SINGLE SOURCE JUSTIFICATION FOR SIMPLIFIED ACQUISITIONS ABOVE
THE MICRO-PURCHASE THRESHOLD AND UP TO SAT, INCLUDING BRAND NAME

1. Agency and Contracting Activity.
Pursuant to the requirements under the authority of simplified procedures for commercial items at 41 U.S.C. 1901 as implemented by Federal Acquisition Regulation (FAR) Subpart
13.501 and consistent with the content requirements of FAR 6.303-2.
The Department of Homeland Security, U.S. Immigration and Customs Enforcement (ICE), Office of Acquisition Management (OAQ), plans to enter into a contract on behalf of the Office of Firearms and Tactical Programs (OFTP) on a basis other than full and open competition. This document sets forth the justification and approval as required by FAR 13.501(a).
2. Nature and/or description of the item/service being procured and anticipated cost.
(a) Type of action: Firm-Fixed-Price (FFP) Purchase Order
(b) Amount the current J&A is justifying: $130,794.32
(c) ICE OFTP Armory Staff have a requirement to procure (38) Truss Series Bridging/Climbing Ladders 8' x 12" and (38) Series Assault Ladder 6" x 19".
Bridging/Climbing ladders weigh as little as 15.5 to 28 lbs depending length of system, with a load capacity of 300 lbs. This ladder provides both climbing and bridging capabilities. Hand made from aircraft grade aluminum, finished in non-skid, low noise signature coating in desert sand color. It’s a rugged feather-weight system. Versatile design allows vertical and horizontal applications with low noise signature. The Bridge is also rust-resistant, and durable. The Basic Series Assault ladder weigh 8lbs and has a load capacity of 300lbs. This ladder provides both climbing and bridging capabilities. Hand made from aircraft grade aluminum, finished in non-skid, low noise signature coating in desert sand color. It’s a rugged feather-weight system. Versatile design allows vertical and horizontal applications with low noise signature.
The Truss Series Bridging/Climbing Ladders and Series Assault Ladders are only available from one manufacturer, Ferno Military Systems, Inc, located at:

Rationale:
Due to the mobility and stabilization of the bridge necessary for rapid breaching maneuvers required by OFTP Armory Staff, no other ladders will satisfy ICE/OFTP’s needs due to the following:
1. This ladder provides both climbing and bridging capabilities. Hand made from aircraft grade aluminum, finished in non-skid, low noise signature coating in desert sand color.
2. It’s a rugged feather-weight system. Versatile design allows vertical and horizontal applications with low noise signature.
3. Additionally, the ladder is also rust-resistant, and durable. This type of ladder allows the
Officers easy movement and enables the Officer to maintain forward progress in order to breach the obstacle.
4. Ferno Military Systems, Inc is the original Equipment Manufacturer (OEM) of both ladder systems, and the distributor of these ladders.
4. The anticipated price will be determined fair and reasonable based on one or more of the price analysis techniques described below in accordance with FAR Part 13.106- 3(a)(2). (Check one and provide short description of action taken.)

Similar products that did not meet agency requirements were;
Rapid Assault tools: Lacks mobility; Some of its parts are loose and cannot be tightened enough. Does not have features that allow independent positioning. Does not have replaceable feet with optional tips.

Ruhl Folding Assault Ladder: The ladder did not stay tight to the platform and needed retightening after long use. Does not have features that allow independent positioning of the ladder. Does not have replaceable feet with optional tips.
Helix Kevlar Assault Ladder: Does not have features that allow independent positioning of the Ladder. Does not have replaceable feet with optional tips.

Efforts to obtain competition:
Due the Original Equipment Manufacturer (OEM) of both ladder systems, and the distributor of the equipment, only Ferno Military Systems is able to provide the required ladders. No other vendor in the open market can provide the following two OEM Truss Series Bridging/Climbing Ladders and Series Assault Ladders Therefore, this requirement is not available for competition; only a quote from Ferno Military Systems will be evaluated for fair and reasonable pricing.
