 19, you stated: “The contract award was from a commercial solicitation which is not subject to the requirements of FAR part 15.” However, looking at Subpart 12.3 "Solicitation Provisions and Contract Clauses for the Acquisition of Commercial Items" I can't see anything that would negate provisions in 15.5, could you clarify?
Answer #1: If the government elects to acquire supplies or services using commercial items procedures, and which is the preferred approach in accordance with the Federal Acquisition Streamlining Act, only the procedures and requirements as stated within FAR 12 apply and not the procedures or requirements stated in FAR Part 15, which are used for negotiated procurements and solicitations which are identified as Request for Proposals and follow the Uniform Contract Format (UCF). Again, the current contract was awarded using commercial items procedures and requirements and hence only FAR part 12 was/is applicable.
