Document Type: Justification Restricting Competition (Sole Source Justification)

This document is a federal contracting justification for a sole source acquisition of the System 90 Slat Wall Shelving System from Metal Dynamics, Ltd., a small business. The requiring activity is Commander, U.S. Fleet Forces Command (USFFC) in Norfolk, Virginia, with the contracting activity being NAVSUP Fleet Logistics Center (FLC) Norfolk. The procurement covers purchase, installation, and maintenance of the shelving system for renovating the ships store space on board the Navy's Auxiliary Personnel Lighter (APL) 61 barge. The estimated delivery and installation date is August 14, 2026, and the contract will be funded with FY26 Operation and Maintenance, Navy (OM&N) funds. The estimated total contract value has been redacted in the document.

The justification cites 41 U.S.C. 1901 and FAR 12.102(b) as the statutory authority for this sole source action using simplified acquisition procedures. Metal Dynamics is identified as the proprietary owner and only manufacturer of the System 90 shelving system, which features patented and proprietary design for shelves, fixtures, counters, and showcases that conform to Navy specifications outlined in Section 654 of general specifications for U.S. Navy ships. Metal Dynamics is the approved NAVSEA supplier and installer of ship store furnishings per NSWCCD Code 9783 and Habitability Procurement Message R031615Z20 MAR 20. The rationale emphasizes that maintaining conformity with existing fleet ship store shelving systems enables greater interoperability and flexibility of parts and materials across the fleet, and using alternative systems would hinder fleet-wide interoperability. The Contracting Officer determined the anticipated cost to be fair and reasonable, and market research confirmed only Metal Dynamics can provide the required system. The contracting activity currently has no plans to compete future contracts for these supplies/services. Joseph DeLibero (joseph.d.deliibero.civ@us.navy.mil) is the contracting point of contact. The justification was legally approved by John Venskus on February 26, 2026.

2. Description of the Action Being Approved.

This is a sole source action for the purchase, installation, and maintenance of the System 90 Slat Wall Shelving System from Metal Dynamics, Ltd. small business for the renovation of the ships store space on board APL) 61 barge. This is a new requirement.

3. Description of Supplies/Services.

The System 90 Slat Wall Shelving System is to be acquired. The estimated total value of the requirement is . The resultant contract will be funded with FY26 Operation and Maintenance, Navy (OM&N) funds that are currently available. The estimated delivery and installation date is August 14, 2026.

4. Statutory Authority Permitting Sole-Source.

The statutory authority permitting this sole source action is 41 U.S.C 1901, Simplified Acquisition Procedures, a sole source acquisition using simplified acquisition procedures for the acquisition of commercial items, as implemented by FAR 12.102(b).

5. Rationale Justifying Use of Cited Statutory Authority.

Metal Dynamics is the proprietary owner of the System 90 Slat Wall Shelving System and is the only company that manufactures and sells it. The shelving, fixtures, counter, and showcases design have a patent and are proprietary. They match various other store visual merchandising products.

The System 90 Slat Wall Shelving System conforms to all salient physical, functional, and other characteristics to the ship store shelving systems that are on board the Fleet Ships Stores afloat.

These shelving requirements are detailed in the general specifications for ships of the US Navy, Section 654. Metal Dynamics is the approved NAVSEA supplier and installer of ship store furnishings by NSWCCD, Code 9783, and in accordance with Habitability Procurement Message R031615Z20 MAR 20.

The procurement of the System 90 Slat Wall Shelving System is necessary to conform to the existing ship store shelving systems that are on board the Fleet Ships Stores afloat. Maintaining conformity by using the same make/model fixtures currently on fleet ships stores allows for greater flexibility and interchangeability between the barge and existing vessels. Using any other shelving system would hinder interoperability of parts/materials across the fleet. Additionally, using the System 90 shelving system allows for interoperability of equipment between ships stores and their supporting barges as well as consistency in procurement of matching replacement

If another potential source emerges, the contracting activity will assess whether competition for future requirements is feasible.

9. Contracting Point of Contact. The point of contact at the contracting activity is Joseph DeLibero at email joseph.d.deliibero.civ@us.navy.mil.
