OFFICE OF ACQUISITION MANAGEMENT

ICE Acquisition Manual 3006.301-90

SOLE SOURCE JUSTIFICATION FOR SIMPLIFIED ACQUISITIONS

NOT EXCEEDING THE SIMPLIFIED ACQUISITON THRESHOLD

(INCLUDING BRAND-NAME)

☐ Brand name – If the brand name requirement applies to a portion of the procurement, please identify that portion.

☐ Industrial Mobilization ☐ Other

Rationale:

The current facility is approximately 32 miles away from FNY. Travel time has significantly increased post pandemic and ICE officers can spend over an hour each way on grildlocked and congested roads depending on the time of the day. This has greatly impacted their response time for public safety threats, such as convicted criminal noncitizens and gang members, as well as individuals who have otherwise violated our nation’s immigration laws, including those who illegally re-entered the country after being removed and immigration fugitives ordered removed by federal immigration judges.

The recommended facility offers the same services as the current facility and is 20 miles away from FNY and will decrease travel time noticeably which will decrease the officer’s response time for public safety threats and meet the ERO/FNY mission goals.

4. The anticipated price will be determined fair and reasonable based on one or more of the price analysis techniques described below in accordance with FAR Part 13.106- 3(a)(2). (Check one and provide short description of action taken.)

☐ Market Research.

☒ Comparison of the proposed price with prices found reasonable on previous purchases.

☐ Current price List.

☐ Comparison with similar items in a related industry.

☐ Comparison to IGCE.

☐ Contracting Officer’s personal knowledge.

☐ Other.

Short description of how price was determined fair and reasonable:

The total value for the current purchase order is . The recommended vendor has proposed to provide the same services for a total purchase order value and is or over lower than what the government is currently paying.
