Justification for Single Source Awards IAW FAR 13.106-1 For

Over Micro-Purchase Threshold but Not Exceeding the SAT ($250K)

Acquisition Plan Action ID: 36C250-24-AP-3239

1. Contracting Activity: Department of Veterans Affairs, VISN 10, Station 583, Richard L. Roudebush VA Medical Center submits to Network Contracting Office (NCO) 10 located at 8888 Keystone Crossing, Suite 325, Indianapolis, IN 46240 a request from the Healthcare Technology Management Service for the PET/CT scanners Medrad Intego Infusion System Services with Bayer Healthcare.

Funding has been submitted on VA Form 2237# 583-24-3-169-0080 in the amount of $11,081.29.

2. Brief Description of Supplies/ Services required and the intended use/Estimated Amount: The VA owned Medrad Intego Infusion System requires a preventative maintenance and repair agreement for the PET/CT scanner systems. This infusion system is used to control and transfer medication to a patient during nuclear medicine procedures, and the total contract cost is estimated at $33,243.87.

The requested period of performance is for a one-year base period with four one year options to extend services.

3. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used:

It is common in the commercial marketplace that when proprietary information is part of a piece of high-tech medical equipment that the OEM is the only company authorized to perform preventative maintenance services. Changing the service provider from the OEM to any other source would eliminate access to support. Service cannot be provided by any other source to ensure the system is functioning to OEM standards. As Bayer Healthcare is the OEM, they are the only source capable to perform preventative maintenance services. This system is critical to PET/CT operations and must receive maintenance annually to remain compliant.

4. Description of market research conducted and results or statement why it was not conducted:

Market research was conducted in Vet Cert and the SBA DSBS website. We received zero responses from SDVOSB/VOSB concerns. The OEM, Bayer Healthcare, LLC., provided a letter stating they are the only authorized dealer who has proprietary software to provide calibrations and preventative maintenance on the Medrad Intego Infusion System. The CO and CS have no reasonable expectation that a SDVOSB, VOSB, or Small Business concern can provide the services needed.

5. Contracting Officer's Certification: Purchase is approved in accordance with FAR13.106-1(b)(1)(i) exclusive licensing agreements. I certify that the foregoing justification is accurate and complete to the best of my knowledge and belief.
