About this file

This document is a Sole Source/Brand Name Justification under the Simplified Acquisition Threshold (SAT) for the procurement of Techthane T-12, a proprietary polymer formulation required for use on VIRGINIA Class submarines. The justification states that Techthane T-12 is only available from the original manufacturer, SII, Inc., due to proprietary rights and limited production capacity.

The related federal contract opportunity is a combined synopsis/solicitation for a firm fixed-price purchase order to procure Techthane T-12 using simplified acquisition procedures. The solicitation number is N0016724Q0311, with a NAICS code of 325211 and a small business size standard of 1,250 employees. The Government intends to award the contract on a lowest price technically acceptable (LPTA) basis without discussions. Quotes are due by 10:00 AM EST on 10 September 2024, and the point of contact is Brittany Tavassoli.

NSWCCD Sole Source/Brand Name Justification Under SAT Rev 4 Template Effective July 2024

III. BASIS FOR DETERMINATION FOR USE OF OTHER THAN FULL & OPEN COMPETITION

A. BRAND NAME:

Item required must be a brand name product, or feature of a product, particular to one manufacturer.

1. Restrictive Rights: The source has established proprietary rights, limited rights in data, patent rights, copyrights, or secret processes in the item or service required.

2. Exclusive Licensing Agreements: The item or service is only available from the Original Equipment Manufacturer (OEM).

3. Other Reasons:

B. SOLE SOURCE (select all that apply)

1. Restrictive Rights: The source has established proprietary rights, limited rights in data, patent rights, copyrights, or secret processes in the item or service required.

Techthane T-12 (Part A and Part B) is a proprietary formulation of SII, Inc., which is specifically required by Navy drawings as the base polymer for a material used on VIRGINIA Class submarines.

NSWCCD has been tasked to perform assessment of Techthane T-12 and is limited by its availability since SII, Inc. only makes a batch of the two sides of Techthane T-12 when the shipbuilder orders it. SII, Inc. manufactures two polymers for the Navy, with the other being the bulk of the volume and orders. To make Techthane T-12 the other product must be taken off-line; therefore, SII, Inc. limits its production of Techthane T-12 to once every year or two.

2. Exclusive Licensing Agreements: The item or service is only available from the Original Equipment Manufacturer (OEM), or there is only one authorized distributor or technical representative for the OEM.

C. LIMITED SOURCE (FAR 8.405-6):

Item required must be a brand name product, or feature of a product, particular to one manufacturer.

1. Restrictive Rights: The source has established proprietary rights, limited rights in data, patent rights, copyrights, or secret processes in the item or service required.

2. Exclusive Licensing Agreements: The item or service is only available from the Original Equipment Manufacturer (OEM).

IV. CERTIFICATIONS & APPROVALS

A. Technical/Requirements Certification: I certify that the facts and representation under my cognizance, which are included in this justification, are complete and accurate to the best of my knowledge and belief.
