About this file

This document is a Justification and Approval (J&A) for Other Than Full and Open Competition for the Department of Veterans Affairs. The acquisition involves procuring two Acoustic Systems Audio Booths for the Hamilton and Clermont Community Based Outpatient Clinics (CBOCs), with a total estimated cost of $271,100.00. The period of performance is 8/15/2025 – 2/15/2026, with anticipated delivery in October and November 2025.

The sole source justification is based on e3 Diagnostics, Inc. being the only vendor capable of providing these specific audio booths, which are dimensionally matched to pre-existing concrete spaces in the clinics. Market research was conducted, including posting a Notice of Intent to Sole Source on GPE on July 31, 2025, with an August 7, 2025 response date. No vendors responded, and the booths are domestic end products made in the USA. The procurement is for a Firm-Fixed Price contract, and the contracting activity is the Cincinnati VA Medical Center, with approval signatures from the Contracting Officer and Branch Chief.

DEPARTMENT OF VETERANS AFFAIRS

Justification and Approval (J&A) For

Other Than Full and Open Competition (>SAT)

Acquisition Plan Action ID: 36C250-25-AP- 4497

1. Contracting Activity: Department of Veterans Affairs, NCO10, Cincinnati VA Medical Center, Cincinnati, OH, submitted 2237 #539-25-3-050-0048 for (2) Audio Booths with accessories.

2. Nature and/or Description of the Action Being Processed: This is a Firm-Fixed Price contract for one Acoustic Systems Model RS-258 for the Hamilton Community Based Outpatient Clinic (CBOC) and one Acoustic Systems Custom Audio Booth for the Clermont CBOC.

3. Description of Supplies/Services Required to Meet the Agency’s Needs: Needed are: one Acoustic Systems Model RS-258 for the Hamilton CBOC and one Acoustic Systems Custom Audio Booth for the Clermont CBOC. POP is 8/15/2025 – 2/15/2026. Anticipated deliver date is October and Novermber, 2025.

The estimated cost is $271,100.00

4. Statutory Authority Permitting Other than Full and Open Competition:

(x) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per 41 USC §3304(a)(1) as implemented by FAR 6.302-1;

( ) (2) Unusual and Compelling Urgency per 41 USC §3304(a)(2) as implemented by FAR 6.302-2;

( ) (3) Industrial Mobilization, Engineering, Developmental or Research Capability or Expert Services per 41 USC §3304(a)(3) as implemented by FAR 6.302-3;

( ) (7) Public Interest per 41 USC §3304(a)(7) as implemented by FAR 6.302-7;

5. Demonstration that the Contractor’s Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): Cincinnati already uses the Acoustics System Audiology Hearing booths. All equipment and supplies will correlate with this Audiology Booth. Constructions has occurred and Audio booth specs are set. Space design required the concrete be poured based on criteria that are specific to the booth being put into that space.

When the space was designed, this booth was used to create the design. Any other booth will not have the exact dimensions required to appropriately fit in the poured concrete space. Other Audiology booths do not match the specification required. Time is of the essence as the CBOCs open fall 2025. Accordingly, e3 Diagnostics, Inc. is the only firm capable of providing the supplies and services described in Section III above without the Veteran’s Health Administration experiencing unacceptable delays in fulfilling its requirements

Included was information on Audio Booth models and requirements for the two CBOCs. No vendors responded.

7. Determination by the CO that the Anticipated Cost to the Government will be Fair and Reasonable: We are proceeding with a sole source justification and the price is similar to other like items recently awarded. The price is determined to be fair and reasonable by reviewing market trends and ensuring the contractor's costs align with industry standards.
