About this file

This is a Sole Source Justification form submitted by the Colorado Bureau of Investigation (CBI) for continued support and maintenance services of the STACS DNA laboratory information management system software application from STACS DNA Inc., d.b.a. InVita Healthcare Technologies. The CBI's DNA Database laboratory is statutorily required under Colorado Revised Statutes to obtain, analyze, compare, and preserve biological substance samples from persons convicted of felonies as well as those arrested and charged with felonies. The STACS DNA application manages all biographical and genetic information for these database samples, including consumables and equipment used during processing. The requested contract period runs from July 1, 2026, through June 30, 2027, covering annual support and maintenance services for the existing software system already installed on servers managed by the Office of Information Technology.

The estimated total cost for the procurement is $96,988.05, with $96,988.05 allocated to services. CBI has procured goods and services from this vendor within the past two years through yearly support and maintenance contracts, with periodic software feature requests purchased as needed. The justification for sole source procurement emphasizes that forensic DNA analysis is highly specialized and subject to strict quality assurance standards established by the FBI Director under the DNA Identification Act of 1994 to ensure results are admissible in court and eligible for entry into the National DNA database. Federal funding for forensic DNA analysis is contingent upon meeting these standards. STACS DNA is identified as the sole manufacturer and owner of the STACS Database intellectual property, with no resellers, subcontractors, or other entities authorized to modify the software or provide equivalent support services. Transitioning to an alternative vendor would require purchasing an entirely new software package rather than continuing with upgrades to the current system.

The Colorado Bureau of Investigation DNA Database laboratory is required by state statutes C.R.S 16 23 103,19 2 925.6 and 16 11 102.4 to obtain, analyze, compare and preserve biological substance samples from persons convicted of a felony as well as persons arrested and charged with a felony. To fulfill these statutory obligations as efficiently as possible, the STACS DNA laboratory information management system software application is used by the Colorado Bureau of Investigation database analysts. This laboratory management system allows for automated management of all biographical and genetic information of these database samples, including all consumables and equipment used during processing.

Only the support and maintenance of the application manufactured and marketed by STACS will work with our current STACS software system. Going with another vendor's software would add a significant cost as we would have to purchase from the beginning (not simply the upgrades, but we would have to purchase a whole new software package).

. Is there any additional information that you’d like to provide in order for this request to be considered?

The Colorado Bureau of Investigation Laboratory seeks sole source authorization for the following services to be obtained from STACS DNA. This authorization would cover the support and maintenance of the application that serves as the DNA database laboratory information management system (STACS DNA).

DNA database analysis is an extremely specialized field, and strict standards must be adhered to for our results to be acceptable in court and for entry into the National DNA database. In addition, federal funding for forensic DNA analysis is contingent upon meeting these standards. The DNA Identification Act of 1994 authorized the FBI Director to develop and create quality assurance standards for forensic DNA laboratories. In October 1998, the FBI Director issued Quality Assurance Standards (QAS) for Forensic DNA

CBI would select a vendor who could maintain the application with updates and assure support for the STACSDNA application. I believe that InVita STACSDNA is the only company who can provide that and safeguard the data.

The software application is currently installed on servers that are managed by OIT. Support for the application is included with our annual maintenance contract with STACS DNA. No additional maintenance or support will be needed from OIT.
