U.S. Department of Navy Naval Research Laboratory Small Purchase Branch

USE OF OTHER THAN FULL AND OPEN COMPETITION FOR AN ACQUISITION UNDER

THE SIMPLIFIED ACQUISITION THRESHOLD – (exceeding $10,000 $250,000)

Purchase Request No.

Estimated Cost (including options, if any)

FAR 13.106 1(b)(1)(i) states for purchases not exceeding the simplified acquisition threshold, Contracting Officers may solicit from one source if the Contracting Officer determines that the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, brand name or industrial mobilization).

As required by FAR 13.106 3(b)(3)(i), this justification explains the absence of competition for this acquisition, as only one source will be solicited for this requirement (or for a portion of the requirement) and the requirement is not expected to exceed the simplified acquisition threshold.

DESCRIPTION OF ITEM OR SERVICE: (Provide a description of the item or service required, to include its intended use, the name of the required source or brand name, and the required delivery date/period of performance.)

THE DETERMINATION FOR USE OF OTHER THAN FULL AND OPEN COMPETITION IS BASED ON THE FOLLOWING (select all that apply):

A. ONLY ONE RESPONSIBLE SOURCE (select all that apply):

1. RESTRICTIVE RIGHTS. The source has established proprietary rights, limited rights in data, patent rights, copyrights or secret processes in the item or service required. (Explain what rights are restricted, why the restrictive rights make the required item or service available from only one source, and why another company could not satisfy the Government’s need.)

2. EXCLUSIVE LICENSING AGREEMENTS. The item or service is only available from the Original Equipment Manufacturer (OEM), or there is only one authorized distributor or technical representative for the OEM. (Identify the OEM and explain the circumstances surrounding why the item or service is only available from the OEM).

THE DANGERS OF HYDROFLUORIC ACID

Although considered a weak acid, HF is one of he most dangerous inorganic acids known. Burns of as lit le as 1% body surface area (BSA), or approximately 25 sq in (about the size of he palm of your hand), have been known to be fatal due to the acid's unique properties.

HF penetrates issue more quickly than typical acids. Because of this ability, systemic toxicity can occur by dermal, ocular, inhalation and oral routes. When human tissue is exposed to concentrated HF, the molecules disassociate into individual hydrogen and fluoride ions. The hydrogen ion burns like any other acid. The fluoride ion quickly penetrates dermal and muscle tissue and reacts with the calcium and magnesium found within the body, rendering these ions useless. Major organs or systems hat are especially vulnerable to damage are the heart, liver, kidneys and nerves. Exposures of 6%-8% BSA burns of concentrations above 50% HF almost always prove fatal within hours.

At lower concentra ions, death can still occur if definitive treatment is not sought quickly. HF interferes with nerve function, so burns from lower concentrations may not be initially painful.

Accidental exposures can go unnoticed for hours or even days, delaying treatment and increasing the extent and seriousness of the injury. This is extremely dangerous because victims may not recognize that they are injured. Death may result from the associated hypocalcemia or hypomagnesemia if too much damage is done before treatment is sought.

The CS Clean HF scrubber is built by CS Clean and they are the sole source provider for the replacement cartridges designed exclusively to work in their proprietary designed HF scrubber.

As explained above, HF is extremely dangerous, and the manufacturer will not warrant nor be responsible for any failure of the HF scrubber if anything but CS Clean cartridges are used. To maintain maximum assurance of the safety of all persons that use the NSI where this system is
