About this file

This is a Sole-Source Justification document for consulting services from the Department of Health and Human Services, National Institute of Health (NIH), specifically the National Institute of Drug Abuse (NIDA) and Office of Translational Initiatives and Program Innovations (OTIPI). The document justifies a sole-source award to a Woman-Owned Small Business (WOSB) for consulting services related to medical device development under the Blueprint MedTech Initiative.

The requirement is for a consultant to provide feedback to NIH program leadership and technical guidance on medical device development projects within the Blueprint MedTech initiative portfolio, serving as an External Oversight Committee member. This is a follow-on requirement to Purchase Order No. 75N95024P00031, structured as a Time & Materials/Labor Hour contract not to exceed $150,000. The incumbent contractor, Rhonda Robinson Beale, is being awarded this sole-source contract under NAICS code 541990 as a WOSB, with the total procurement not to exceed $4.5 million. The justification cites acceptable past performance and the vendor's status as a woman-owned small business in an underrepresented NAICS code as rationale for the sole-source award.

Revised10/31/2016

FAR Subpart 13.106-1(b)

4. Acquisition Type.

Time & Materials/Labor Hour. This acquisition exceeds $3,500 and not expected to exceed $150,000, and conducted in accordance with FAR Part 13—Simplified Acquisition Procedures.

5. Acquisition Authority. This acquisition is conducted under the authority of the Federal Acquisition Regulations (FAR) Subpart 13.106-1 (b) Soliciting from a single source. (1) For purchases not exceeding the simplified acquisition threshold, contracting officers may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, or industrial mobilization).

6. Justification Rationale.

FAR 19.1506 states that a contracting officer shall consider a contract award to a WOSB concern eligible under the WOSB Program on a sole-source basis before considering small business set-asides (see 19.203 and subpart 19.5) provided none of the exclusions at 19.1504 apply.

Rhonda Robinson Beale is the incumbent contractor under the predecessor contract, and is a WOSB, and this procurement is solicited under a NAICS code (541990) in which SBA has determined that WOSB are substantially underrepresented in Federal procurement. The expected procurement will not exceed $4.5 million, and Rhonda Robinson Beale has been determined to be a responsible contractor with respect to performance.

It is anticipated that prices for this requirement shall be at the vendor’s standard commercial rate, and NIDA shall compare the proposed prices to similar and historical contracts to verify that the prices are fair and reasonable.

7. Any other facts supporting the justification. None.
