CLASS JUSTIFICATION AND APPROVAL (CJ&A)

FOR USE OF OTHER THAN FULL AND OPEN COMPETITION

1. Contracting Activity. Department of the Navy’s Strategic Systems Programs Office (SSP) located at the Washington Navy Yard, 1250 10th Street SE, Washington, D.C. 20374.

2. Description of Action Being Approved. This Class Justification and Approval (CJ&A) is for the award of multiple contracts on a sole-source basis for the procurement of the SSP development, production, sustainment, modernization, repair, installation, and technical engineering services in support of United States (U.S.) and United Kingdom (UK), Strategic

Weapons System (SWS), U.S. Attack Weapon Control System (AWCS), development and production of U.S. COLUMBIA and UK Dreadnought Class SSBNs (Ballistic Missile

Submarines), Common Missile Compartment (CMC), SWS common infrastructure, and development of the SWS in support of the 2nd Life Extension of the Navy’s D5 TRIDENT II

(D5LE2), Mk7, and Nuclear Reentry System (NRS) for the Fire Control Subsystem. The contractor is General Dynamics Mission Systems (GDMS). The authority to act under this class justification expires on 31 December 2027.

3. Description of Supplies/Services. GDMS will be required, as the prime contractor, to manage the overarching program and system requirements of the SWS Fire Control subsystem. This

CJ&A covers the following anticipated contracts:

a. FY24 – FY27 Fire Control Omnibus Contract: The period of performance will begin on

01 October 2023 and will continue through 31 December 2030 with a total contract value of $494.8M. The FY24 – FY27 Fire Control Omnibus Contract will include

Development, Production, Installation, Operational and Sustainment (O&S) Support, Repair & Return effort, and training development for the U.S. SSBN, UK SSBN, and

SSGN fleets as well as the overall SWS. This effort will also include development of

Fire Control System (FCS) software, Shipboard Modernization efforts, development of

D5LE2, Mk7, and NRS FCS capabilities, Technical engineering services, development, production, and installation of U.S. COLUMBIA and UK Dreadnought FCS, CMC, and common infrastructure components, Development, Production, Installation and O&S

Support of the Trident Training Facilities (TTF) and the Attack Weapon Training System

(ATCS), Technical and Engineering support including performance evaluation, logistics, fleet documentation, training reliability maintenance and hardware/software engineering services for the deployed fleet. The contract will consist of one, 12-month base period plus three, 12-month option periods.

b. FY25 Basic Ordering Agreement (BOA) and all Orders: The ordering period will begin on 18 December 2024 and will continue through 17 December 2027 with a ceiling of

$53.9M. The FY25 BOA orders will procure emergent spares and support equipment, deployed systems support for engineering requirements changes, delivery of Strategic

Systems Programs Alterations (SPALTs) and Alterations to support emerging capability insertions, support for emergent research and development, maintenance operational refresh, and redesign and production, support for U.S. SSBN, UK SSBN, COLUMBIA

Class, Dreadnought, SSGN, and D5LE2 development and production efforts.

c. FY26 – FY27 Fire Control Omnibus: The period of performance will begin on 01

October 2025 and will continue through 30 December 2032 with a total contract value of

$523.8M. The FY26 – FY27 Fire Control Omnibus contract will include continuation of

Development efforts, Production of CMC components of additional Hulls, Increments, and Equipment Refresh, installation, O&S Support, Repair & Return effort, and training development support for U.S. SSBN, UK SSBN, SSGN fleet and the overall SWS.

Effort will also include ongoing and continuing development and production of FCS software, CMC, Shipboard Modernization efforts, common infrastructure, continued development efforts in support of D5LE2, Mk7 and NRS FCS capabilities, technical engineering services, development, production, and installation of U.S. COLUMBIA and

UK Dreadnought FCS and common infrastructure components, development, production, installation and O&S support of the TTF and technical and engineering support including performance evaluation, logistics, fleet documentation, training reliability maintenance and hardware/software engineering services for the deployed fleet. The contract will consist of one, 12-month base period plus one, 12-month option period.

Note: The contracts will each include contact text permitting an increase of not to exceed 30 percent of the total contract value to accommodate for additional emergent or unplanned requirements. This increase of not to exceed 30 percent of the total contract value is not accounted for in the above table.

All values set forth above are conditional upon Congressional authorization and appropriation of funds.

4. Statutory Authority Permitting Other Than Full and Open Competition. 10 U.S.C. 3204(a)(1), only one responsible source and no supplies or services will satisfy agency requirements.

5. Rationale Justifying use of Cited Authority.

a. The contracts will be for efforts related solely to the SSBN TRIDENT II (D5) SWS FCS and the CMC Development and Production of COLUMBIA platform that is predicated on the TRIDENT II (D5) SWS FCS, and the AWCS, of which GDMS has had the responsibility as the prime contractor for the design, development, production, installation, and documentation for these supplies and services with the Government.

Due to the technical complexity of the programs and systems, a thorough knowledge of the design, production, and assembly is essential so that the various categories of work described within the contracts are performed in a timely and cost efficient manner. The

FY24 – FY27 Fire Control Omnibus contract will be a follow-on contract to the FY20

Fire Control Omnibus Contract, Contract No.: N0003020C0005, the FY22 Fire Control

Omnibus Contract, Contract No.: N0003022C1005, and the FY22 Fire Control

Production Contract, Contract No.: N0003022C1005. The FY25 BOA will be a follow-on agreement to the FY22 BOA, BOA No.: N0003022G1038, while the FY26 – FY27

Fire Control Omnibus Contract will be a follow-on to the FY24 Fire Control Omnibus

Contract. Each of the identified contracts and agreement were awarded using other than full and open competition, as were their predecessor contracts.

b. GDMS solely possesses the unique knowledge, skillsets, and technical expertise regarding the FCS, AWCS, and the overarching SWS. These specialized skills and depth of experience held by GDMS make it uniquely qualified to develop, produce, sustain, and repair the specialized components of the FCS, AWCS, and effect unique repairs of the

SWS. The Pittsfield facility operated by GDMS has been the location of the prime contractor for the TRIDENT II (D5) SWS and AWCS Systems for over 50 years.

GDMS-Pittsfield possesses the facilities, advanced development labs, detailed knowledge of the Equipment Technical Data Packages and SSP Requirements Documents needed for performance under the contract, including intimate knowledge of existing design elements pertaining to nuclear safety. No other source has this level of capabilities, comprehensive knowledge of the SWS, proficiency and experience in support of the FCS, AWCS, and overarching SWS, in support of the SSP strategic mission. Therefore, GDMS is the only source capable of fulfilling the Government’s requirements without causing unacceptable program delays and substantial increases in costs.

c. Analysis conducted by the Government shows competing these efforts would result in substantial, unrecoverable duplication of cost estimated at ~$266.9M. To quantify those costs, the SSP Fire Control Technical Branch determined the expertise and infrastructure needed to perform the work required by using contractual/work history for TRIDENT I and TRIDENT II. In more detail, the alternate source would be required to develop and duplicate all Advanced Development Labs and Engineering Test Systems required for both U.S. and UK specific labs (~$110.2M), Train and Certify the new workforce

(~$54.7M), Development, production, and delivery of specialized tooling, test equipment qualifying of design, generation of refinement and production processes through the production of qualified models, test and examinations (~$44.3M), and the modification, update, and implementation of all pertinent documentation for the alternate workforce, to include process requirements, specifications, methodology, and Fleet Documentation

(~$57.7M). It is not reasonable to expect these costs to be recovered through the competitive process.

d. If selected, another contractor would cause detrimental delays in the readiness of the

Fleet. Based on meeting the development, modification, and transition requirements above, it is estimated a minimum of two to three years would be required to qualify and transition to a newly contracted source. Furthermore, during a transition period, the

Government would incur additional costs as a result of maintaining and resourcing duplicative organizations while qualifying an alternate source. Any delay in qualifying another contractor would directly impact the ability to successfully sustain capabilities across the existing fleet and further delay ongoing development, production and installation of capabilities which would adversely affect Fleet readiness, capabilities, and national security. Currently, there is no other source capable of meeting these requirements without significant impacts to the continued support and sustainment of the current SWS and AWCS fleet and a significant and detrimental impact to the

COLUMBIA and Dreadnought delivery schedules.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.

a. A sources sought notice, Sources Sought Notice No.: N00030-24-R-1005, was posted to the System for Award Management (SAM) website for all requirements covered under this CJ&A on 28 September 2022. SSP did not receive any responses to the sources sought notice. Additionally, a pre-solicitation synopsis was posted on the SAM website in accordance with Federal Acquisition Regulation (FAR) 5.201 on 23 February 2023, providing vendors with the opportunity to demonstrate their capability to meet the requirements, and no responses were received.

b. In accordance with FAR 16.703(d)(2)(iv), the contracting officer will also post a synopsis on the SAM for each order, evaluate any offers received prior to contract award, and refer any interested parties to GDMS’s subcontracting managers for possible subcontracting opportunities. In addition, market research will be conducted for each anticipated order to determine if alternate sources exist to satisfy the requirements. The market research process involves conducting internet searches using common internet search engines and government sources, and contacting government and industry sources for information related to the proposed requirement. The extent and results will vary for each BOA order.

However, SSP will only execute orders on the BOA after determining GDMS is the only responsible source for satisfying the requirements.

c. Other strategic market research efforts have been ongoing, to include continuous market research, monitoring relevant Department of Defense activities, government labs and survey reports conducted by NSWCs to maintain an understanding of developments and capabilities within the industry. At this time, the strategic market research affirms, that it is not practical, for the reasons discussed in paragraph 5 above, for any company other than GDMS to provide the required services and supplies in the outlined contracts, given the complexity and technically specialized nature of the efforts being procured in this highly specialized and unique SWS requirements.

7. Determination of Fair and Reasonable Cost. The Contracting Officer has determined the anticipated cost to the Government of the supplies and services covered by this CJ&A will be fair and reasonable.

8. Actions to Remove Barriers to Future Competition. For the reasons set forth in Section 5, SSP has no plans at this time to compete future contacts for the types of supplies/services covered by this CJ&A. If another potential source were to emerge, as discovered through the continual tactical and strategic market research processes, sources sought notices, and synopses, SSP will assess whether competition for future requirements is feasible. Additionally, the prime contractor for this effort will continue to utilize competition amongst suppliers and commercial item procurements where feasible for fulfilment of component parts. It is noted that the current design and production work will be conducted in a way that does not preclude a company from participation in downstream design, manufacturing, or construction efforts. Because these are follow-on contracts for supplies and services previously awarded on non-competitive bases, in accordance with DFARS PGI 206.304(a)(S-70)(i), the prior J&As were provided to the approval authority for review. Approval of this CJ&A signifies the approval authority has made the determination required by DFARS PGI 206.304(a)(S-70)(ii).
