MEMORANDUM FOR RECORD

SUBJECT: Use of a Single Source below the Simplified Acquisition Threshold (SAT)

I. BACKGROUND

A. FAR 13.106-1(b)(1)(i) states for purchases not exceeding the simplified acquisition threshold, Contracting Officers may solicit from one source if the Contracting Officer determines that the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, brand-name or industrial mobilization).

B. As required by FAR 13.106-3(b)(3)(i), this memorandum explains the absence of competition for this acquisition, as only one source will be solicited for this requirement (or for a portion of the requirement) and the requirement is not expected to exceed the simplified acquisition threshold.

II. DESCRIPTION OF THE SUPPLIES/SERVICES REQUIRED

III. RATIONALE FOR SOLICITING FROM A SINGLE SOURCE OR BRAND NAME (select all that apply):

The source has established proprietary rights, limited rights in data, patent rights, copyrights or secret processes in the item or service required.

The item or service is only available from the Original Equipment Manufacturer (OEM), or there is only one authorized distributor or technical representative for the OEM.

Item required must be a brand name product, or feature of a product, particular to one manufacturer.

The supplies or services are of such unusual and compelling urgency that the Government would be seriously injured unless the agency is permitted to limit the number of sources from which it solicits bids or proposals. Urgent requirements are supplies or services that will result in a work stoppage, or are mission critical and the routine processing time would result in injury to the Government. The determination that the procurement for the above item/service is an urgent and compelling requirement is based on the following:

1. Date on which the requirement was first identified.

2. Required delivery date/period of performance.

3. Explanation of why delivery/commencement of services by the date mentioned above is required:

4. If appropriate, include any additional pertinent information.

IV. CONTRACTING OFFICER'S DETERMINATION

I have determined, in accordance with FAR 13.106-1(b)(1), that the circumstances of this contract action deem only a single source is reasonably available.

Refer to FAR 5.102(a)(6) for the requirement to post the brand-name justification or documentation.

Paragraph_II: This action for the conversion of the SkidCar system for a 2008 Ford F-350, currently in use at Malmstrom Air Force Base, into a 2014 Ford F-150 SkidCar System for continued use at Malmstrom Air Force Base. The contractor shall provide the material components and phone and technical support during installation needed to convert the current SkidCar system for use from a 2008 Ford F-350 to a 2014 Ford F-150 as described in the Statement of Work (SOW).

The total estimated value of this acquisition is $11,262.00. The funding appropriation is 3400 Operations and Maintenance.

CLIN 0001: Conversion of the SkidCar system for a 2008 Ford F-350, currently in use at Malmstrom Air Force Base, into a 2014 Ford F-150 SkidCar system for continued use at Malmstrom Air Force Base. This CLIN covers all parts needed for the conversion, as well as any technical support required during the process, in accordance with the specifications outlined in the SOW.

The period of performance will be one hundred forty (140) calender days after the date of contract award. The required completion date is 140 calender days after the date of contract award.

Approval is requested for a single fiscal year requirement. The rationale for this request is that the requirement is for a specific, one-time project with a defined scope. Additionally, per Air Force Global Strike Command Instruction 91-210, Paragraph 3.3, Skid Vehicle training will be accomplished in accordance with training received from the parent company of the SkidCar assembly.

III.A.3_Fill-in: This acquisition, for the conversion of the SkidCar system currently in use on a 2008 Ford F-350 for the 341st Missile Wing, requires the use of other than full and open competition, as authorized by DAFFARS 5313.501. SkidCar System, Inc. is the sole authorized dealer, maintenance provider, and service provider for SkidCar equipment in the United States. Additionally, per Air Force Global Strike Command Instruction 91-210, Paragraph 3.3, Skid Vehicle training will be accomplished in accordance with training received from the parent company of the SkidCar assembly, making them the only source capable of meeting the Government’s requirements.

Using a contractor other than SkidCar System, Inc. introduces unacceptable risks: an improper conversion kit will compromise functionality and safety.

This conversion and installation is essential to ensure the 341st Missile Wing can properly maintain nuclear missile systems, a critical component of the base's overall strategic mission. Therefore, utilizing the only authorized and qualified source, SkidCar Systems Inc., is the only way to ensure the Government's requirements are met without unacceptable risks.
