About this file

This document is a Single Source Justification for Simplified Acquisition Procedures (SAP) under the Simplified Acquisition Threshold (SAT) for the procurement of an ophthalmologic laser by the Department of Veterans Affairs (VA) for the John D. Dingell VA Medical Center in Detroit, MI.

The VA is seeking to procure a Lumenis Digital Duet ophthalmologic laser system to provide treatment and therapy for various optical conditions. The estimated value of the procurement is under the SAT of $250,000. The justification states that the Lumenis Digital Duet is the only system that meets the unique requirements, including the ability to take images/videos, generate digital treatment reports, and connect to the facility's electronic medical records. The VA conducted market research but found no other competitive sources. As a result, the procurement will be solicited on an unrestricted, open market basis per FAR Part 13 guidance.

Acquisition Plan Action ID:

1. Contracting Activity: Department of Veterans Affairs, NCO 10, 8888 Keystone Crossing, Indianapolis, IN 46240. In support of John D. Dingell VA Medical Center, Detroit, MI.

2237:

2. Brief Description of Supplies/ Services required and the intended use/Estimated Amount: The Ophthalmology Clinic at the John D. Dingell VAMC has a new requirement for an ophthalmologic laser to provide treatment/therapy for various optical maladies, to include cataracts, glaucoma, and retinal inefficiencies. The service has requested the Digital Duet, manufactured by Lumenis BE, Inc (OTSB). The estimated amount of this procurement is:

3. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used: Brand name only. The Lumenis Digital Duet reimagines laser therapy with the first digital dual path SLT-YAG platform on the market. The Digital Duet platform is a comprehensive digital and imaging solution that streamlines practice efficiency and offers new ways to communicate with patients and peers.

The Digital Duet is the first and only digital platform that allows the taking of images and videos of ophthalmologic treatment, generate digital treatment reports, and the capability to connect to the facility’s local EMR (clinic requirements). Lastly, the laser system is ADA-compliant, which allows wheelchair accessibility to veteran patients (treatments can be performed without having to transfer to an exam chair/table).

4. Description of market research conducted and results or statement why it was not conducted: Queried SBA VetCert database using NAICS 339112 and 658 concerns were found. Queried DSBS database with same NAICS code and keywords “optical laser”, and zero concerns were found.

Required item(s) were searched by item number on GSA Advantage, the Supply Chain Master Catalog, and NAC websites and produced zero results. The OEM has only one authorized distributor.

A search of the FPDS website found that purchase order #, which was awarded by, on (for the exact item requested for this procurement) matched the IGCE of this procurement; the awardee of the purchase order was.

The VA Rule of Two cannot be met due to the NMR. Given market research results, there is no reasonable expectation that competitive offers will be received from two or more small businesses, thus the SBA Rule of Two cannot be met. Requirement will be posted on Contract Opportunities as an open market/unrestricted solicitation per FAR Part 13 guidance.

5. Contracting Officer's Certification: Purchase is approved in accordance with FAR13.106-1(b). I certify that the foregoing justification is accurate and complete to the best of my knowledge and belief.
