About this file

This document is a single source justification for the purchase of two GI waste management systems from Stryker Instruments for the Wyoming, MI Endoscopy Clinic, which is part of the Battle Creek, MI VA network. The clinic requires replacement of its current unreliable wall suction system with the Neptune S Rover closed low-fluid waste management system, which is the only product currently available that meets the clinic's needs for primary suction during GI procedures. Market research found no other authorized distributors for the required line items. As no other products can satisfy the unique needs, a single source award is recommended to the original equipment manufacturer, Stryker Instruments.

VHAPG Part 813.106 Simplified Acquisition Procedures: Soliciting from a Single Source Attachment 1: Single Source Justification for SAP under the SAT

DEPARTMENT OF VETERANS AFFAIRS

Justification for Single Source Awards IAW FAR 13.106-1 For Over Micro-Purchase Threshold but Not Exceeding the SAT ($250K)

Acquisition Plan Action ID:

1. Contracting Activity: Department of Veterans Affairs, NCO 10, Battle Creek VA Medical Center, Battle Creek, MI. 2237:

2. Brief Description of Supplies/ Services required and the intended use/Estimated Amount: The Wyoming, MI Endoscopy Clinic (part of the Battle Creek, MI VA network), requires the purchase of two GI waste management systems to replace their current system that has met the end of its serviceable life. The service is requesting the Neptune S Rover system, which is manufactured by Stryker Instruments (OTSB). The estimated value of the proposed action is:

3. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used: Endoscopy procedures offered at the Wyoming CBOC are colonoscopy and esophagogastroduodenoscopy (EGD). Current suction system is a wall suction system (Environmate) that has been unreliable with frequent failures, resulting in disruptions to procedure schedules. The clinic opened a second procedure room in February 2023 to improve access to veterans. With the second procedure room, any equipment failure is highlighted due to no longer having a back-up procedure room. The current back up to the wall suction is an old Gomco portable suction unit with 1L canisters for fluid collection. The Gomco unit is not intended as the primary suction source for Endoscopy procedures. The added steps for setting up the backup suction and the need to exchange canisters during procedures (as well as in between procedures), prolongs procedure times and can delay start times of subsequent procedures.

The Neptune S Rover System is the only closed low-fluid waste management system currently on the market specifically for GI procedures. Other fluid collections system are canister systems like the Gomco and direct to drain systems like the Environmate and Streamaway.

4. Description of market research conducted and results or statement why it was not conducted: Queried SBA VetCert database using NAICS 339112 and 605 concerns were found. Queried DSBS database with same NAICS code and keyword “waste management”, and one concern was found.

Two of the six line required line items were located on GSA Advantage, with Stryker being the only distributor. All other line items are open market pricing. CS was able to obtain a list of authorized SDVOSB distributors from a recent Stryker Instruments procurement (distributor list uploaded to contract briefcase).

The VA Rule of Two cannot be met due to NMR. The SBA Rule of Two can be met. CS recommends SB set-aside, open market solicitation to be posted to SAM.gov, and award to the vendor who submits the lowest priced technically acceptable quote.

5. Contracting Officer's Certification: Purchase is approved in accordance with FAR13.106-1(b). I certify that the foregoing justification is accurate and complete to the best of my knowledge and belief.
