FEDERAL BUREAU OF INVESTIGATION
JUSTIFICATION FOR LIMITED COMPETITION/SIMPLIFIED ACQUISITION
JUSTIFICATION AND APPROVAL FOR
ACQUISITIONS UNDER THE SIMPLIFIED ACQUISITION THRESHOLD
In accordance with Federal Acquisition Regulation 13.106-1(b)(1), I hereby determine that the purchase of Instructor Services from Spyder Forensics LLC/Mr. Robert Attoe, listed on DJF-21-0700-PR-0004150 is available from only one source, and competition is precluded as there are no substitutes available.
1. This acquisition is restricted to the following sole source:

2. The instructor services in UAS Digital Forensics is estimated to cost XXX and is required to be performed by 7/26/2021.
The requested instructor lead services lead by Mr. Robert Attoe, is to provide electronics engineer-forensic examiners and Supervisory Special Agents with the latest in UAS data extraction techniques, interpretation of data, advanced analysis techniques, report writing, presentation of evidence capable of acceptance in court, and administration of a final assessment.
3. Specific characteristics of the instructor services that limit the availability to a sole source are as follows:
Through internet research, there are limited vendors that provide this service, and none that match the qualifications and pedigree of Spyder Forensics LLC. There were a few digital forensic courses found however, only a few specialize in UAS digital forensics and teach not only to perform the digital forensic work but also teach the practice. While conducting market research, there were no other vendors that could provide the needed training at our venue located on the Redstone Arsenal, and to our specific group (FBI employees) within our desired timeline noted above.

Spyder Forensics LLC is an industry leader within the digital investigations community delivering contemporaneous instruction across the globe to federal, state and local law enforcement personnel, ensuring the curriculum and delivery concepts are of the highest standards within the industry. Robert Attoe has almost 20 years of experience developing and presenting training on Digital Forensics, Cyber Security, Mobile Forensics and eDiscovery education programs for the global digital investigations community.
5. A determination by the ordering activity Contracting Officer that the order represents the best value consistent with FAR 8.404(d).
The contracting officer will determine, after considering the level of effort and the mix of skills available for the tasks needed, that the proposed order or BPA represents a reasonable total price and will be the best value for the FBI.
6. Description of product to include model number and all specifications required.
To meet the training requirements, a coordinated UAS digital forensics course should be comprised of the following:
· Extraction techniques
· Interpretation of data
· Advanced Analysis Techniques
· Report Writing
· Presentation of Evidence capable of acceptance in court
· Final Assessment/Check on Learning
In order to ensure this training is successful, it’s necessary to procure the services of a recognized UAS digital forensics expert/vendor; in this case Spyder Forensics LLC.
7. A statement of the actions, if any, the agency will take to remove or overcome any barriers that led to restricted consideration before any subsequent acquisition for supplies and services is made.
The Government will continue to research the market to obtain as many available sources as required in accordance with the FAR to ensure that there are other vendors out there that can satisfy this requirement. In addition, the customer will do due diligence in ensuring that barriers to competition are avoided to ensure we obtain the best value for the government.
