Technical Requirements
Certain experienced, professional and/or technical personnel are essential to the successful accomplishment of the work performed under this BPA. These positions are identified as “Key Personnel”.
These Key Personnel shall not be removed from the BPA without compliance with the following:
If one or more Key Personnel a.) becomes, or is expected to become, unavailable to work under this BPA for a continuous period exceeding 30 workdays or, b.) is expected to devote substantially less effort to the BPA than indicated in the proposal or initially anticipated, the Contractor shall, subject to the concurrence of the Contracting Officer and Contracting Officer’s Representative, promptly replace Key Personnel with personnel of equal ability, experience and qualifications.
All requests for approval of substitutions must be in writing and provide a detailed explanation of the circumstances necessitating the proposed substitution(s). Written requests must be made at least 30 days in advance to the Contracting Officer and Contracting Officer’s Representative.
The request must contain a resume for the proposed substitute, and any other information requested by the Contracting Officer. The Contracting Officer shall notify the Contractor of approval or disapproval of the substitution in writing. If the Contracting Officer determines that the Contractor has not provided suitable and timely replacement of Key Personnel for the BPA work or that the resultant reduction of productive effort would be so substantial as to impair successful completion of the BPA, the Contracting Officer may terminate the BPA for default or for the convenience of the Government. Also, the Contracting Officer may, as appropriate, make an equitable adjustment to the BPA to compensate the Government for any resultant delay, loss or damage.
Since several safety courses may be scheduled at the same time or at different geographical locations the Contractor must identify the proposed personnel for each course. The Contractor must provide in their proposal contingency plans demonstrating that equally qualified back-up instructors are available in instances when primary instructors are not available. This is to ensure that there is no disruption to the course schedule(s) or quality of training delivered.
Only qualified personnel with adequate and verifiable experience in a complex biomedical or laboratory research-based setting, in the required areas of specialization shall be assigned to this BPA. Experience conducting assessments according to United States Pharmacopeia standards is preferred.
