About this file
This is a Statement of Work (SOW) for arbitration services between the United States Patent and Trademark Office (USPTO) and Arbitrator Frederick R. Ward to resolve labor relations disputes under the NTEU 245 Collective Bargaining Agreement (CBA). The specific matter involves an institutional grievance regarding the USPTO's decision to increase the number of potential annual employee paid trips under policies implementing the Telework Enhancement Act of 2010 (TEAP). The arbitrator will review complaints and related file materials, conduct legal research, write decisions, attend and hear arguments, hold scheduling conferences, and issue pre-arbitration decisions as needed.
The contract pricing for CLIN 0001 includes six days for review, complaint analysis, and decision writing at $1,600 per day ($9,600); one day for attending and hearing arguments/holding scheduling conferences at $1,600 ($1,600); and one day for pre-arbitration decisions at $1,600 ($1,600), totaling $12,800. Per the CBA, the parties split the total arbitration cost equally, resulting in a USPTO cost of $6,400. The period of performance begins upon order issuance and continues for approximately twelve months with four optional twelve-month extensions. The estimated arbitration hearing date for NTEU 245 is June 16, 2026 (subject to change). All arbitrations are conducted virtually per CBA terms. Cancellation or postponement within 15 days of brief submission deadlines results in a $1,600 fee, though mutual postponement, delay, cancellation, or settlement require equal cost sharing between parties. The SOW allows modification to add arbitrations for POPA and NTEU243. The Contracting Officer retains sole authority for contract changes.

Background
The mission of the United States Patent and Trademark Office (USPTO) is to foster innovation and competitiveness by providing high quality and timely examination of patent and trademark applications, guiding domestic and international intellectual property policy, and delivering intellectual property information and education worldwide. The Office of General Counsel (OGC) and Office of General Law (OGL) supports the mission of the Agency.
To accomplish this mission, the Agency must hold hearings, hear appeals, and make decisions on a host of patent-related matters and non-patent related matters. The handling of these matters must be documented.
The Office of General Counsel (OGC) is responsible for overall management of the division and acts as the Under Secretary and Director’s principal legal advisor in assuring the provision of legal advice and representation for the agency. OGC is also the delegated authority to hear appeals from decisions in enrollment and discipline matters, and to determine whether special circumstances exist pursuant to 35 U.S.C. § 122 for releasing information concerning patent applications.
The Office of General Law (OGL) provides general litigation and advisory services on matters concerning the administration and management of the USPTO. The OGL also represents USPTO in various administrative proceedings, including arbitration hearings addressing alleged contractual violations and disciplinary matters arising under the USPTO’s various Collective Bargaining Agreements (CBA) with those unions representing the agency’s bargaining unit employees.
