About this file

This document is a Justification and Approval for Other Than Full and Open Competition for the acquisition of Dedicated Internet services for the U.S. Consulate General in Hermosillo, Mexico.

The U.S. Consulate seeks to contract dedicated Internet services for its OpenNet network at the New Consulate Compound (NCC) for the period of 10/01/2024 through 09/30/2025 at an estimated cost of $27,840.00. The justification cites 41 U.S.C. 253 (c)(1), the statutory authority allowing other than full and open competition, as TOTALPLAY is the only ISP with the necessary proprietary infrastructure to provide full redundancy. TOTALPLAY has provided superior service and responsiveness over the years, making them the preferred vendor over other options like TELMEX and MetroCarrier. The Contracting Officer has determined the anticipated cost will be fair and reasonable based on market analysis and previous purchase orders. The notice of intent for this sole-source requirement has been posted, but no other vendors have expressed interest in writing.

JUSTIFICATION AND APPROVAL FOR OTHER THAN FULL AND OPEN COMPETITION

(OVERSEAS CONTRACTING ACTIVITIES)

1. I recommend that U.S. Consulate General Hermosillo use other than full and open competition for the acquisition of Dedicated Internet services for its OpenNet Network at the New Consulate Compound

(NCC). The estimated cost is $27,840.00 USD.

2. Nature and/or description of the action being approved.

The U.S. Consulate General in Hermosillo seeks to contract dedicated Internet services for its OpenNet operations, for the period of 10/01/2024 through 09/30/2025.

3. Description of the services required to meet US Consulate Hermosillo needs.

The US Consulate General requires reliable dedicated Internet services for NCC’s OpenNet Network that can be provided by an ISP different than the one providing Secondary OpenNet circuit.

4. Identification of the statutory authority permitting other than full and open competition:

Only One Responsible Source (FAR 6.302-1)

Citation: 41 U.S.C. 253 (c)(1).

5. Demonstration of contractor’s unique qualifications.

TOTALPLAY is the only ISP with proprietary infrastructure that will provide full redundancy in

Internet services for our planned range of circuit vendors. Over the years TOTALPLAY has always responded to our inquiries on time, technical support is provided immediately as requested, extraordinary or unplanned requests are addressed in short time, whenever there is construction required or need to replace equipment that might result in system downtime, TOTALPLAY representatives and technical crew are willing to closely follow our plans and adapt to our schedules and escort needs.

TOTALPLAY is also the only vendor that provides access to an on-line monitoring tool of our circuits.

On the financial side TOTALPLAY is also responsive and willing to resolve any issues in a short period of time. For these reasons and the fact TOTALPLAY representatives are easily approachable, our experience with TOTALPLAY has been highly positive, which we cannot state for other available vendors.

6. A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable.

Other available vendors in the area include MetroCarrier and TELMEX. However, TELMEX is providing the secondary OpenNet circuit at the NCC. Since we do not have other options, TELMEX also provides the Secondary OpenNet service for the current consulate building and used to provide the tail circuit for the CGR. MetroCarrier service does not meet the technical requirements. For redundancy purposes, we need to utilize multiple vendors for our services. Pricing between TOTALPLAY and

TELMEX are similar, and through experience, TOTALPLAY provides superior service, warranting their selection as the primary OpenNet circuit supplier.

7. A determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.

The provided quote by TOTALPLAY is within market limit costs. Price is consistent with purchase orders from previous years. We recently received a quote from ISP TELMEX for 60 mbps at

$29,013.00 USD. Due to its supervisor service performance, TOTALPLAY is viewed as the preferable option.

8. A description of the market survey conducted and the results or a statement of the reasons a market survey was not conducted.

TOTALPLAY has provided this service for several years at the current Consulate building and considers

Post a VIP client, which allows them to offer competitive rates, 24/7 technical support and quality of service. Notice will be sent via SAM to determine other interested vendor; the results will be included in the final approval package.

9. Any other facts supporting the use of other than full and open competition.

We have worked with TOTALPLAY in the past and customer service has always been excellent. Since this service provides connection for our main network in the current building, using the same provider at the NCC allows us to create a logical tail circuit to just switch over when the move is complete.

10. A listing of sources, if any that expressed, in writing, an interest in the acquisition.

No vendor wrote a letter to express interest.

11. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required.

Actions to enhance competition are difficult as GOM regulations make it difficult for other companies to invest in telecommunications.
