About this file
This document contains a justification for a single source award and notice of intent to sole source a federal contract. The Department of Veterans Affairs Veterans Health Administration Network Contracting Office One intends to sole source award a contract to Granger Medical for emergency correction of medical gas deficiencies at the CT HCS West Haven VAMC. Services required include emergency response to a January 2023 Joint Commission site visit, a 24-hour response plan, inspection and repair of all medical gas system components, and certification and recertification of repaired systems. An immediate response was necessary to address Joint Commission findings threatening facility accreditation. The justification cites urgent need and Granger Medical's specialized capabilities. The notice establishes a February 3, 2023 deadline for capability statements from other sources for potential future work.

Last Updated: 02/01/22 Page 1 of 2
DEPARTMENT OF VETERANS AFFAIRS
Justification for Single Source Awards IAW FAR 13.106-1 For
Over Micro-Purchase Threshold but Not Exceeding the SAT ($250K)
Acquisition Plan Action ID:
1. Contracting Activity: Department of Veterans Affairs, VISN 1 CT HCS, West Haven VAMC
NCO 1, 2237 # 689-23-2-5050-0024 Medical Gas Deficiencies Repairs
2. Brief Description of Supplies/ Services required and the intended use/Estimated Amount:
In response to the Joint Commission Visit conducted January 18 and 19, 2023 we require inspection of all components of the medical gas system, repairs to correct emergency deficiencies and certification and recertification as required of all medical gas systems repaired.
3. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used:
The NCO 1 Director of Contracting has approved this emergency under unusual and compelling authority FAR 6.302-2.
(a) Authority. (1) Citations: 10 U.S.C. 3204(a)(2) or 41 U.S.C.3304(a)(2).
(2) When the agency’s need for the supplies or services is of such an unusual and compelling urgency that the Government would be seriously injured unless the agency is permitted to limit the number of sources from which it solicits bids or proposals, full and open competition need not be provided for.
(b) Application. This authority applies in those situations where-
(1) An unusual and compelling urgency precludes full and open competition; and
(2) Delay in award of a contract would result in serious injury, financial or other, to the Government.
There is concurrent approval to use all flexibilities permitted in the FAR, including FAR 18.102(a)(1) on SAM registration. Per the Director’s discussion with the Network Director, this emergency order is needed immediately to address the Joint Commission’s findings that threaten West Haven’s accreditation.
This requirement is to report on site to the West Haven campus to perform the services outlined in the performance work statement, which include any necessary labor and materials for inspection of all components of the medical gas system in West Haven, CT. The West Haven VAMC requires the vendor to provide a report of the findings and furnish all labor and material to perform emergency repairs to correct emergency deficiencies. The vendor is also to furnish and install all labor and materials to perform certification and recertification as required for all medical gas systems https://www.acquisition.gov/?q=/browse/far/13

The certifications required to perform the necessary services limits the potential pool of contractors as well as their availability to provide services. The type of services we requested are booked in advance.
Small business, Granger Medical, performed a site visit after studying the Joint Commission report findings. A work plan was expeditiously drafted in order to immediately address these joint Commission deficiencies in order for the West Haven VAMC to remain in compliance with hospital standards and maintain accreditation.
4. Description of market research conducted and results or statement why it was not conducted:
Vet Biz, SBA dynamic search, GSA, Google, and the CO’s personal knowledge of the acquisition field revealed two SDVOSB vendors, although because this is an emergency with deficiencies needing to be addressed immediately, we are contracting with small business Granger Medical.
5. Contracting Officer's Certification: Purchase is approved in accordance with FAR13.106-1(b). I certify that the foregoing justification is accurate and complete to the best of my knowledge and belief.
