SOLE SOURCE JUSTIFICATION (SSJ)

FOR ACTIONS SIMPLIFIED ACQUISITION THRESHOLD (SAT)

PRlSolicitation Number: N6055024RC001RT Quote:Q-00120760-V2 Code: R130

1) Agency, Contracting Activity and Purpose: Forward Deployed Regional Maintenance Center (FDRMC) Detachment Rota supports the fleet by executing maintenance in a safe, timely manner, and in accordance with the Joint Fleet Maintenance Manual Vol V.

2) Description of the Supply or Service being procured, its intended use and anticipated/estimated value

a. Describe the product or service (provide make, model, product serial number/part number-include a spreadsheet if necessary).

3D IPLEX Borescope System and accessories QTY 2 3 year warranty is included for all IPLEX 3D Borescope system components at no additional cost

b. What is its intended use or purpose? These units are essential to identifr, assess and evaluate potential defects in inaccessible critical shipboard systems and other assemblies in I-Level Maintenance facilities.

c. What is the total estimated cost ofthis/these products or services (include any option periods, required _.diiyerv4ate/period of performance if applicable)?

3) Possible Authority for Non-Competitive Procurement

a. Sole/Limited Source Procurement ((Sole Source: Only one source exists with no known distributors of the required product or service. Only One Responsible/Capable Source JAW either FAR 8.405-6(a), FAR 13.106-1(b) or FAR 16.505(b)(2)).

FAR 13.106- 1(b)(1)(i) states for purchase not exceeding the simplified acquisition threshold, Contracting Officers may solicit from one source if the Contracting Officer determines that the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, brand-name or industrial mobilization).

As required by FAR 13.106-3(b)(3)(i), this memorandum explains the absence of competition for this acquisition, as only one source will be solicited for this requirement (or for a portion of the requirement) and the requirement is not expected to exceed the simplified acquisition threshold.

b. lED Brand Name Requirement ((Brand Name: Only one manufacturer with multiple distributors (this justification covers only the portion of the acquisition which is brand name). Item Peculiar to One Manufacturer with multiple distributors/resellers/vendors JAW FAR 8.405-6(b), FAR 13.106-1(b) or FAR 16.505(a)(4)).

5) Provide rationale and justification reardin the above selection.

The borescope equipment will be used to perform inspections and troubleshooting efforts on U.S. Navy assets. The criticality of this equipment requires quick response in order to support all U.S. Navy ships in Rota. The technical features provided by these systems are required so that FDRMC can meet its customer's service need and demands, performing duties as a repair maintenance facility.

As stated below in the Market Research section, vendor quotes and brochures were requested from various sources by requesting information through emails an4 phone calls. Only two vendors responded, Evident Scientific and Waygate Technologies. The equipment from Waygate Technologies did not meet the 3D capabilities and other salient technical requirements of the specifications, while the equipment from Evident Scientific does. Evident's IPLEX 3D systems include precise measurement software, which is proprietary and patented. These systems meets all of FDRMC's requirements. Evident Europe GmbH responded to the Government's sources sought notice, but the European distributor is not registered in SAM and is therefore ineligible to receive a Government contract.

The customer states that in the event one unit becomes inoperable, the interchangeability between components provides a redundant capability between multiple codes for seamless use.

No other vendors can provide the Interchangeable 3D features and processes provided by the Olympus IPLEX. As such, the customer requests to purchase the borescope systems from Evident Scientific, Inc.

6) Describe the Market Research conducted.

As stated above, the customer contacted multiple vendors throughout the United States and Europe to see if there were alternative products that offer the technical capabilities offered by the Olympus IPLEX borescope systems sold by Evident Scientific. The products offered by the responding vendors lacked the technical capabilities reqiired by FDRMC. Additionally, the Olympus units are used throughout the Dept.

ofDefense and have a 3 Year Warranty at no additional cost to the US Government.

The contract specialist posted a sources sought notice to NECO and Sam.gov. One response was received from an Evident Scientific distributor located in Barcelona, Spain. The contract specialist spoke with the vendor, and they indicated that they are an authorized distributor for Evident Scientific in Spain, and are interested in providing these products to the US Navy in Rota. However, the local distributor is not registered in SAM; based on previous experience, it could take several months to get the vendor registered in SAM, which would delay shipment to the customer.

7) Any other information of facts supporting the justification to limit competition not described elsewhere on this form (i.e. international agreement).

8) Provide a statement of actions that will be taken to remove or overcome any barriers to competition prior to any future procurements for this Supply or Service.

The customer and the contracting office will continue to perfom market research in order to identify any available companies that may be able to meet the government's needs should future requirements arise. In the event other vendors supplying alternative brands that meet requirements necessary for production capabilities become available, FDRMC will request quotes from these vendors.
