DETERMINATION TO SOLICIT FROM A SINGLE SOURCE

Pursuant to Federal Acquisition Regulation (FAR) 13.106-1(b)(1)(i), for purchases not exceeding the Simplified Acquisition Threshold (SAT) Contracting Officers may solicit from only one source if the circumstances of the contract action deem only one source is reasonably available (e.g., urgency, exclusive licensing agreements, brand name, or industrial mobilization).

Pursuant to FAR 13.106-1(b)(1)(ii), when a single source is identified to provide a portion of the purchase as a Brand-Name, the documentation in paragraph 3 must state that this determination is only for a portion of the requirement.

3. Description of Supplies/Services and Estimated Cost.

This BPA call is for payment of annual water share assessments to ensure delivery of water to URMCC lands. The estimated cost for this call is , which is within the BPA ceiling of $150,000 over five years.

4. Description of Circumstances, including why only one source is reasonably available.

Warm Springs Irrigation and Power Company is the sole provider because it owns and distributes water to URMCC lands under exclusive water share rights. No other sources can fulfill this requirement.

5. Determination of Fair and Reasonable Price.

Based on the Warm Springs Irrigation (WSI) 2026 budget detail (see ECS File Item D01), the proposed assessment price per share of is fair and reasonable compared to the 2025 rate of , reflecting a necessary increase of approximately 65.4%. This increase is driven by documented, non-discretionary cost growth and carryover obligations, including:

carryover from 2025 for chemical purchases (440 gallons at /gallon) for major ditch bank repair and culvert installation
